Court directs status quo be maintained, stays woman's vacating of premises

The Small Causes Court has directed that status-quo be maintained and a woman, along with her family, be allowed to live in a building that is part of the Bhendi Bazaar cluster redevelopment project.
The judgement was given by additional chief judge, SASM Ali and judge DP Shingade on September 24, 2014. The woman, Nafisa Masalawala, is a resident of Galabhai Chawl, Gujar Street, Bohri Mohalla and had filed a case to resist vacating the premises that is being redeveloped by the Saifee Burhani Upliftment Trust (SBUT).
The SBUT Behndi Bazaar project was the vision of the late 52nd Dai ul Mutlaq of the Dawoodi Bohra community, Syedna Mohammed Burhanuddin. It looks to provide better housing to members of the community which he headed, and those living in the cluster that is to be redeveloped.
"They did not give me any agreement and what I would be getting post redevelopment," said Nafisa. Her advocate argued in court that "SBUT, under the guise of demolishing the suit building, are trying to dispossess the plaintiff from the suit premises."
Nafisa's advocate further contended that SBUT was "Not providing suitable transit accommodation to the plaintiff, and also not ready to execute the registered agreement with the plaintiff to provide her permanent alternate accommodation in the newly constructed building that may be constructed after demolishing the present suit building. Therefore, the learned advocate urged that the appeal be allowed and status-quo be continued to protect possession and interests of the plaintiff."
The SBUT advocate however, argued that 47 of the 48 tenants in the building had moved out and if she did not, there would be danger to her life and that of her family. It also stated that Mumbai Buildings Repari and Reconstruction Board had directed it to demolish the building to avoid any untoward incident. The court stated that the two parties unfortunately could not settle the matter amicably.
It then stated that until another case is settled, Nafisa and her family be allowed to live there. "The original case is with respect to the tenancy rights of Nafisa," said Nasima Don, solicitor under whose firm the case was fought.
When contacted, SBUT issued a statement saying, "SBUT is a non-profit body that has always been sensitive to its tenants with tenant's safety at utmost priority. So far we have moved more than 1600 families to the residential transit accommodation that is better than their original homes. Legal agreements have been signed with all tenants and they have also been informed of the exact location of their new homes in Bhendi Bazaar. Once complete, the project will raise their standard of living immeasurably. Galabhai Chawl is one of the many such dilapidated buildings in the Bhendi Bazaar area which partially collapsed this monsoon. The building had been classified by MHADA two years ago as dangerous and unift for living. In interest of the larger society SBUT had safely moved more than 50 families to transit accommodation built by SBUT. However just one tenant refused to move in spite of the families' life being in danger. Galabhai Chawl not only poses serious threat to the one tenant living there but to the shopkeepers, their patrons, pedestrians and the surrounding areas as the pillars have given way and it can crumble down anytime."

Now this Nafisa ben is next Zehra ben.

But seems that building condition is danger, God forbids what if the building collapse? They are risking their lives.

A home is a very valuable emotional item to a person..it is worth giving a life too. It may sound easy that why not move ...but it is not.

The SBUT seems runs in classical Kothar way no docs , no agreements...so a person is transferring a multi million worth asset and in return no cash , no equivalent guaranteed asset just a promissory note !

There is an underlying sophisticated con business model I too am struggling to peel ! but is some thing that very astute business men would be familiar with that some one somewhere is going to hugely benefit ....is it kothar will suddenly be in position of a huge land value where they will lease back a flat to previous owners that was costed and paid for by other buyers of adjacent properties. There is probably profits from construction and current rates are 20-30% . Is it a sink to wash the black money to white and churn the Dawat offshore or onshore funds and send it to new accounts .

The public image is a charade

Such a huge undertaking ..wonder what and who will finance or provide finance guarantees. The construction companies or material suppliers will either seek that or will operate on payment upfront. If it is later then there is a huge pool of cash seating around.

The ONLY beneficiary is the Dai and his henchmen, they never do anything for free. This non-profit crap that they talk about is just hogwash to fool the general public. Mark my words that these con men will only develop the area surrounding Raudat Tahera as they want to beautify this mausoleum and the rest of the stuff will be sold lock stock and barrel to some builder at a hefty price after some time. Even this surrounding area will be sold to the rich NRI abdes at exhorbitant rates. This a cluster development project which has some huge extra benefits as compared to the normal buildings. As per the current govt policy they are entitled for an FSI of 4 which is very likely to be increased to 6 so one can imagine the amount of money that these con men will make by seling such huge FSI.

The tenants will then be at the mercy of the new developer who will set his own terms. The Dai will only say "Khuda tamne ghani barkat aapse" whereas the barkat will directly land in his swiss bank accounts and the Bohras will be left to fend for themselves for the Dai's "Harkat" !!

Look at his eyes, his frowning face which smacks of sheer arrogance which is the result of extreme power in Muffy raj derived from the multi billion dollar wealth looted from abdes.

The similarity to YN is striking actually. For all intents and purposes he is the one pulling the strings.

Don't know if this has already been posted here, but SBUT has moved out of their Main office from Husseini Towers. This may be because of all the irregularities they were doing.

Generally Raza comes for all business except directly haram like liquor. Oh i forgot that's the forte of Kothar itself (Ambassador hotel)
