Good to know that few people showed guts and refuse to move out without proper agreement. This dacoit family thought all dawoodi bohra are idiots and cowards like MS. Hats of to people like patrawala and masalawala.

I hope they are not threatened by mafia.

I had requested my relative to take money and live place but they chose to stay in the project because money offer to them was less compare to non bohra.

Also there are some road construction work is going on by municipality. Wondering if the project is going for redevelopment in a short time, municipality must be aware of, so what is the need for road construction when in near future every thing has to be destroyed for SBUT.

A section of Bhendi Bazar residents have refused to move out of their houses to make way for the Saifee Burhani Upliftment Trust (SBUT)-led cluster redevelopment project, calling the draft agreement they are being asked to sign with the trust 'unfair, arbitrary' and akin to signing their own 'life imprisonment' sentences.

Among the clauses the residents have objected to are the ones that allow SBUT to retain all future development rights over the entire redeveloped layout even after formation of new cooperative housing societies. One such clause says that only SBUT will decide how to use any increase in Floor Space Index available to a housing society in the redeveloped enclave.

The religious mafias are not satisfied with the billions they will generate through this project and still want to exploit the extra FSI in future and make still more money !!

The residents' letter refers to a clause in the draft agreement which uses the word 'may' instead of 'can' in connection with their right to sell or transfer ownership of properties in the redeveloped buildings.

The mafias want to make money even when the tenants decide to sell off their flats as without SBUT's consent they cant sell their property...... Seriously greed has no limits and these mafias under the leadership of the new ring master are out to squeeze the last penny from Bohras !!

CHOUHAN BOUGHT BANDUKWALA BUILDING IN 2004 AND ABID MANZIL IN 2005. HE GOT THE CONSENTS OF ALMOST 90% TENANTS OF THESE BUILDINGS WITHOUT ANY FUSS AND SO WAS ABLE TO COMPLETE HUSAINI TOWER AS EARLY AS JANUARY 2010, WITHOUT ANY HINDRANCE AT ALL FROM THE OLD TENANTS, AFTER HAVING STARTED WORK IN JANUARY 2008 WITH THE FOUNDATION STONE ITSELF BEING LAID BY THE NOW CHAIRMAN OF SBUT, SHZ. QAIDJOHAR BS AND HE HIMSELF HAD BOOKED THE 17TH FLOOR AS A TOKEN AT THAT VERY MOMENT.

THE ROYAL FAMILY HAD ALREADY ESTABLISHED THE SAIFEE BURHANI UPLIFTMENT TRUST ON 23/01/2009 AND IN JUNE 2010 OFFICIALLY PURCHASED FLAT NOS. 1103,1303,1304,1403, 17TH,18TH,19TH,20TH & FLAT NO. 2101.

EVEN THEIR SALE DEEDS CLEARLY MENTION THESE PREMISES ONLY FOR RESIDENTIAL PURPOSE.

MEANWHILE SBUT'S OFFICE BEARERS TOOK THESE ISSUES TO BE MANAGEABLE BY THEIR POWERFUL CONNECTIONS, AS CONGRESS HAD ALREADY WON THE 2009 LOK SABHA & VIDHAAN SABHA ELECTIONS AND BOTH, MP MILINDBHAI DEORA & MLA AMINBHAI PATEL WERE AT THEIR DISPOSAL.

THESE CONSULTANTS FAILED MISERABLY, SO AN IN-HOUSE ENTITY, M/S. ALAMDAR INFRASTRUCTURE PVT. LTD. WAS THEN CREATED AND ENTRUSTED WITH THE JOB OF OBTAINING THE CONSENTS.

WILLING & UNSUSPECTING LANDLORDS STARTED SELLING OFF THEIR BUILDINGS AT BELOW PAR PRICES TO ASSIST THE PROJECT. THE NOT SO ALERT TENANTS OF GALABHAI CHAWL AND MOHAMMEDI TAIYEBI BUILDINGS ALSO AGREED WHOLE-HEARTEDLY AND STARTED MOVING TO THE TRANSIT ACCOMMODATION IN ANJEERWADI.

THERE WERE MURMURS FROM SOME LANDLORDS AND TENANTS ALIKE, WHO SHOULD HAVE BEEN TAKEN INTO CONFIDENCE TO EFFECTIVELY BEGIN THE DEVELOPMENT. HOWEVER, VESTED INTERESTS WITHIN THE SBUT STARTED SPOILING THE IMAGE OF SBUT BY INDULGING THE NAME OF SBUT IN SHADY DEALINGS AS WELL AS DEPLOYING DUBIOUS METHODS TO CONVINCE THE OBJECTING LANDLORDS/TENANTS ALIKE. MOST OF THESE OFFICE BEARERS THEN STARTED FINDING THE GOING TOUGH AND SO THEY EITHER EXCUSED THEMSELVES OR WERE EXCUSED BY THE HIGHER UPS IN SBUT.

ONE SUCH CASE WAS THE HANDLING OF TENANTS OF THE ALREADY REDEVELOPED BURHANI HEIGHTS IN PHOTO GULLY. HERE SBUT BLINDLY BOUGHT THE RIGHTS OF REDEVELOPMENT OF BURHANI HEIGHTS FROM ITS EXISTING DEVELOPER FAIZAN MALIK. THEY SHOULD HAVE APPROACHED THE EXISTING TENANTS WITH VIABLE OFFERS, BUT THE TRUSTEES ENTRUSTED THE DEALING TO MURTUZA BAKER, SHK. ABDEALI KOTHARI (BHANPURAWALA), SHABBIRBHAI MORBIWALA, ADV. MOHAMMEDBHAI SINGAPOREWALA, SHK. ASGARBHAI ARSIWALA, MURTUZA RAJKOTWALA AND HOZEFA ELECTRICWALA UNDER THE AEGIS OF JUZER BS SHAKIR & SHOAIB BS HASHMI, WHO ALL BOTCHED UP THE ENTIRE SCENARIO AND SBUT HAS HAD TO FACE THE MUSIC OF ATTENDING THE MAZGAON COURT AS THE TENANTS OF BURHANI HEIGHTS THEN WENT ON TO FILE A CRIMINAL SUIT AGAINST SBUT. The Chittalwala building stands right next to Raudat Tahera but Kothari goons are unable to grab the same as Chittalwalas are a wealthy family having very good contacts in the government, moreover they are not at all the typical abdes whom Kothar can pressurise.

Maharashtra New DP/DCR

Redevelopment work will be difficult now with DCR.

Municipal Corporation of Mumbai has proposed new DP and DCR 2034 for Mumbai city. The new rules are quite different from what all are following presently. Few major changes coming up in these new rules :-

a) They have removed 35% funging which was free for existing tenants which is a major point affecting all.

b) 6 metre space has to be left on all four sides of a building.

c) The new FSI will cover staircase, lobby and lift which earlier were exempted. Now you have to pay premium for the same and less area to be offered to society.

d) Present FSI is 1 plus 35% funging i.e. 27% whereas the new FSI will be 3.5 and 5 but additional will be on the payment of rate as per Ready Reckoner. Also to be noted, that against 5 FSI you will have to spare 25% of FSI for staircase, lift and lobby. In other words you will be left with FSI of 3.75 for redevelopment.

In view of these changes as mentioned above, redevelopment looks impossible for small plots.

It appears, no new projects will be announced shortly !!

I heard that SBUT wont commit further until this dawedar case is resolved , this is being used as an excuse to buy time such that most of the oldie abdes above 65 yrs would not remain alive and hence could not stake claim. Legally the dai is owner of SBUT and dai itslef is in question hence first ownership title would need to be cleared and then SBUT development would start.
