ISIL establishes Caliphate, Is it Valid?

#1

Unread post by qutbudin » Tue Jul 01, 2014 12:42 pm

The ISIL [recently claimed establishment of an Islamic caliphate][1] with the following statement:
"The Shura (council) of the Islamic State met and discussed this issue (of the caliphate)... The Islamic State decided to establish an Islamic caliphate and to designate a caliph for the state of the Muslims," said ISIS spokesman Abu Mohammad al-Adnani.
which is fighting to bring the Muslim lands into one Islamic nation and essentially has claimed/declared war the enemies of Islam. Also the leader has [claimed to be from the progeny of Fatima (A.S)][2] which they claim is a requirement for a future leader. Also they clearly are not fighting for a nation or piece of land but [to establish a caliphate][3], Is such a caliphate valid according to Quran and Sunnah?

Note: The group also [has some twitter accounts][4] which explain their views.
They have released an [official press release][5] on public twitter account changing their name to "Islamic State" from ISIL with following declaration:
>
Therefore, the shūrā (consultation) council of the Islamic State studied this matter after the Islamic State
– by Allah’s grace – gained the essentials necessary for khilāfah, which the Muslims are sinful for if they
do not try to establish. In light of the fact that the Islamic State has no shar’ī (legal) constraint or excuse
that can justify delaying or neglecting the establishment of the khilāfah such that it would not be sinful,
the Islamic State – represented by ahlul-halli-wal-‘aqd (its people of authority), consisting of its senior
figures, leaders, and the shūrā council – resolved to announce the establishment of the Islamic khilāfah,
the appointment of a khalīfah for the Muslims, and the pledge of allegiance to the shaykh (sheikh), the
mujāhid, the scholar who practices what he preaches, the worshipper, the leader, the warrior, the reviver,
descendent from the family of the Prophet, the slave of Allah, Ibrāhīm Ibn ‘Awwād Ibn Ibrāhīm Ibn ‘Alī
Ibn Muhammad al-Badrī al-Hāshimī al-Husaynī al-Qurashī by lineage, as-Sāmurrā’ī by birth and
upbringing, al-Baghdādī by residence and scholarship. And he has accepted the bay’ah (pledge of
allegiance). Thus, he is the imam and khalīfah for the Muslims everywhere. Accordingly, the “Iraq and
Shām” in the name of the Islamic State is henceforth removed from all official deliberations and
communications, and the official name is the Islamic State from the date of this declaration.
We clarify to the Muslims that with this declaration of khilāfah, it is incumbent upon all Muslims to pledge
allegiance to the khalīfah Ibrāhīm and support him (may Allah preserve him). The legality of all emirates,
groups, states, and organizations, becomes null by the expansion of the khilāfah’s authority and arrival of
its troops to their areas. Imam Ahmad (may Allah have mercy upon him) said, as reported by ‘Abdūs Ibn
Mālik al-‘Attār, “It is not permissible for anyone who believes in Allah to sleep without considering as
his leader whoever conquers them by the sword until he becomes khalīfah and is called Amīrul-Mu’minīn
(the leader of the believers), whether this leader is righteous or sinful.”
Note this question asks for the fiqh ruling about this event, like is this fard kifaya or this event can be safely ignored?

ISIS leader calls for Muslims to help build Islamic state in Iraq
'Rush to your state'

He said the Islamic state is a land for all Muslims regardless of nationality, telling them it "will return your dignity, might, rights, and leadership."

"It is a state where the Arab and non-Arab, the white man and black man, the easterner and westerner are all brothers," he said — an appeal aimed at broadening his support base beyond the Middle East. "Muslims, rush to your state. Yes, it is your state. Rush, because Syria is not for the Syrians, and Iraq is not for the Iraqis. The earth is Allah's."

To help build that state, he appealed to those with practical skills — scholars, judges, doctors, engineers and people with military and administrative expertise — to come "answer the dire need of the Muslims for them."

He also called on jihadi fighters to escalate fighting in the holy month of Ramadan, which began on Sunday. "In this virtuous month or in any other month, there is no deed better than jihad in the path of Allah, so take advantage of this opportunity and walk the path of you righteous predecessors," he said. "So to arms, to arms, soldiers of the Islamic state, fight, fight."

Al-Baghdadi also urged Muslims worldwide to "Stand up and rise. For the time has come for you to free yourself from the shackles of weakness, and stand in the face of tyranny."

The audio was posted on militant websites where the group has issued statements in the past, and the voice resembled that on other audiotapes said to be by the shadowy al-Baghdadi, an Iraqi militant who has rarely been photographed or appeared in public.

I am not Sunni but I do attend their Mosques and Salahs and very active with Muslim community in general and NO ONE has accepted and almost all have condemned their acts and donot even consider them as Muslims. For more to learn about American Muslim reaction do visit the website of Islamic Society of North America (www.isna.net) to get a good prospective of Muslims both Sunni and Shia

But there is no official statement. Have they read their primary sources and talked to them? Here in tablighi jamat and jamat islami circles they seem to have a soft corner and they say that they are waiting for deoband fatwa.

There is no official statements from any Muslim Organizations about accepting as a matter of fact many Islamist groups including Al Qaida have distanced themselves from ISIS and declared that ISIS announcement of Caliphate is heresy

Heresy means Biddat, this is certainly not Bidat. Moreover there are many news reports which spread malicious info to defame Muslims and stop caliphate.

eg: "ISIS will attack kaba and demolish kaba "was a news spread by major media houses. Which isis officially denounced in their twitter accounts.
