Bail to Gujarat Riots accused, tough time for Teesta Setalvad: SC Bar Association president Dushyant Dave


NEW DELHI: Supreme Court Bar Association president Dushyant Dave on Wednesday questioned the top court's decision to grant bail to all accused in the Sohrabuddin fake encounter case, and also former Gujarat minister Maya Kodnani, who was convicted for the murder of 70 people during the 2002 Gujarat riots.

A bench comprising Justices JS Khehar, Jasti Chelameswar, Madan B Lokur, Kurian Joseph and Adarsh Kumar Goel is hearing petitions challenging the constitutional validity of the National Judicial Commission Act (NJAC), which they claim will erode judicial independence.

"The executive wants a weak, pliable judiciary. Lack of integrity suits the executive, which knows how to manipulate them," he said. Dave then turned to how the collegium had failed in choosing the best in "ethical behavior and personal conduct".

"Every accused in the Sohrabuddin case gets bail, but poor Teesta (activist Teesta Setalvad) has to run from pillar to post. In all the Gujarat riot cases, those accused of murder get acquitted. The state does not appeal. This court gave bail to Maya Kodnani who was convicted for the murder of 70 people."

Dave also accused the court of failing to come to the rescue of activists such as Setalvad and Prashant Bhushan. "Democracy needs such activists. The court needs to protect them." He credited Bhushan for drawing attention to the 2G and coal scams, which had garnered over Rs 2 lakh crore for the exchequer. Bhushan does not demand z-plus security or 68 security personnel like Baba Ramdev, he said.

All this would have to be kept in mind during selection of a judge, he said. "Once when a man gets power, will he be amenable to power or will he remember his oath?"

JI chief: $16mn bounty for Modi's arrest

Jamaat-i-Islami (JI) chief Senator Sirajul Haq on Monday announced Rs1 billion reward for anyone who arrests Indian Prime Minister Narendra Modi.

The JI chief in Azad Jammu and Kashmir, said that India has failed to arrest Hizbul Mujahideen chief Syed Salahuddin despite keeping a reward on his arrest.

“I want to say to Modi that you and your agents cannot arrest Salahuddin. And you say whoever will arrest Salahuddin, we will give him Rs 50 crore. I too say that whoever arrests Modi, we will give him Rs1 billion,” he added.

In an article in Dawn, Haq blamed Modi for killing hundreds of civilians in Jammu and Kashmir and Gujrat and slammed the government for not paying heed to Indian atrocities in Jammu and Kashmir.

“Our relations with India are conditional to Kashmir’s freedom,” he said

The diamond merchant who bought Modi's controversial monogrammed suit for `4.31 crore has now allegedly received a favour from the Surat municipal corporation.The local administrators of the diamond city are set to return 12,000 square metres of land worth about `54 crore to Laljibhai Tulsibhai Patel's Dharmanandan Sport Club. The municipal authorities have denied any special favour to Patel.

Rohini Salian said she wants the NIA to officially denotify her from the case to which she was appointed in 2008, 'so that I am free to take up other cases, against the NIA, if need be'.

Rohini Salian, Special Public Prosecutor in the case related to the Malegaon 2008 blasts in which four Muslims were killed during Ramzan and in which Hindu extremists are the accused, has said that over the past one year, since “the new government came to power,” she has been under pressure from the National Investigation Agency (NIA) to go “soft” in the case.

Soon after the NDA government came to power last year, she said, she got a call from one of the officers of the NIA — the agency investigating all the alleged Hindu extremist cases — asking to come over to speak with her. “He didn’t want to talk over the phone. He came and said to me that there is a message that I should go soft,” Salian told The Indian Express

Matters came to a head this month, on June 12, she said, when just before one of the regular hearings in the case in the Sessions Court, she was told by the same NIA officer that “higher-ups” did not want her to appear in the court for the State of Maharashtra and that another advocate would attend the proceedings.

Salian, 68, a leading prosecutor who has handled important cases like the J J shootout, Borivili double murder, the Bharat Shah case and the Mulund blasts amongst others, said: “The meaning (of that message from the officer) is very clear — don’t get us favourable orders.”

She said she wants the NIA to officially denotify her from the case to which she was appointed in 2008, “so that I am free to take up other cases, against the NIA, if need be”.

The Malegaon blast, on September 29, 2008, claimed four lives and injured 79 while another blast at the same time in Modasa in Gujarat killed one. Initially, Muslims were seen as suspects in the case but it was under Hemant Karkare of the Maharashtra Anti-Terrorism Squad (ATS) that investigations led to alleged Hindu extremists based in Indore, as first reported by The Indian Express on October 23, 2010.

Investigations revealed the blasts were allegedly the handiwork of extremist Hindu organisations. Twelve people were arrested in the case, including Sadhvi Pragya Singh Thakur and Colonel Prasad Shrikant Purohit. Of the 12, four are on bail.

That probe — later given over to the NIA that was constituted after the 26/11 terror attack in which Karkare was killed — led to a relook at other cases: Malegaon blasts of 2006 (31 killed, 312 injured); 2007 Ajmer blast (3 killed, 15 injured); 2007 Mecca Masjid blast in Hyderabad (9 killed, 58 injured); and 2007 Samjhauta Express attack (68 killed, 13 injured). The probe found many common accused in these cases.

Salian said that the Supreme Court has now decreed that the case should be tried in a special court with a specially appointed judge to see to the matter. “So in a way it’s all back to square one,” said Salian.

On April 15, the Supreme Court held that the Malegaon accused cannot be charged under MCOCA since there was no evidence as on date. Opening the doors for their release on bail, it further said that the trial court should decide their bail plea on merit and without applicability of MCOCA, preferably within one month.

This, Salian said, now leaves it open for the accused to once again appeal for bail in the court under changed circumstances.


“A day before June 12, when the case came up again for regular hearing (in the trial court), the same officer who had come to my office came up to me and said there are instructions from higher-ups, someone else will appear instead of you. I said I was expecting this and, good, you have told me this, so please settle my bills…I also said that now they should now denotify me so that I can appear against the NIA in other matters — not this one — in the future. He must have conveyed it to the higher-ups and I am waiting for their action. I have not heard from anyone since then,” said Salian.

“The meaning (of the message from the government) is very clear — don’t get us favourable orders. Unfavourable orders are invited — that goes against the society,” said a perturbed Salian.

When asked how she saw the case proceeding further, Salian said, “For a layman or a fresh prosecutor it’s very difficult — one cannot do anything. Maybe they want to loosen it and ultimately lose the case because they can’t withdraw it.”

Caution and Narendra Modi

The U.S. should be cautious regarding these overtures, as the BJP is not in sync with Western liberal ideals.

The BJP is jingoistic. It espouses an extreme form of Indian nationalism. It calls for the destruction of Pakistan and Bangladesh and their absorption into greater India. The BJP wants India to forcefully take all of Kashmir and abnegate all agreements providing special status to Kashmir as a Muslim majority state.

The BJP is anti science. It wants to introduce new Indian school textbooks that describe India is a Hindu state that experienced a golden age under Hindu rule. Prominent BJP leaders claim that Hindus invented nuclear weapons, plastic surgery, air travel and many other wonders during their ancient past. They present this as evidence of the inherent superiority of Hindu civilization. BJP leaders want to make the study of Sanskrit compulsory for all Indian.

The BJP is anti-environment. The BJP will not join worldwide efforts to combat climate change by reducing carbon emissions. It has rejected calls for India to join the USA/China Agreement on climate change signed by both countries on November 12. Instead, the BJP intends to continue its economic development program regardless of the consequences to the world environment. The BJP has little interest in environmental initiatives and does not pursue energy conservation or encourage renewable energy.

The BJP government of Narendra Modi is trying to manipulate the United States for its own ends and has launched a charm offensive to woo American elites. An accomplished politician and a master manipulator, Modi is currently demonstrating his skills on the Indian public. So far, it is working. Many Indians are entranced and enthusiastically go to the polls to vote for the BJP. He is trying these same skills on the American leadership.

However, this overlap in values should not be over-emphasized. American and Indian elites share a similar economic agenda and the BJP and the Republican Party share a similar political agenda, but the overlap between these groups is limited. The value system underlying BJP/RSS ideology is inherently at odds with the liberal value system of the West. To retain its identity as a secular democracy fully committed to human rights, the U.S. must not become too close to India's BJP government. Economic interests alone should not determine our alliances.

The Modi Government’s Cynical Approach to Justice

The Special Public Prosecutor in the 2008 Malegaon blast case, for which Hindu extremists are undergoing trial, has disclosed to the Indian Express newspaper that the Centre wants her to “go soft” in the trial court. The prosecutor, Rohini Salian has clearly stated that over the past one year, since the new government has come to power, she has been under pressure from the National Investigation Agency (NIA) “to go soft” in the Malegaon matter. She has given some details as to how senior NIA officials want her to be replaced by another advocate. “May be they want to loosen it and ultimately lose the case.”

This is a shocking revelation which makes a mockery of the Modi-led government’s claim of ushering in a new era of governance. The Special Public Prosecutor’s interview to the newspaper comes on a day when PM Modi has talked about his government’s commitment to the ideals and ethos of democracy to mark the 40th anniversary of the Emergency. The larger question to ask is whether the NDA, with its 282-seat majority in the Lok Sabha, thinks it is entitled to extra-constitutional discretion which it can use to selectively dilute or not pursue cases of national importance.

Rohini Salian’s interview to The Indian Express has fascinating parallels with the manner in which a Special CBI court had dealt with the fake encounter killing of Sohrabuddin, his wife Kausar Bi and Tulsiram Prajapaty, an associate of Sohrabuddin. The CBI chargesheet had named Amit Shah as a lynchpin of a larger extortion racket run by Sohrabuddin, a petty criminal, with the help of senior police officials of Gujarat.

But over the past year under the NDA, the same CBI appears to have shown little enthusiasm in pursuing the case, even before all the evidence against him were scrutinised in a proper trial. Note that during this period the CBI Special Prosecutor and the judge of the Court got replaced quickly. Amit Shah’s lawyer argued for his discharge for several days and the new CBI prosecutor took barely an hour to put forth the CBI case. After Shah’s discharge most police officials, who have been in jail for some years in connection with the case, also got released on bail. The CBI has yet to appeal in the case.

So is anyone really surprised that the Special Prosecutor Rohini Salian feels the NIA wants to replace her with a new advocate in the Melegaon blast trial so that the case is ultimately lost? Clearly, the NIA cannot withdraw the matter as it is already in the court.

The modus operandi is a tried and tested one. If you can’t withdraw a case, just ensure it dies a natural death. Rohini’s statement is a damning indictment of the cynical ways of the Modi government which doesn’t have a place to hide now. The government is going about offering its own premature judgment on cases which are either being investigated or are committed to trial. In cases which are still being investigated — like the one against Vasundhara Raje’s son — the government is already giving clean chits.

Most likely this will be the fate of the investigation by the ED and CBI in the money laundering cases relating to Lalit Modi, the Adani Group as well as the still not-so-transparently launched criminal cases against income tax violators and alleged money launderers in the notorious HSBC Swiss branch list. In all these matters, a strong element of discretionary treatment seems to be at work. A news report suggested that the SC appointed special investigation team dealing with black money may be requested by the government to allow compounding of some income tax violation cases on the HSBC list.

Brazening it out

The Modi government has clearly tied itself up in knots. The PM’s deafening silence is the biggest evidence of this. The sole message coming out of the highest echelons of the NDA government is, “We will brazen it out, come what may”.

The NDA must remember one thing. Rohini Salian’s revelation is not a simple matter relating to a financial crime. This cuts at the very root of our constitution’s commitment to fostering a secular-democratic polity. Political brazenness will meet with its democratic/ judicial limit. Eventually, of course, the people will decide the fate of those who systematically dilute democratic institutions.

Is Modi’s India Safe for Muslims?

Hindu nationalism is on the rise in the country with the world’s second-largest Muslim population.

This past March, a group of community activists in Aurangabad, an industrial city in central India, convened a morcha — a demonstration — to protest a series of blatantly anti-Muslim measures taken by the state government in Mumbai, which is controlled by Prime Minister Narendra Modi’s Hindu nationalist Bharatiya Janata Party (BJP). The morcha operated according to a well-worn protocol: A colorful tent was erected in a vacant lot across the street from the office of the district commissioner, and 250 or so Muslim men sat in the shade while a succession of speakers — a very long succession of speakers — denounced the state government and called for civil disobedience, in the spirit of Gandhi’s famed Salt March against the British, should their demands not be met.

The leaders of the demonstration then walked up a long driveway to formally present their demands to the district commissioner, who promised to relay them to the Maharashtra state authorities. The humble folk stayed back in the tent so as not to block traffic. Quite a few of them were qureish — cattle butchers — who had lost their jobs when the government had banned the consumption of beef the week before. They were trying to figure out how they were going to feed their families or send their kids to school. And they were wondering who, if anyone, would protect their interests amid India’s new politics of Hindu chauvinism.

Over the last year, since Modi became prime minister, the news out of India has focused almost entirely on his struggle to open up India’s economy and attract foreign investment. That has been reassuring both for many Indians and for economic partners abroad. But Modi is himself a product of the militant, trident-shaking wing of the BJP known as the Rashtriya Swayamsevak Sangh (RSS). He was chief minister of Gujarat state in 2002 when Hindu mobs killed more than 1,000 Muslims, and he was blamed for failing to stem the violence. The RSS chauvinists, who dream of a Hindu-dominant India, adore him as their champion. That is precisely what India’s Muslims fear.

India’s Muslims have noted every apparent straw in the wind. And there have been many of late. In March alone: Subramanian Swamy, a senior BJP leader from the southern state of Tamil Nadu, declared in a speech that mosques, unlike temples, are not holy places and thus can be demolished. Two days later, the BJP chief minister of the northern state of Haryana announced that the teaching of the Bhagavad Gita, the Hindu holy text, would become mandatory throughout the state. A number of churches were vandalized. A 71-year-old nun in the eastern state of West Bengal was gang-raped. And the beef-ban movement was spreading to new states.

India, of course, contains multitudes, and these incidents could be dismissed as the usual turbulence. Modi has conducted himself with remarkable circumspection, reassuring Muslims and other minorities about their place in Indian society, avoiding loaded or ambivalent language, and building bridges with Pakistan. He has not, however, tried to stop BJP state governments from pursuing a more nationalist agenda or has done much to curb inflammatory rhetoric. India has survived, and thrived, as a multiconfessional, multicultural nation because of a shared faith in secular principles enshrined in the country’s constitution. But India’s Muslims, who have worn that secular identity as a suit of armor in Hindu India, now feel more vulnerable than they have in many years.

I suggest all Muslims from India should move to Arabised Muslim countries where, some believe, they belong. What are Muslims doing in Hindu countries which are shirk infested.

I will even go further. All Muslims also move from West, because the West also is Kafir. Let's all move to pure Arabised Muslim countries where they respect our hijabs and treat our women with lots of respect.

When you find such a place, please let me know because I would like to move there because I am tired of living in a country where I was born and raised, and where Al-Qaeda, ISIS, Taliban (pure Muslims) are condemned.

Religious violence still a concern: report

U.S. report refers police and security force abuses, including extrajudicial killings.

Religion-based violence in Indian society “continued to be a concern,” during the first year of Narendra Modi’s rule as Prime Minister, according to a report on worldwide human rights abuses released by the U.S. State Department

In its annual Country Reports on Human Rights Practices unveiled on Thursday the Department said that the most significant human rights problems were police and security force abuses, including extrajudicial killings, torture, and rape; widespread corruption that contributed to ineffective responses to crime, including those against women and members of scheduled castes or tribes; and societal violence based on gender, religious affiliation, and caste or tribe.

The report alluded to “several instances” during the 2014 general elections, in which individuals faced arrest for allegedly posting political comments on Facebook.

It cited in particular the case of Goa-based Devu Chodankar who was the subject of a complaint filed on May 23, 2014, allegedly for urging community members on Facebook not to vote for Mr. Modi.

Following this “police detained and interrogated Chodankar for allegedly accusing Modi of planning a holocaust against Muslims and Christians… [and] confiscated Chodankar’s computer and other related items,” the report noted.

While the report referenced some states’ laws restricting religious conversion, the Department also appeared to have closely tracked a report submitted to the Indian government by three senior police officials from Maharashtra, Uttar Pradesh, Tamil Nadu, and one Intelligence Bureau representative entitled ‘Strategy for Making Police Forces More Sensitive Towards Minority Sections,’ which the report said “acknowledged bias within the police force against Muslims and reported the Muslim perception of police as communal, biased, and insensitive.”

Last summer in some areas such as Bastar district of Chhattisgarh numerous village councils passed resolutions banning non-Hindu religious “propaganda,” prayers, and speeches in their villages, the Department said.

Additionally the report highlighted communal violence in Pune in late May, wherein social media posts triggered multiple arson attacks on Muslim-owned shops and mosques and an assault against a Muslim cleric.

It underscored the June 2 incident in which a group beat Mohsin Shaikh, who was returning from prayers in Pune, to death, allegedly targeting him for his “Muslim appearance.” In that case police arrested members of the Hindu Rashtra Samiti and pressed murder charges against its chief, Dhananjay Desai, the Department added.

Similar to previous reports on religious freedoms issued by the U.S. government, this week’s report also drew attention to concern expressed by civil society activists “about the Gujarat government’s failure to hold accountable those responsible for the 2002 communal violence in Gujarat.”

More broadly, other human rights problems of India that found mention in the report include disappearances, hazardous prison conditions, arbitrary arrest and detention, and lengthy pre-trial detention, all exacerbated by a judiciary that “remained backlogged, leading to lengthy delays and the denial of due process.”

365 days of demonisation of minorities under Modi regime : A report

Those of us who have been tracking the growth of Hindutva in India had already said that this government would unleash their hidden agenda once it comes to power through ‘media’ management to grab headlines as Sangh ideologue Arun Shourie said in an interview adding that the minorities are living in a fear and when a person like Juleo Ribero can feel unsafe and unwanted in India then it need to be seriously looked into.

The fact is that this government has wonderfully developed the cocktail of Corporate and Hindutva to strengthen its agenda. With huge flow of funds, corporate are enjoying the hospitality of the government. Some of these industrialists are part of Prime Minister’s business trip abroad, which actually never happened in the past in such an unashamed way. If the current government’s favoritism remains unstopped, one may see Adani Group becoming the biggest ‘corporate’ house of the country leaving behind another friend Mukesh Ambani.

There is no growth factor in India. Reports of farmers’ suicide are already there and the government has not shown any inclination to address the issue.

#SelfieWithDaughter: Ehsan Jafri's daughter shares "haunting" picture

After PM Modi asked Twitterati to share selfies with their daughters to bolster the campaign against female infanticide, many on social media reacted enthusiastically. The hashtag was not only the top trend in India but also featured on the global trends. There were also some dissenting voices like those of actress Shruti Seth and activist Kavita Krishnan.

However, Ehsan Jafri's daughter gave a very poignant twist to the entire campaign. Nishrin Jafri Hussain shared a picture with her late father, along with a caption that was short, but hard hitting. It read: "SelfieWithDaughter: This one will haunt him for ever." Judging by the context, it's not very difficult to understand who the 'him' referred to by Nishrin is.

Ehsan Jafri was a former MP of the Congress party, who was brutally killed in the infamous Gulbarg society massacre in 2002 where 69 Muslims were killed by a riotous Hindu mob. This and other sporadic communal riots were in the aftermath of the Godhra train burning incident. Ehsan Jafri's widow Zakia Jafri said that the Gujarat police and the then CM Narendra Modi were complicit in the action by turning a blind eye to the riotous mob, which finally led to the death of the ex-MP. Later, the SIT probing the case gave a clean chit to Narendra Modi and the state government.

However, Nishrin Jafri Hussain's picture has certainly put a cold water to the entire #SelfieWithDaughter campaign. A chilling reminder of the past, it amply shows that Gujarat always remembers.

Will India's banks collapse under the burden of bad loans of rich people?

Despite the reality that 73 % of outstanding loans to the Public Sector Banks are owed by major Corporate houses and entities , there is a serious proposal to privatize Public Sector Banks by covertly reducing Government shareholdings to a minority and establishing an advisory board to administer these privatized banks with representatives of the Private
Corporate Sector and Banks on this board to oversee these Banks , steps that will lead to the collapse of the Indian economy on the lines of the United States and other European Countries .

Cong. demands apology from PM for Gujarat riots

The Congress on Friday raked up the post-Godhra riots issue against Prime Minister Narendra Modi, latching onto the claims by former RAW chief A.S. Dulat to demand that Mr. Modi apologise for the communal violence in 2002 when he was the Chief Minister of Gujarat.

The party also questioned BJP’s commitment to fighting terrorism and alleged it was wearing a “mask of nationalism”.

Citing certain claims by Mr. Dulat including on the “goof up” in the IC-814 hijack in 1999, he accused the ruling party of always compromising with terrorists and terrorism.

Party spokesman Ajoy Kumar launched a scathing attack on Mr. Modi, saying: “Dulat says that former Prime Minister Atal Bihari Vajpayee believed that he lost the 2004 elections in view of the Gujarat riots... Bharat Ratna Vajpayee has clearly condemned... the shameful incidents of 2002.”

He said it was Mr. Vajpayee who had reminded “Chief Minster Modi to follow raj dharma”.

“Will Narendra Modi respect the words of the Bharat Ratna and apologise to the country for 2002?” Mr. Kumar asked, talking to reporters.

Mr. Kumar said the interview by former chief of Research and Analysis Wing (RAW) has brought “certain disturbing facts” into the open, including that the Vajpayee government was in “active communication” with the Hizbul-Mujahideen chief Syed Salahuddin and even admitted his son in a medical course.

“It shows the pseudo-nationalism of the BJP... Whenever in power, it has compromised with terrorists and terrorism,” he alleged, adding that Salahuddin and his organisation were responsible for the killings of thousands in the country.

Turning to the IC-814 hijack, the Congress spokesman said Mr. Dulat believed that the Crisis Management Group (CMG) “failed miserably” and allowed the plane to leave Amritsar which led to the release of three dreaded terrorists.

Noting that senior leaders in the then government were part of the CMG, Mr. Kumar said that it needed to be clarified as to as to the circumstances under which the plane was allowed to leave Amritsar and who was responsible for the decision.

If the plane had been halted at Amritsar, it would have saved the lives of a large number of innocent persons, he said, adding that three dreaded terrorists, including Masood Azhar, had had to be released to secure the release of the passengers of the hijacked plane.

He said that the tradeoff proved costly as the release of the three terrorists resulted in the killing of thousands of people, Masood Azhar leading the campaign of hate from Pakistan.

He came and said to me that there is a message that I should go soft,” Salian told The Indian Express

Matters came to a head this month, on June 12, she said, when just before one of the regular hearings in the case in the Sessions Court, she was told by the same NIA officer that “higher-ups” did not want her to appear in the court for the State of Maharashtra and that another advocate would attend the proceedings.

Salian, 68, a leading prosecutor who has handled important cases like the J J shootout, Borivili double murder, the Bharat Shah case and the Mulund blasts amongst others, said: “The meaning (of that message from the officer) is very clear — don’t get us favourable orders.”

She said she wants the NIA to officially denotify her from the case to which she was appointed in 2008, “so that I am free to take up other cases, against the NIA, if need be”.

The Malegaon blast, on September 29, 2008, claimed four lives and injured 79 while another blast at the same time in Modasa in Gujarat killed one. Initially, Muslims were seen as suspects in the case but it was under Hemant Karkare of the Maharashtra Anti-Terrorism Squad (ATS) that investigations led to alleged Hindu extremists based in Indore, as first reported by The Indian Express on October 23, 2010.

Investigations revealed the blasts were allegedly the handiwork of extremist Hindu organisations. Twelve people were arrested in the case, including Sadhvi Pragya Singh Thakur and Colonel Prasad Shrikant Purohit. Of the 12, four are on bail.

That probe — later given over to the NIA that was constituted after the 26/11 terror attack in which Karkare was killed — led to a relook at other cases: Malegaon blasts of 2006 (31 killed, 312 injured); 2007 Ajmer blast (3 killed, 15 injured); 2007 Mecca Masjid blast in Hyderabad (9 killed, 58 injured); and 2007 Samjhauta Express attack (68 killed, 13 injured). The probe found many common accused in these cases.

Salian said that the Supreme Court has now decreed that the case should be tried in a special court with a specially appointed judge to see to the matter. “So in a way it’s all back to square one,” said Salian.

On April 15, the Supreme Court held that the Malegaon accused cannot be charged under MCOCA since there was no evidence as on date. Opening the doors for their release on bail, it further said that the trial court should decide their bail plea on merit and without applicability of MCOCA, preferably within one month.

This, Salian said, now leaves it open for the accused to once again appeal for bail in the court under changed circumstances.


“A day before June 12, when the case came up again for regular hearing (in the trial court), the same officer who had come to my office came up to me and said there are instructions from higher-ups, someone else will appear instead of you. I said I was expecting this and, good, you have told me this, so please settle my bills…I also said that now they should now denotify me so that I can appear against the NIA in other matters — not this one — in the future. He must have conveyed it to the higher-ups and I am waiting for their action. I have not heard from anyone since then,” said Salian.

“The meaning (of the message from the government) is very clear — don’t get us favourable orders. Unfavourable orders are invited — that goes against the society,” said a perturbed Salian.

When asked how she saw the case proceeding further, Salian said, “For a layman or a fresh prosecutor it’s very difficult — one cannot do anything. Maybe they want to loosen it and ultimately lose the case because they can’t withdraw it.”

14 key witnesses have turned hostile since hearings in June 2014, says Public Prosecutor in Ajmer blast case

Since June 2014 and the change of government at the Centre, 14 key witnesses in the 2007 Ajmer dargah blast case have turned hostile, weakening it considerably. One of them is now a minister in Jharkhand.

Last month, Special Public Prosecutor Rohini Salian told The Indian Express that she had been under pressure from the National Investigation Agency (NIA) to go “soft” in the 2008 Malegaon blasts case from the time “the new government came to power” — a charge the probe agency denied.

The Ajmer dargah blast, which killed three and injured 17 people, was handed over to the NIA in 2011. It now emerges that all 14 witnesses have gone back on their statements recorded before the Anti Terrorist Squad (ATS) and a magistrate under Section 164 of the Code of Criminal Procedure in 2010.

Public Prosecutor Ashwini Sharma told The Sunday Express: “These 14 witnesses who have turned hostile since the hearings in June 2014 were all key witnesses who had recorded their statements before the magistrate under Section 164 (of the Code of Criminal Procedure).”

“It was all the more important because in this case, there are only 15 witnesses who recorded their statements under Section 164, of whom three were later named accused. A large number of the remaining witnesses are the injured or police officers who are not key witnesses.”

“The testimonies of those who have turned hostile would have made for a watertight case. Despite tough cross-questioning, they refused to admit in court what they had once told the ATS or the magistrate. This considerably shakes the ground of the case,” Sharma said. The witnesses who have turned hostile — Randhir Singh, Rohit Kumar Jha, Bhanu Singh, Sonu Pandey, Vishnu Patidar, Swapnil Joshi, Ishan Chawla, Vinod Kumar Shav, Parimal Pal, Gautam Pal, Vimal Pal, Sugandhi Devi, Govardhan Singh and Hari Narayan — are either active RSS workers or owe allegiance to the Sangh in some capacity or the other.

The case was handed over to the NIA in 2011 but hearings kept getting postponed since the witnesses moved over a dozen applications, delaying their appearance before the court.

The witnesses cited, among other reasons, threat to their lives.

In 2014, it was decided that hearings in the case would be fast-tracked — at least five hearings a month. Since then, 90 of more than 170 witnesses have been cross-examined, of whom 14 have turned hostile.

These are statements of five of the 14 witnesses who have turned hostile:

* Randhir Singh, RSS loyalist, now Jharkhand minister:

On July 21, 2010, Singh told ATS: “Zila pracharak Giridih Mahendraji, vibhag pracharak Ranjan and Indore RSS pracharak Manoj alias Sunil Joshi came to my house on a motorcycle four years ago and told me we would have to go to Akhil Mandal’s (vibhag karyavaha) place in Godda. I took them in my Bolero JH 15R 5555. Devendra Gupta came along with Akhil Mandal and took us to a village. I don’t know the exact village’s name. They got off the car to go to a house but I kept sitting. Later, Akhil Mandal, Devendra Gupta and Manoj came out and fired from a pistol. When I asked about the pistol, they said ‘forget about these things, you just drive’. Later, I distanced myself from Devendra Gupta.”

He repeated the statement under Section 164 on September 27, 2010 but did not mention the firing.

On May 6, 2015, Singh turned hostile in court: “ATS pressurised me. Met Devendra Gupta only at RSS baithaks. I do not know Mahendra and Manoj.”

* Vishnu Patidar, RSS worker, Shajapur, Madhya Pradesh

On September 1, 2010, Patidar gave a statement to ATS and on September 23, 2010 recorded a Section 164 statement: “I know Chandrashekhar. He used to come to my house. Two years ago, at Pankaj’s shop, he gave me three mobile phones. I tried using all three. One of them was used by Santosh, one was not working and one my wife used. On the day of Diwali, ATS officials came to my house to investigate. Chandrashekhar told me that I should tell them that the phones belonged to Pankaj Patidar, who was already dead.”

On November 21, 2014, he told the court: “I do not remember saying that Chandrashekhar had asked me to say any such thing.”

* Rohit Kumar Jha, RSS worker, Jharkhand

Jha recorded his statement before a magistrate under Section 164 in New Delhi on August 21, 2010, voluntarily in English. “In 2005 summer, one guruji came from Madhya Pradesh to visit Devendra Gupta at Mihijam. Later on I came to know his name was Sunil Joshi alias Manoj. Guruji stayed there for one day. After he left, Devendra asked me for a voter ID card. I asked him for what purpose did he need it. He said he had come from outside, needed local address to arrange for a mobile number. In Dumka, one of my friends Ravi told me his father was a mukhiya and distributed ID cards at their village. At their house, I saw 30-35 voter cards lying. Without permission I picked two and gave to Devendra Gupta. I was cleaning Devendra Gupta’s room and saw pencil cell with red wire attached lying in his room. Later on came to know it was a detonator. There were 10-12 such wrapped in a newspaper.”

On January 13, 2015, he told the court: “I do not know English. Not my statement.”


* Sonu Pandey, RSS worker, Jharkhand

On November 24, 2010, Pandey told the magistrate under Section 164: “I gave Devendra Gupta my mother’s voter ID card in 2006. My grandfather was in the Railways and after his death, my mother would have got an ad hoc job for which I gave the ID card. Later, when I asked for it, Devendra Gupta gave me other documents but did not give the voter ID card. He said get another made.”

On January 16, 2015, he denied this in court.

* Hari Narayan, RSS worker, Shajapur, Madhya Pradesh

On September 25, 2010, in his statement under Section 164, Narayan said: “Bhanu and Govardhan came on a motorcycle to my house and kept an attache. They said they will take it later and did so. When the ATS called, then I got to know there were phones in the attache.”

On November 21, 2014, he told the court: “ATS pressurized me to give such a statement.”

The next hearings in the case are slated from Monday through Friday where more new witnesses will be introduced.

ENS adds from New Delhi: NIA Director General Sharad Kumar said: “All these cases were finalised during the UPA regime, and the then DG of NIA took whatever decisions he seemed fit. As for some witnesses turning hostile, there are more than 300 witnesses and it should not have a very damaging impact on the case. We are examining this.”

Israeli Prime Minister Benjamin Netanyahu called up Prime Minister Narendra Modi to speak about a United National Human Rights Council resolution against Israel a day before it was put to vote at the council in Geneva on Friday, sources told The Hindu on Saturday. India abstained from voting on the resolution.

Diplomatic sources confirmed that Mr. Netanyahu spoke to Mr. Modi on Thursday, to discuss Israel’s issues with the resolution on the violence in Gaza in 2014 that left 2,251 dead. But the External Affairs Ministry, in its media statements, did not disclose the fact that the two Prime Ministers spoke.

Israeli newspapers on Saturday credited diplomats with convincing India not to vote against Israel. In a tweet, Israeli Ambassador to India Daniel Carmon appreciated the government’s stand. “We appreciate votes by members of @UN_HRC, including #India, who did not support yet another anti-Israel bashing resolution. We thank them.”

India was among five countries that abstained from voting against Israel, which only the U.S. opposed.

Centre curbing civil rights

The district unit of Komu Sauharda Vedike staged a protest in front of the Clock Tower here on Friday, against Modi-led BJP government at Centre for curbing civil rights.

Speaking on the occasion, district unit of Komu Sauhrada Vedike Vice President Phanniraj said Modi government is the protector of assassins who created havoc during the Gujarat riots.

He said government is treating civil rights activist and journalist Teesta Setalvad badly and inhumanly. She has been labeled anti-nationalist element and the government is framing fake charges against her

Phanniraj alleged Modi-led Central government was framing her as she is responsible to bring at least 57 cases concerning Gujarat riots into the court and at present she is fighting for 27 cases in the Supreme Court.

Alleging that the encounter culture is being encouraged by Modi government, he said Modi government has given clean chit to five top ranking police officials and they were also given bail for gruesome crime. He said irony is that two of them are reconstituted into service

Condemning Modi government’s attitude for initiating CBI inquiry into the Setalvad case, he said Teesta is being punished for being transparent in maintaining her accounts.

Harnessing terror

Asserting that the BJP government is massacring civilian rights, the social activist said the government is harnessing the terror in different form. He ridiculed that even after people receiving life imprisonment in Supreme Court, they are offered bail, referring to Maya Kodnani, the BJP MLA, who was involved in Gujrat riots.

Komu Sauhrada Vedike district president G Rajashekar alleged that the government is also behaving violent in case of Delhi University English Professor G N Saibaba.

He is granted temporary bail for three months to undergo medical treatment for multiple ailments including for a degenerative spine disease. He was arrested by Maharashtra police last year for alleged Maoist links and jailed in the Nagpur Central Prison.

He said that how a person with 90 percent disability would be able establish of Maoist links, he ridiculed.

He also said Hemanth Karkare is massacred by the RSS activists in Mumbai and not by Islamic fundamentalists as pictured by the BJP government, he added.

The takeover: how the Modi govt has filled key positions in 14 institutions

Two celebrated Indians - Nobel laureate Amartya Sen and Bollywood actor Ranbir Kapoor - have separately come out in public, raising one issue: the Modi government's interference in educational institutions.

Sen was scathing in his criticism of what he calls "extraordinarily large" interference of the government in academia. "Nothing in this scale of interference has happened before. Every institution where the government has a formal role is being converted into where the government has a substantive role," he alleges.

He also claimed that his "ouster" from the post of the Chancellor of Nalanda University was a forced one.

Kapoor focused his criticism on the controversial appointment of BJP member Gajendra Chauhan as the director of the Film and Television of India (FTII).

For the most part, many of these appointees also share an ideological belief that India would be better off as a majoritarian Hindu rashtra rather than a secular polity.

A BRIEF SYNOPSIS OF MODI RAJ !!

On December 23, 2013, a lower court in Gujarat cleared Narendra Modi and 57 others of charges that they were involved in the 2002 pogrom. The verdict was based on the findings of a Special Investigation Team appointed by the Supreme Court. The SIT’s reports were riddled with inconsistencies and errors but for the media, TV media especially, the TRP-generating “clean chit” from the lower court was as good as final. It didn’t matter that the appeals process extending right up to apex court had not been exhausted.

Modi’s emergence in 2014 was a surprise only to the extent that he seemed to have shed the Hindutva baggage for development. But even as he enticed the young generation across castes with promises of new opportunities and well-paying jobs, his lackeys remained true to their lineage. Amit Shah‘s inflammatory hectoring ricocheted through U.P. and the signal was picked up by the rank and file. Modi spoke of development but in riot-torn Muzzafarnagar in Western UP, Jats violently confronted Muslims. The BJP also gave the party ticket to men associated with anti-Muslim violence.

In Government, Modi kept the focus on development but in what seemed to be a tacit backing of party hot heads, allowed them to do as they willed. Ministers, MPs and other party functionaries competed to make incendiary speeches. A minister of state, Sadhvi Niranjan Jyoti, instigated her followers with libellous language against Muslims. The hot- headed Mahant
Adityanath rallied and thundered at Muslims and threatened to implement ghar wapsi on a mass scale (bringing them back to the Hindu fold by force). The militant Bajrang Dal added its own bit to the boiling cauldron in the form of the anti-Love Jehad campaign (protests against Muslim boys alleged to be ensnaring Hindu girls into marriage).

But while all this made headline news, the real agenda was the Hinduisation of India — reflected in the rush to fill up important positions with poorly qualified persons with RSS affiliations, in the reforms initiated in education at the prompting of Sangh-linked organisations, and finally in the RSS’s own exalted status in the new regime. On October 3, 2014, Doordarshan and All India Radio carried live the annual Vijaya Dashami address of Sarsanghchalak Mohan Bhagwat. Since then, a co-ordination panel comprising high-ranking Cabinet ministers and key RSS officials has been deciding important policy matters, especially in education where work is in rapid progress for the introduction of a new Hinduised curriculum.

Not just this. Of 27 ministers in the Union Cabinet, 15, or more that half, have their origins in the parent Sangh or its affiliates. This is the largest presence of the Sangh in any BJP-led Cabinet.

Rights activists at risk of detention on politically motivated charges

Civil rights activists Teesta Setalvad and Javed Anand are at risk of being arrested and placed in police custody on allegations of conspiracy and illegal acceptance of foreign donations. Amnesty International India believes they are being targeted for their work in seeking justice for the victims of the 2002 violence in Gujarat.

Teesta Setalvad and her husband Javed Anand have been working for several years to secure justice for the victims and survivors of the 2002 violence in the state of Gujarat, through the organizations Citizens for Justice and Peace (CJP) and Sabrang Communications and Publishing Private Limited (SCPPL). The month-long outbreak of violence in 2002 led to the killing, according to official estimates, of at least 1044 people, mostly Muslims, and the rape of a significant number of women and girls.

Their work has been instrumental in bringing about over a hundred convictions in cases related to the 2002 killings. The CJP has also sought the prosecution of several other Gujarat and central government officials and politicians for their alleged complicity in the violence
.

On 8 July, the Central Bureau of Investigation, a central investigating agency, registered a case against Teesta Setalvad and Javed Anand. The CBI alleged that SCPPL, by receiving about 18 million INR from the Ford Foundation without the prior approval of the Union Ministry of Home Affairs, had violated India’s Foreign Contribution (Regulation) Act (FCRA), which restricts civil society organizations from receiving foreign funding. The CBI said the transfer of the money to the publishing house reflected “interference towards the internal security and activities of India”.

Amnesty International India believes the investigations against the activists to be politically motivated, and made with the intention of persecuting them for their human rights work.

Teesta Setalvad has pointed out that her publishing house had a consultancy contract with the Ford Foundation, which excluded it from the restrictions of the FCRA. Teesta Setalvad and Javed Anand have rebutted the allegations against them in detail in affidavits produced in court. The financial accounts of NGOs run by them have been audited and submitted to the appropriate Indian authorities.

First they went after Sanjiv Bhatt
But I said nothing because I wasn’t a cop. Then the witnesses in Asaram’s
case started dropping dead
But I said nothing because I wasn’t a fan of any guru - buru.
Then the witnesses of Vyapam case started falling one by one
And I said nothing because I didn’t live in Madhya Pradesh.
Then they released Maya Kodnani on bail
And I said nothing because that woman did no harm to me.
Then they tried withdrawing cases against Hindus accused of bomb blasts,
And I said nothing because Hindus are non-violent, so why should they be
prosecuted?
Then they banned beef in the state,
And I said nothing because red meat is bad for health anyway.
Then they started shouting “ghar wapsi,”
And I thought they are cheering the Prime Minister on his occasional visits
back home to India.
Then they froze the accounts of Greenpeace
But I thought that shouldn’t matter, after all India has to develop, no,
and doesn’t Greenpeace stop all development?
Then they stopped Priya Pillai from boarding a flight
And I thought, come on, why does she have to go to a British parliament to
speak against India?
Then they tried to arrest Teesta Setalvad,
But I ignored that – the Supreme Court made sure nothing would happen to
her, so why should we care?
Then they raided Teesta’s home
And I thought, may be she had something to hide, otherwise why wouldn’t she
disclose everything?
Some day, they say, they’ll come for me.
That’s ridiculous; India is the world’s largest democracy.
It is not some banana republic.I pay my taxes;
I have my aadhaar card;
I even do yoga.
But if they do come, will you speak up for me?
