Noted lawyer and activist Mukul Sinha passes away

Ahmedabad: Noted activist and human rights lawyer Mukul Sinha passed away here on Monday.

He was suffering from lung cancer. After his condition deteriorated suddenly on Sunday night, he was admitted to a private hospital in Ahmedabad and breathed his last this morning. He is survived by his wife and a son.

Sinha’s body will be donated to cancer hospital.

He had floated an NGO called the Jan Sangharsh Manch, which championed the cause of not only the riot victims, but also those sections of the society which he felt had been bypassed by the state government.

The scientist-turned-lawyer was consistently taking on the Gujarat government on the issue of Godhara and post Godhara riots and fake encounter cases.

An alumnus of IIT Kanpur, Sinha’s work in fake encounter cases of Ishrat Jahan, Tulsiram Prajapati, Sohrabuddin and Sadiq Jamal led to the CBI investigations.

His cross examinations of several important witnesses before the Nanavati Commission on the 2002 Godhara riots brought out the role of the state authorities.

His critics accused him of driving an agenda against Narendra Modi and Gujarat.
In 2007, he got involved in the Sohrabuddin fake encounter case in which several top policemen were arrested by Gujarat police and NK Amin and Dinesh MN had got bail within few days of their arrest.

In 2008, he took up Ishrat’s case and in 2009, he started representing Javed Sheikh's family.

Based on his petition, the Gujarat High Court formed a three-member SIT of Gujarat police to probe the case.

Dr.Mukul Sinha was a great lawyer in the struggle for justice in Gujarat. Muslims will ever remember the sterling role of Teesta Setalvad, Mukul Sinha, and the outstanding Gujarat Police officers Rahul Sharma, Kuldeep Sharma, Sanjeev Bhatt, Sreekumar and others who ruined their careers in helping the victims.

Without sounding casteist, all of these angels were upper caste, mostly Brahmins. Sadly those who really hurt us were mostly from the OBC, Dalit and tribal communities, such as Vanzara, Noel Parmar, Pandian and ofcourse Modi himself.

In Narendra Modi's India, a case of rule and divide

AHMEDABAD: Ali Husain is a prosperous young Muslim businessman. He recently bought a Mercedes and lives in a suburban-style gated community that itself sits inside a ghetto.

In Gujarat, it is so difficult for Muslims to buy property in areas dominated by Hindus that even the community's fast-growing urban middle class is confined to cramped and decrepit corners of cities.

Husain embodies the paradox of Gujarat: the state's pro-business leadership has created opportunities for entrepreneurs of all creeds; yet religious prejudice and segregation are deeply, and even legally, engrained.

If a Muslim enquires about a property in a new development, often the response is: "Why are you even asking?" said Husain, speaking at his home in the Muslim neighbourhood of Juhapura, where filthy slum streets rub against smart new apartment blocks and enclaves.

Separation of communities is common across India. Nowhere is it as systematized as it has become in Gujarat.

Modi's record in his home state is clouded by riots in 2002, when 1,000 people, mostly Muslims, died in a frenzy of mob violence. Modi still struggles to shake off the perception he did not do enough to stop the bloodshed, despite a Supreme Court investigation that found no case against him and his own insistence he did all he could to keep the peace.

Even some Hindus connect Modi to the riots. Pradeep Shukla, a prominent Hindu businessman and former member of the BJP in the Gujarati town of Bhavnagar said Hindus "believe that, somewhere, indirectly, Modi had a hand in it because he supports Hindus. This is why they vote for him".

On the campaign trail, Modi has tried to project a moderate image with a platform that downplays hot-button Hindu issues and emphasizes growth and "development for all".

But in Gujarat's neighbourhoods and cities, people tell a different story.

Husain is one of roughly 400,000 people living in Juhapura, a teeming Muslim township within Ahmedabad. Many of them moved there after the 2002 riots. Local Hindus jokingly refer to it as "Little Pakistan".

India's history is scarred by episodes of horrific Hindu-Muslim violence. At least 200,000 people were killed in the months after the country was divided into India and Pakistan at independence from Britain in 1947. The destruction of an ancient mosque in 1992 in Ayodhya triggered religious rioting across India. Modi visited the northern town on May 5, repeatedly invoking the name of Ram.

Memories of the 2002 rioting have not faded for the many residents of Juhapura who lost relatives, homes and businesses. And its legacy has been increasing segregation.

In particular, a property law unique to Gujarat has perpetuated segregation, creating ghettos such as Juhapura and a sense of apartheid in some urban areas.

The "Disturbed Areas Act", a law that restricts Muslims and Hindus from selling property to each other in "sensitive" areas, was introduced in 1991 to avert an exodus or distress sales in neighbourhoods hit by inter-religious unrest.

Modi's government amended the law in 2009 to give local officials greater power to decide on property sales. It also extended the reach of the law, most recently in 2013 — 11 years after the last major religious riots.

Critics say the act's continued enforcement and the addition of new districts covered by it — about 40 per cent of Ahmedabad is now governed by the law — means it is effectively being applied as a tool of social engineering.

The Gujarat high court in a 2012 case questioned the state government's use of the act to block the sale of properties by Hindus to Muslims.

Bhavnagar is not covered by the Disturbed Areas Act. But in one district of the town, Hindus have effectively imposed it, raising a banner at the entry to a narrow lane that reads: "In this area, locality or by-lane no property or building can be sold or rented to people who are not of this religion."

Reuters interviewed two local VHP leaders who said they have made repeated requests since 2004 for Bhavnagar to be put under the Disturbed Areas Act.

One consequence of the segregation: land and home prices in Juhapura and other Muslim areas have escalated more than in Hindu areas as the community finds its ability to expand and build more properties limited.

"Prices have increased so much because the expansion of Juhapura has been contained, not only by walls but also by the building of Hindu colonies ...at the periphery of the locality," Christophe Jaffrelot, a scholar with the Carnegie Endowment for International Peace, wrote in a recent column in the Indian Express.

Communal tension in Sahranpur after wine bottles thrown into Darul Uloom mosque

Saharanpur: After Meerut, anti-social elements tried to vitiate communal atmosphere in Deoband of Saharanpur district by throwing wine bottles into a mosque during fajar prayer time. It is said that two motorcycle- borne persons came on their bike and threw bottles in the mosque in which one person identified as Zameer Alam got injured in the attack.

In another incident, flesh of animal was found at an Eidgah in Khrrampur village of Behat town which was thrown in evening. Following both incidents, the authorities have issued high alert to police and intelligence agencies in the area.

And this will eventually hit the innocent community members, will dawat help families under life threatening situations to relocate to other countries or safe locations within India before they are tortured, maimed and burned to death? or this is none of their business, safe guarding bohra families doesn't come their jurisdiction.

16th May 2014 will go down in the history of Indian elections as the day when Propaganda won over good sense, 2014 Lok Sabha elections no doubt is India's first intensively televised election, which leaves many uneasy question's that needs to be answered by the media first and then the parties who have funded this entire grandiose exercise using questionable resources. All that one can expect now from the newly elected government is to see it exhibit right intentions and vigor in taking forward this nation of 1.25 billion into the future it has been promised.

Obviously Kothar backed the right horse and he won handsomely. On the flip side Congress had lived out its hereditary role and will ride into the sunset. Whether it is BJP or Congress or Aam Aadmi at the helm, for the millions of Indians life will go on just as it did before. Abject poverty, overpopulation, pollution, pathetic infrastructure and sanitation will never disappear. The immediate beneficiaries will be the industrialists and the entepreuners. Modi won on the coat-tails of the Mantra of GROWTH. Let us hope he will be able to deliver what he promised. As for the Muslims in Gujarart his victory is bitter sweet.

victory of NaMo was very definite.although NaMo had extended gesture of friendship by receiving donations cheques from moolahs he will show true color by kicking muffys a...ss out of gujarat soon. the nasty miyabhais and naughty bohris in gujarat were required to be taught good lesson in 2002 and thats what he did. bohris with junglee 10 inch dadhis are worst than terrorists..i remember when i was kid this miyabhais will fire crackers when pak won and will annoy loyal citizens..namo should put bomb behind there ass

there are 2 breeds which has surfaced..one is sophisticated bohris with junglee dadhis involved in multi crores scams in pwd, construction etc all having lineage to muffy gang their crook masters and second is miyabhai's who are not educated and do honour killings

In a first past the post election system, seats share can be misleading. Even in this 'wave', BJP's vote share is restricted to 33% and Cong. is still holding to 21%. That means while one out of three Indians has turned into full blown masculine Hindutva, one in five Indians still remains committed to good old Nehruvian consensus approach to running the country. If this was a proportionate electoral college like the U.S., in a house of 500, BJP would hold 165 seats, Congress 105, and the rest 230.

BJP has a Lok Sabha majority but not the country's majority will. That means while they have all the rights to run a government, it also means that they have to take along with them 2 out of 3 Indians who did not vote for them.

History will judge the just-concluded elections as republican India’s first intensively televised elections. Never have close to four hundred news networks (they equal the number of entertainment networks, such is the saleability of “news” in our culture) in a bewildering variety of languages and dialects communicated political messages from an equally bewildering array of politicians and political actors across the country. But, equally, never have so many news networks dished out the same fare: Narendra Modi. How Amit Shah and the RSS managed the BJP’s Varanasi campaign

Ask any Rashtriya Swayamsevak Sangh official about the organisation’s interest in politics and you will usually receive some version of a stock reply: the RSS is an apolitical, socio-cultural organisation involved in social (and cultural) work. In reality, of course, the Sangh exerts a profound influence on the Bharatiya Janata Party on many fronts, from policy framing to selection of leaders.

The organisation has remained largely away from the political spotlight during this election. But at least in Varanasi, centrestage in this year’s electoral war, a closer look reveals that it is not the BJP, but the Sangh that has been the engine powering the campaign.

A nagar karyavaha—a mid-level RSS worker—whom I met in the city used an unusual, if telling, metaphor to describe the RSS’s role in the campaign. “You see this hand?” he said, holding up his palm. “You can only see the palm lines and it is clean. The millions of microorganisms will only be visible under a microscope. Similarly, the Sangh workers are invisible, but always at work.”

The karyavaha explained that the RSS workers had been instructed that this was a “karo ya maro” (do or die) election for them. At the same time, they were never to “cross the line,” and were to avoid being seen actively campaigning. “The instructions given are: never go to the BJP office, don’t hold the BJP flag, don’t be seen on the BJP stage, don’t use Modi’s name in pamphlets, et cetera,” he said.

. “The RSS aim is to reach every house in the constituency,” he said. “So they have divided the responsibility.” A “booth prabhari,” or booth in-charge, oversees a certain number of booths in the constituency. Under the booth prabhari is the panna prabhari, or page in-charge. “A panna prabhari is given the responsibility to reach out to 60 voters listed on two sides of a page of the voter list,”

To get a sense of the penetration of the RSS campaign, consider that the number of voters in the Varanasi constituency has been reported at around 17.6 lakh, spread across 1562 booths. Thus the average number of voters per booth is roughly around 1130—at 60 voters per panna prabhari, that makes around 19 panna prabharis per booth.

“Every person of 18 years should be registered as a voter, so we are going from house to house,” he said. “We are working for 80 percent voting in Varanasi this time.” (Varanasi registered only 42.6 percent voting in the 2009 Lok Sabha elections.)

The RSS is distributing pamphlets under the banner of the Jagruk Matdaata Manch (Voters Awareness Association). The pamphlets urged voters to think about issues such as national security under the threat of terrorism and Maoism; shrinking borders and an incompetent government; the threat to national integration from votebank appeasement, communal thinking and other factors. “We tell them that we are choosing a PM not MP, so the national issues matter more than the local issues,”

“It is like Modi’s wedding, for which 40 organisations of the RSS are working,” he recounted telling the workers. “The BJP is like the son’s friends, who dance and create a lot of noise. They take photos and get all the publicity. But the Sangh is like the groom’s father. We have to put up with them because they are important for the son. If Modi wins, the BJP cadre will take the credit; if he loses we will take all the blame.”

WASHINGTON: President Obama on Friday telephoned Prime Minister-designate Narendra Modi and invited him to visit Washington at a mutually agreeable time to further strengthen bilateral ties between the two countries.

The White House said the President called Modi to congratulate him on the Bharatiya Janata Party's success in India's historic election. The President noted he looks forward to working closely with Mr Modi to fulfill the extraordinary promise of the US-India strategic partnership, and they agreed to continue expanding and deepening the wide-ranging cooperation between our two democracies, a White House statement said.

Hours before the call, Washington made it clear that Prime Minister Narendra Modi is welcome in the United States. Even before the President's phone call, the Obama administration extended the most explicit invitation to India's prime minister-to-be on Friday, indicating that the visa flap that had dogged ties with him is a thing of the past.

Separately, senior State Department officials said the visa thing is now a non-issue, overruling overzealous spokespersons who doggedly stuck to the bureaucratic script in repeating ad nauseum that his visa will be considered on merit etc. Officials explained that as a head of government, Modi will merit a different treatment altogether.

"Everything will be alright," a senior official said on the sideline of a reception the Indian ambassador to Washington S.Jaishankar hosted at the conclusion of the elections and the announcement of the results.

Droves of India experts and administration officials dropped by at the luncheon where everyone, without exception, expressed astonishment at the staggering size and scope of the BJP victory. Representatives of U.S trade and industry, business and commerce were clearly beside themselves with delight at the clear mandate the Indian electorate had given to the BJP, saying it paved way for the incoming government to take swift decisions without being weighed down by coalition politics.

A representative of the Ford Motor Company, whose CEO will be in India early next month expressed admiration for the electorate saying the outcome was one that would be good for India and for foreign investment.

The White House spokesman Jay Carney also praised the outgoing prime minister Manmohan Singh for his contribution to India-U.S relations and said ties would continue to remain bright going forward.

Earlier, US Secretary of State John Kerry tweeted his congratulations to prime minister-designate Narendra Modi on his historic victory in the general elections.

"Congrats to @narendramodi and BJP. Look forward to working w/you/growing shared prosperity/security w/world's largest democracy," Kerry, who is travelling to London, said on the micro blogging site.

Kerry's remarks came after the White House National Security Council also took to Twitter to convey its greeting.

"US congratulates BJP on its victory in India's historic election; we look forward to working w/govt once formed to advance our partnership," the National Security (NSC) of the White House said in its tweet.

"After the largest democratic election in history, US congratulates the BJP for its victory and looks forward to working closely with new government," tweeted Ben Rhodes, the Deputy National Security Advisor and a close aide of President Barack Obama.

India is a corrupt nation. India's richest man cannot be any different. That's our reality. The masses have spoken and the masses in India are not literate. That's our reality. Congress' silence during the scam expose's have caught up with them. Add to that the terrible oratory skills they bred thru the years has got them where they are. In the light of the ANTI CONGRESS WAVE, BJP had to win. However, with Modi as PM, India has lost its sense of moral consciousness and it does not matter anymore. Justice is flawed clearly. The reality is they ran the progrom. Now he wants to look back at it and close that chapter. But his boss - THE RSS wanted him here to run their Hindutva Campaign. As more and more illiterate educated ( another reality of our country) get carried away by rhetoric and praise our new PM, nothing must let you bury the murders and atrocities committed on mankind. PREPARE FOR THE GLOBAL SHAMING OF OUR NATION AS THE WORLD LAUGHS AT US AND MAKES MOCKERY OF OUR DEMOCRACY , OUR HUMAN RIGHTS AND MORE TO FOLLOW....

We had done what can b done by us but now that modi had won what i can only wish is that he prove all of us wrong and concentrate only on building nation. I am just trying to be optimistic.

Even yazeed won the battle of Karbala and was successful in martyring Imam Hussain (AS) but what happened later on all of us remember the sacrifice of Imam Hussain (AS) not the oppression of Yazeed.
Modi is just a phase which will pass by and trust me he would not be remembered as other highly qualified leaders are.

Need a turnaround in economy,get manufacturing sector to rise,defence and foreign policy to project and protect Indian economy & interests.

The most disturbing aspect of this election and Modi's win is that there are NO Muslim MPs in BJP, even the loyalist Shahnawaz Hussain who was a minister in Vajpayee's cabinet surprisingly lost the election. This means that we wont have a SINGLE MUSLIM minister in the cabinet. This is part of a larger gameplan by the RSS pracharak to eliminate Muslim voices in the country forever. BJP which is extremely strong in Gujarat could have put a Muslim candidate in that state if at all it wished that Muslims should have some representation in the parliament but they didn't !! This clearly and explicitly displays their agenda which could prove very disastrous for Muslims of India in future.

To woo the Hindu voters, Modi visited Varanasi today and promised to undertake a massive programme to clean the Ganga river, there is a saying "Deepak tale andhera" because he is more concerned about cleaning the Ganga but prefers to keep the Juhapura area of Ahmedabad filthy............ Juhapura is one of the biggest ghettos of Muslims where more then 3 lakh Muslims live in most abysmal conditions, it is the BIGGEST garbage yard of Ahmedabad where all the garbage of the city including hospital filth is dumped, there are no proper roads, there is no proper public transport, there are hardly any banks and only a couple of police chowkies.

What more proof does one need to understand Modi's future plans !!

Supreme Court acquits all six persons in 2002 Akshardham temple terror attack case

In a major setback to the Gujarat government, the Supreme Court on Friday acquitted all six persons, including two on the death row, in the 2002 Akshardham temple terror attack case.

Allowing their appeals against the conviction and sentencing, a bench comprising Justices A K Patnaik and V Gopala Gowda held that the prosecution failed to establish their guilt beyond reasonable doubt and they deserved exoneration from all the charges.

The bench nixed their confessional statements being invalid in law and also said that the prosecution could not establish they participated in any conspiracy.

The petitioners had sought to draw parallels between investigations into the alleged fake encounter killing of Sohrabuddin and that of Akshardham terror attack in which both the fidayeen were killed by NSG commandos on September 25, 2002.

The appeal by the convicts said they were arrested following investigations conducted by then deputy superintendent of police D G Vanzara, who is facing trial for the fake encounter killing of Sohrabuddin. It alleged that Gujarat government was “notorious for conducting investigations in a totally partial and unjust manner which was evident from another case monitored by the apex court — Sohrabuddin encounter case”.

Muslims averse to BJP so you expect BJP to go run after some muslim politician and request or beg them to contest elections? Muslims have for clogged minds in india due to the idiotic "secular" parties and their votebank politics. That has now meant that Muslim vote has become irrelevant as Hindu votes have started to consolidate. So much for tactical voting by Muslims. BJP has won where the Muslim population is upto 30-40%.

Time for Muslims to realize they cannot have enmity with India's only national party right now. Cong won't recover any time soon. Their next best chance is 2024 and that if they dump Gandhis and come back with an array of you a leaders at both center and state. BJP is strong because they have good state leaders. Gandhis never liked strong state leaders as they felt threatened by them. Like YSR was in Andhra.

Anyways good wake up call for Muslims this elections. To get any relevance back in the political landscape, they have to clear their clogged minds
