Yes what is wrong is to break the law to slaughter a goat in conditions that are unacceptable as set by local authorities . There would be fines not jail sentences . Issues would be raised by animal welfare or local councils .

People might be scared and taking precautions to avoid further arrests or media outburst while the current criminal case is ongoing.
I do know that applying blood or shaving babies head is not harming the child in any way, but seeing the conditions in Sydney at present, people are really scared to perform aqiqa rituals as it involves a new born baby.

Bori85 good on them that they can look after themselves and not break laws in Sydney ...but they should know that Mebourne is in Australia and they too have a Victoria Police Force so trying to carry out illegal activities in Melbourne is dangerous for them. May be the Melbourne Amil is getting reckless and is not reading news . Keep us posted ...as they say the long arm of the law will reach them.

May be they should do aqiqa using Skype from somewhere in Pakistan ...this should be ok since I have seen Abdes do sajada and join hands when they watch a Moulas relay !

There was a court hearing on 7 Feb and a new date has been given by the court which will be another hearing in a few months time . The case continues.

Two pieces examining the taboo topic of Female Genital Mutilation (FGM) also won awards.

World News Australia's Katrina Yu picked up Best Investigative Story of the Year. Her television report broadcast last March looked at the difficult transition many women from FGM-practicing countries make when they arrive in Australia, and the need for the health system to cater to new migrants dealing with the physicial and pyschological effects of the practice.

"It took many months of research and liaising with communities and inidviduals to earn the trust that was required to put his story together," said SBS reporter Katrian Yu. "The African community is one of Australia's fastest growing migrant communities of the past decade. Many women from FGM-practicing countries should have access to the necessary health services and also cultural support and education to allow them to understand that this practice is unacceptable in Australia."

A column in Arabic newspaper El Telegraph that explored the need to bring discussion about FGM out of the shadows, picked up the Best Editorial or Commentary award. Editor Hani Elturk's piece explained the illegality of the practice and emphasised that there is nothing in Islamic law that allows it.

Our task today is to agree on refocussing and redoubling our current efforts to protect and support women and girls who are affected by FGM, and to prevent this practice from occurring to a new generation.

This is a difficult and confronting topic.

It is distressing for many and touches on closely held cultural traditions for others.

We are not here today to lay blame or make accusations.

Far from it. We are here to promote healing and protection for girls and women now and in the future.

Last year the Prime Minister asked me to coordinate the Australian Government’s efforts to end the practice of FGM, and to make sure we are doing all we can to support girls and women affected by FGM.

Since then, I have met with a wide range of people - health workers, clinicians, advocates, peer support workers, educators and researchers.

Today’s summit brings many of you together.

This is an impressive group of people - it has a powerful voice, it has reach into our communities, it has influence, expertise, drive and passion.

I want to acknowledge that most of the people here today have been working for many years to highlight the issues around FGM and advocate on behalf of girls and women affected by this practice.

You inspire us, and your leadership will continue to be immensely important.

All mothers - all parents - want the best for their children.

In some communities the practice of FGM on girls and women has become established and accepted, and passed on from one generation to another.

Even mothers and grandmothers have agreed or arranged FGM because they believed their daughters would not be marriageable without it.

Now is the time to end that cycle.

The truth is that Female Genital Mutilation has no benefits, only detriments.

It is an act of discrimination and physical abuse against girls and women, which cannot be condoned or ignored.

Globally, FGM is mostly carried out on young girls sometime between infancy and
age 15.

The World Health Organization defines FGM as "all procedures involving partial or total removal of the female external genitalia or other injury to the female genital organs whether for cultural or other non-therapeutic reasons".

WHO estimates 140 million women and girls are affected worldwide.

There are currently no reliable statistics on how many women and girls are affected in Australia.

However, anecdotal evidence suggests that the practice continues to occur in Australia.

The number of cases might be small, but not one single girl in Australia should ever experience FGM.

Not one.

The number of people migrating to Australia from countries which commonly practice FGM is increasing.

As the prevalence of FGM in some of these countries is over 85 per cent this means the number of women with FGM-related health needs, and girls potentially at risk of FGM here in Australia is also likely to rise.

We are not isolated from this issue, and cannot be complacent.

We are compelled as a nation to take action.

I want to talk briefly about one aspect of our efforts to end FGM, and that is our work on the legal framework for responding to FGM.

The Federal Attorney General Mark Dreyfus has been working with his state and territory colleagues to complete a review Australia’s FGM laws.

The aim of the review was to ensure that Australia’s legal framework comprehensively criminalises FGM.

The review examined existing laws to identify areas for improvement and ensure individuals do not escape criminal liability. It also examined the practical operation of Australia’s laws to ensure that police and prosecutors are in the best possible position to detect, investigate and prosecute FGM whenever and wherever it occurs.

What the review found was that State and Territory laws are effective in criminalising FGM, but that there are opportunities to strengthen Australia’s legal framework.

In particular there is room to improve consistency of penalties - which range now from 7 years imprisonment up to 21 years imprisonment. The Australian Government’s model laws recommend a penalty of 15 years imprisonment for performing FGM; and 7 years imprisonment for removing, or making arrangements to remove a person from a jurisdiction for the purpose of having FGM performed.

Reforms are also recommended to extend current laws which protect girls under the age of 18 years, so that they apply to all girls and women, regardless of age.

The review also recommends reforms so that consistent legislation is adopted in all Australian jurisdictions – so that regardless of location, there can be no confusion that performing FGM or removing, or making arrangements to remove a person or the purpose of having FGM performed is a crime.

While our laws effectively criminalise FGM, questions remain around enforcement. Despite being extensively criminalised very few (if any) FGM offences have been successfully prosecuted in Australian courts and there are opportunities to better enforce existing laws.

This could include better cooperation between the health and legal systems.

The Australian Government will continue working with states and territories to push ahead with reforms that are necessary to prosecute and penalise criminal behaviour.

I will also be discussing with Health Ministers opportunities to improve the detection, investigation and prosecution of offences.

Australia is standing strong with the international community in efforts to end FGM overseas.

Last December, Australia co-sponsored an historic United Nations resolution on FGM, calling on all countries to act to eliminate the practice. UN Secretary Ban Ki Moon described the resolution as an important step towards a world free from violence against women.

At least 8000 communities in African nations which have previously practised FGM have listened to the voices of their women and girls and abandoned it.

Women, and men who once thought FGM was important for their girls, now see that it is not central to their beliefs or to their acceptance in the community.

Communities in which FGM is still practiced will become stronger and healthier without it.

The Australian Government’s position is that there is and can be no justification for FGM and it will not be tolerated under any circumstances.

There is no doubt that FGM is a preventable harm and a serious risk to their health.

It has no medical benefits, but has immediate and long term health consequences.

These can include obstetric, gynaecological and mental health problems.

At this Summit you will be reminded a little about the pain, suffering and trauma of some women.

This suffering is entirely avoidable.

Our responsibility is not only to ensure no girl in Australia suffers FGM but to provide support and care for women and girls who have experienced the procedure overseas.

The actions that are being proposed today will build on and coordinate existing efforts being made around the nation.

They will include awareness raising and education activities, prevention and law enforcement efforts, appropriate and culturally sensitive health services and developing the evidence base on FGM in Australia.

Each of you will be asked to support action in areas which you can best influence.

By working together, we can contribute to global efforts to end FGM and support those affected by the practice.

I hope that goal will be at the top of your minds today.

I am confident that we can take a united step forward today – a step that could make all the difference for young girls and women.

The Attorney-General’s Department’s final report recommended that there should be clarification of application of the FGM laws to female genital cosmetic procedures. This recommendation was confirmed by the Standing Council but there have been no further developments to date.

Genital cutting without consent ruled a grave offence

The New South Wales doctor who excised a woman’s genitalia “for her health” has had his gaol sentence increased by a further 18 months. In March 2011 former south coast gynecologist Graeme Reeves was convicted of inflicting grievous bodily harm on a patient, Carolyn DeWaegeneire, and sentenced to two and a half years gaol. Both he and the prosecution then appealed, Reeves because he claimed the jury had been wrongly directed, the prosecution because the sentence was “manifestly inadequate” to the gravity of the offence. On 21 February 2013 the Court of Criminal Appeal rejected Reeves’ appeal and increased his sentence by a further 18 months.

A LAWYER involved in an alleged female genital mutilation case will face court today charged with two counts of perverting the course of justice.

Detectives from the Sex Crimes Squad and attached to Strike Force Longfield arrested the solicitor at his office in Sydney's inner west.

The strike force was set up to investigation claims two young girls had the procedure, also known as female circumcision, performed on them when they were aged six and seven.

Eight people remain before the court after being arrested by detectives last year. Findings are yet to be handed down in those cases

The lawyer has been charged with two counts of do act with intent to pervert the course of justice. He was granted conditional bail and will appear at Parramatta Local Court next week.

Detective Superintendent John Kerlatec, commander of the Sex Crimes Squad, said it was safe to assume the most recent case wasn't an isolated one.
"The difficulty is that we've got to get to a criminal standard of proof,'' he told the Herald.
''That's more than just someone ringing up and saying, 'I think this is what's going on.'
''So, whilst we have [prosecuted people], we do accept that there's certainly other cases out there that can't be prosecuted."
Another police source close to the investigation said: ''It happens; it's well known in these communities. It's just a matter of [choosing] where - do you do it here or overseas?''
Superintendent Kerlatec said education was the key to stamping out the practice.
"We need to empower kids … I know it is difficult because they are very young, but if we can say to older siblings, 'look it's not right, we don't do that here'.''
"You might have an older sister who's had the procedure done. She's experienced it, she knows what it feels like, she knows how painful it is. Don't let it happen to your sister."
He said very few cases get reported to police
In NSW, the charge of female genital mutilation can be laid against anyone involved with arranging the operation, in the same vein as ''aiding and abetting'' - not just the person who carries out the procedure.
Ajay Rane, a professor of obstetrics and gynaecology and vice president eect of the Royal Australian and New Zealand College of Obstetricians and Gynaecologists, said there was ''an immense cultural pressure to make young ladies culturally acceptable''.
Professor Rane said it was possible that one of the reasons reports of FGM were rare in Australia was that the operations here were stage one or two. This meant the procedures did not involve the removal of the entire clitoris and resulted in fewer medical complications.

A SYDNEY solicitor has become the ninth person charged over the alleged genital mutilation of two young sisters.
The 46-year-old man was arrested at an office in Strathfield on Wednesday and charged with two counts of perverting the course of justice.

It follows an investigation by the Sex Crimes Squad into the circumcisions, which allegedly took place when the girls were aged six and seven.

Eight other people - including the parents of the girls, an Islamic sheik and a retired nurse - were charged last year with being present during the procedures and other offences.

The victims' father, who is a Sydney doctor, and his wife have been charged with two counts of mutilation.

A local sheik was charged with being an accessory after the fact to female genital mutilation and with hindering the police investigation.

He is accused of telling locals to lie to police about the prevalence of female genital mutilation in their community, court documents say.

The solicitor was granted conditional bail on Wednesday and will face Parramatta Local Court on August 8, when the other eight co-accused are also expected to appear.

Ozzy do the accused have names ? Why are you not giving names how do we know they are abdes ?
Perverting the course of justice can be any of three acts:
Fabricating or disposing of evidence
Intimidating or threatening a witness or juror
Intimidating or threatening a judge
Also criminal are:
conspiring with another to pervert the course of justice, and
intending to pervert the course of justice.
Statutory versions of the offence exist in Australia, Canada, and New Zealand. See, for example, Section 319 of the Crimes Act 1900 (NSW),[1] where the maximum penalty is 14 years' imprisonment.

BS yes they have names and are die hard abdes...for now that is all I can publish. If the media publishes their names I will do so.

All I can say for now that they are not haltu faltu chaprasi...the abdes are very devout young educated doctor, degree pharmacist, older qualified nurse, religious scholar Amil, and now practising lawyer. This is front row crowd who don't wait to be asked to jump..they will jump without being asked just if zada imagined that they should ask someone to jump :roll:

Its sad to see that a search of the news report you have posted above only brings in several repost links to Christian/liberterian blogs which now serve to highlight how Bohras are just as much part of the "Muslim problem" those countries allegedly have.

I coincidently read this and felt obliged to reply.. I am now based elsewhere for a long time and cannot keep up. I have done my part , now it is for others to take it forward and make the future better.

Case continues ...half the accused are still under bail conditions, Amil cannot travel outside Sydney. Media is under direction to not publish proceedings until case reaches trial. I am informed by my insiders from Sydney jamaat, The accused are not associating in public and trying to deceive the authorities as if they don't know, hear or see, really they are playing games with the wrong machinery . The ayan lawyer has left the jamaat committee and keeping a low profile so that they can claim innocence . By now let us hope this is enough of a lesson for the involved to stay within local laws 100% of the time. There is a list of minor irregularities in Melbourne and Sydney that are being monitored and will be pounced on when the time is right.

We cannot say if FGM has gone underground and whether Pakistani or Indian migrants are or not travelling to their home countries to perform the criminal acts. However if they are doing so they will ultimately be found out, it is matter of time. One of the children hopefully will grow up and report the abuse and the parents will be deep trouble . So any parent thinking for the khushi of their faulty belief and Maula is continuing , the time bomb is ticking.

Are we not baffled by silence of the intellectuals in our community both locally and globally to distance themselves from this practise. This sends a message to people in corridors of powers that the Bohra Community whether be orthodox or progressives to stubbornly and arrogantly demonstrate reluctance to proactively eradicate this abhorrent practise. The government could not seat back and watch and has stepped in to govern the situation.

It is noted that 3 people of prominence took a stand and this was also a personal one rather than official position ie Ali Asgar Engineer, and the 2 eminent scholars. The ramifications of this broader neglect is going to affect the long term standing of the community in society for years.
Female genital mutilation: penalties tripled in NSW

Penalties for performing female genital mutilation will increase from seven to 21 years' jail and it will become a crime to have the procedure done overseas.

A new offence of removing a person from NSW with the intention of having the procedure performed will also attract a maximum sentence of 21 years in prison.

Minister for Family and Community Services Pru Goward said female genital mutilation was an abhorrent offence.

“These changes send the message loud and clear that no matter whether you are the doctor holding the scalpel, or the parent buying the plane ticket, the penalty will be the same,” Ms Goward said.

“This crime has profound effects on women's health such as infertility, childbirth complications, and infant and maternal mortality during and shortly after childbirth. The NSW government is making it very clear the practice is simply not acceptable.”

The Attorney-General, Greg Smith, said existing penalties for the crime were inadequate. The new penalties would be the toughest in Australia, equal with Tasmania, he said.

The Minister for Citizenship and Communities, Victor Dominello, said the government would also launch a public awareness campaign to try to break the silence surrounding the procedure in migrant communities.

“We want everyone in NSW to understand – regardless of cultural background or language – FGM is a serious crime in our state and there will be no excuses for anyone who performs or facilitates the procedure,” Mr Dominello said.

I think the government should get hold of Kothar and Company and penalize them. They are responsible for this crime.

Can someone in Australia advise as to the outcome go FGM case. We heard the case had a hearing on 5-6 Feb 2014 and a lot of Australian mominin want to know the outcome. Is the bhaisaheb Shabbirbhiasaheb in prison or the case has been dismissed due to lack of interest?

Just heard from reliable source that the case in Australia was dismissed and Janab Amilsaheb Sabbirbhai Vaziri is back in Mumbai but for how long it is not known. Many from Sydney and else ware have left for Mumbai. I am told Sydney is deserted as the Aamil has left his followers and run

The pre-trial is not complete, the media would have jumped onto it, and the Amil could have taken leave to attend Mumbai events....he is supposed to return if he is on leave from court.

Australians need to take heart that the system of justice as recently as yesterday convicted a Member of Parliament for fraud . So no one is above the law. Read between the lines that the government has invested so much time and resources to abolish this practise so suddenly things will not go quiet. There will be mis-information in the grapevine and rumour mill will be in full speed, but be cautious.

Are abdes taking this lightly...I hope kids are safe ...no underground khatna is going on. If they are they are asking for trouble again.

My contact in Sydney Jamaat was a bit sloppy...I need to slap him awake.. that's why it took a few days to get back.

Sydney Amil is back. He was granted leave to attend Mumbai tazIyat ..I don't know the specifics whether he gave sureties that he will return. On his return he solemnised the misaq ceremony .

The pretrial hearing continues in March . The accused parents and the nurse did not trave.

The defence lawyers must be creaming fees for such a lengthy trial. Sydneysiders must be paying it some how.

Thanks Oz bhai. Can you please write to proper authorities, in NY, Houston, LA, Chicago, Toronto.
We can ask hear who the authority may be? Since we do not have proof, we could, just say that this Muslim sect, practices FGM and put all the Amils on notice.

I live in the US and would like to be anonymous. We can request some one to come out of the closet for this.

Just set the context, the police stumbled or found the abuses on their own, how and when is not public.

It could have been anyone who may have interacted with the victims . School, friends, medical , etc

Since the authorities are on it it is important we support or lead , if we are serious and sincere reformists , from internal position the need to abolish this practise so no more victims fall for this abuse. I hope not in Australia after all this but can everyone say right now today or tomorrow or just yesterday a poor Bohra female child did not fall a victim of this institutionalised practise?

Why are more women not coming out in masses and public to say where they stand. I can understand the older women may be too attached to the practise but Where are the educated girls in the 18-25 year old bracket ? Why are they silent.
