I beg to differ and would like to enlighten you with a few facts. I was born and raised in Kenya and so was my father. Bohras in the early 1945 onwards established themselves in countries like Kenya, Uganda, Tanzania and Zanzibar. Most cities and towns had schools and mosques built by philanthropists like the Karimjees, Nooranis, Sachaks, Mamujis, Jinjawallas, Dhorajiwallas and others. These well meaning and forward-thinking people spent millions of dollars to build academic schools, sports grounds, community housing for the poor and so on. They together with other members of the community built revenue properties from which educational scholarships including fees Maafi , ration for widows and needy, free medical services were provided. Hundreds of youngsters availed themselves of scholarships to acquire education in the UK and India. These became the vanguard of rational thinkers and proponents of enlightenment. The Bohra community in all this countries began flourishing in all fields. When the 51 Dai visited these countries in 1963 he was welcomed with all the enthusiasm of a society that was proud of him. He saw the immense wealth and influence of the community and initiated the abrogation of the East African Bohra Central Council. He did this with the aid of a few side liners like the Hebatullas in a pincer movement. On witnessing this development, and to avoid confrontation with the Dai the philanthropists quietly receded. In order to wrench control the Dai's henchmen started vilifying the philanthropists and their efforts in modernizing the community. The first wave of Bohras started to leave those countries for the West was in the early 1950s. They had hoped to start afresh only to be followed by the Dai followers to replacate the same scenario in the West.

I welcome additional comments from people from East Africa and their experiences during these times.

A New South Wales supreme court judge says he has not seen any evidence that three people convicted of female genital mutilation charges will work to stamp out the practice in their community.

On Friday Justice Peter Johnson presided over a sentencing hearing for the three co-offenders, all of whom are connected to the Dawoodi Bohra Muslim community.

The trio includes two women – the mother of the two girls who underwent FGM and a retired nurse – who were accused of arranging for the two young sisters’ clitorises to be cut in separate incidents in Sydney when the girls were aged about seven.

A high-ranking member of the religious community, Shabbir Mohammedbhai Vaziri, was found guilty by a jury of acting as an accessory after the fact.

The women’s lawyers have previously argued the procedure was symbolic, and that the retired nurse only touched the girls’ skin with a set of forceps.

Johnson said that act alone would be considered criminal assault.

But although the court heard the defendants were remorseful, Johnson did not think the evidence before him showed the three would actively oppose the future practice of female genital mutilation by members of the local Dawoodi Bohra community, symbolic or otherwise.

“I’m not sure that I have seen any of these accused saying they reject all practices of that sort,” he said.

Johnson has also been asked to consider whether an order banning journalists from identifying the retired nurse should remain in place.

The older woman’s lawyer has argued the ban is necessary to protect her safety, adding that the frail woman had been jostled by members of the media and received threatening phone calls.

But the crown prosecutor, Nanette Williams, said the freedom to identify an offender was a central feature of the principle of open justice.

“There are laws against stalking and harassing, and those laws can be invoked to prevent [the woman] from being subjected to any further harassment or calls, should that be the case,” Williams said.

The hearing continues.

"A British paedophilia survivor who has been asked to step down from a Vatican panel on the issue told AFP on Monday that he felt betrayed by Pope Francis.

"Of course Pope Francis has established he is part of the problem," Peter Saunders said in an interview with AFPTV, during which he insisted he had not resigned and that only the pontiff himself could force him to quit the Vatican commission.

"That breaks my heart because when I met him 18 months ago I thought there was a sincerity and a willingness to make things happen, and I am afraid that has been dashed now."

Saunders, the head of Britain's National Association for People Abused in Childhood, was personally asked to join the panel by Pope Francis.

His involvement, along with fellow survivor Marie Collins, helped burnish its credentials as a symbol of the Church tackling the abuse head-on.

But Saunders now says he realises the commission was always going to be about "smoke and mirrors" and that he is convinced the Church will never act alone to cure the "cancer" in its midst.

The Vatican confirmed earlier on Monday that Saunders, 58, had been asked to step down from the commission because of disagreements over whether the 17 members should get involved in individual abuse cases brought to the Church's attention.

Saunders said the move was triggered by tensions that arose after a fellow commission member told him about being approached by two priests from an Italian diocese who had discovered a colleague was a serial abuser of children.

"I have always said I will speak my mind and exercise my right of free speech and that really isn't compatible with the way the Church and the Commission operates," Saunders said.

"It is also at the heart of why abuse within the Church is still so rampant and widespread."

- 'Secrecy and darkness' -

He added: "It is because everything has to exist under conditions of secrecy and darkness and I am not prepared to work like that and I am not prepared to be silenced on an issue as important as child protection."

Saunders said the whistle-blowing priests in the Italian case had been told to stay silent by their bishop and referred back to the prelate by local police.

The case has since been referred to the Vatican for further investigation.

"Now, I find that beyond unacceptable that men doing the right thing protecting children should both be sent away by the police but more significantly and sinisterly... to be told by their boss, the bishop, they must do nothing and to remain silent," Saunders told AFP.

He said he accepted the commission's remit was not to deal with live cases.

But he added that child abuse would never be tackled "as long as we just sit around the table talking about how we should better recruit priests in the future or how we look at updating canonical law, because these are the kind of discussions the commission is having.

"Some of the work they we are doing is very valuable, but it ain't stopping kids being raped now.

"When we hear about something like that, we have to act -- and as a parent, it breaks my heart when I hear of serious allegations of abuse that are not going to be tackled."

Saunders said the notion that clerical sex abuse was a problem of past decades -- an argument Vatican officials have assiduously promoted -- had to be challenged.

"This is not in any sense a historical issue or problem," he said. "It has to be tackled now. The Pope could do so much more and he is doing next to nothing.

"This is a societal problem -- but if the Church, the so-called moral leadership of the world, does not take a lead in this area it would quite rightly be considered morally bankrupt in every other area." msn.com

Ha ha. Mufaddali fanboys/girls don't seem to have read the blurb properly. The letter was not written by Burhanuddin Moula but rather by some amil TO Burhanuddin Moula RA. Burhanuddin Aqa only seems to have forwarded it to SKQ. It's notable that Burhanuddin Moula did not get mad at the aamil but rather sent it on to the person concerned! Lends credence to the Qutbi claim.

The journalist of this article needs to be informed the letter was in response to the judge demand ing action as a sign of regret, the community produced a symbolic letter that was discredited as flawed in content by the prosecution and questioned the impact if any in stopping fgm.

An Indian man has entered the record books after making a rail journey to Delhi on a 26-year-old ticket.

On 19th Jan 2000 Fakhruddin Takulla ( India ) travelled from Mumbai ( Bombay ) to New Delhi, both India, using a ticket he had purchased on 15 July 1973 – 26 years 6 months earlier. Takulla used the unlimited booking service offered by the Indian Railway Authority so that he could attend the celebrations marking the 50th anniversary of Indian Independence.

Shri Fakhruddin Takulla, resident of Bombay, shocked the reservation clerk on duty at Western Railway's reservation office some time in 1973 when he approached him to book an AC Chair Car ticket to travel from Bombay Central to New Delhi by the Rajdhani Express 27 years later in January, 2000! Such bookings were then allowed under Railway Board's experimental scheme to permit would-be passengers to book their reservations in all trains without any time cap. Initially the clerk was reluctant for he had no calendar for 2000 to know whether the train would run on the specified date 27 years later for the Rajdhani then (in 1973) used to run only thrice a week. Further it was also too much of an 'unnecessary' hassle for the clerk to keep records, etc., safely for the next millennium. But the enterprising Shri Takulla would not give up as he produced a manual calendar, which he had drawn up himself, to let the clerk know the exact day and date of date of his journey! Finally, thus, he got his precious ticket for Rs 120/-.

Later Shri Takulla indeed took the journey to New Delhi by the Rajdhani Express to arrive there well in time to see the Golden Jubilee Republic Day celebrations in January 2000. He was grateful to Allah for keeping him alive to see the destined day 27 years later.

Indian Railways played the good Samaritan for they exchanged his ticket gratis for AC 3-tier class as by 2000 the AC Chair Car class had vanished from the Rajdhani. They also gave him a VIP treatment by deputing a railway official to receive him at New Delhi station on arrival and arranged for his lodging in New Delhi at a railway guesthouse for 8 days, and also arranged for his return journey at no cost to him. Shri Takulla was also given a place in the VIP gallery to watch the Republic Day celebrations. 'We felt that a person who could think of doing this 27 years ago obviously had tremendous faith in the reliability of the Indian railway network and we felt that we needed to acknowledge that and respond to it adequately,' said Shri Shanti Narain, member of the Railway Board.

At 61, Fakruddin Takulla now wants to book a ticket for 2038 - when he will be 100.His dream now is to go to his ancestral home in Kaparwaj, in the western state of Gujarat.

The roots of India's independence from the British were laid in a similar manner, in isolated protests and rebeliion at smaller level which started with the famous uprising of 1857! But India didnt gain independence until the next 90 years.. almost a century...

Australian judge sentences mother to 15 months for mutilating daughters

This is milestone in bohra history. From now Kothar will afraid law of land at least at Western countries. In Asian countries slowly noose is getting tighter day by day. In maharashtra new law has been passed against social boycott. Time will tell when first case is registered against Kothari mafia.

I must say this is one of the best law that is pass in bjp ruled government kudos to Mr. Phadnavis. Koi aur k nahin to na sahi, reformers k acche din aa gae atleast in maharashtra. Even if few cases goes in favor of victim regarding excommunication many will get strength to raise voice agnst kothar dictatorship. These kothari are using excommunication as their favourite tool to control people now government has given a wonderful reply.

Only worry is this is INDIA where corruption can suppress any law...

On April 13, 2016, on the eve of Dr B R Ambedkar’s 125th birth anniversary, the Maharashtra legislature unanimously passed the Prohibition of Social Boycott Bill to end the menace of extra-judicial institutions such as caste and community panchayats. The Bill was approved by the State Cabinet on March 1 and will be tabled in the Assembly during the monsoon session.

The Bill has followed the directions of the Bombay High Court to the State government in August 2013 to frame a law to curb the menace of social boycott and excommunication. Two cases had come up before the High Court: one a PIL filed by four members of the ‘Kunbi’ community from Harihareshwar, Raigad district, who were facing social boycott for contesting the local body elections without the consent of their jat panchayat and the other by a member of the ‘Koli’ community from the same district that the local caste panchayat had ostracised him due to which he was not allowed to attend weddings and funerals of his relatives, and was even disallowed from being supplied subsidised diesel for his fishing boat.

On August 19, 2013, a Division Bench of the High Court headed by Justice SC Dharmadhikari had said: “Victims of excommunication must have the protection of law. It is dangerous in a democratic setup to run such parallel systems, which control society illegally,” and exhorted the State government to take initiatives to end the scourge.

The High Court said, “As per Articles 14 and 21 of the Indian Constitution, everyone should be given the Right to Equality; some people, in the name of caste panchayats, shouldn’t violate the rights of others.”

But it is not the first time that such a legislation has been passed in the State. In 1949, in what was then Bombay Province (that included the states of Maharashtra and Gujarat), the State government had passed the Bombay Prevention of Excommunication Act, 1949, with the objective to protect the civil, social, and religious rights of those excommunicated by their own communities. The legislation was pushed by the reformers within the Dawoodi Bohra community who sought to bring an end to the practice of ‘excommunication’, which was rampant in their community.

The community’s head priest or Syedna challenged the law on the ground that the Act infringed upon his constitutional freedom of religion by curtailing his right as the religious head to discipline the community by casting out ‘errant’ members. The High Court upheld the constitutional validity of the Act. However, in 1962, a five-judge Bench of the Supreme Court headed by Chief Justice BP Sinha in Sardar Syedna Taher Saifuddin vs The State of Bombay, struck down the Act finding that its provisions violated Articles 25 and 26 of the Constitution

An Indian campaign which advocates against female genital mutilation(FGM) is reaching a global audience, but here in Mumbai, it is being dragged into the dirt by a section of the Dawoodi Bohra community, which isn't happy with the momentum it is gathering and are intent on spamming it with porn and irrelevant postings. The Facebook page for `End FGM' is a space for members to share their experiences of FGM and engage in a meaningful debate on the traditional practice. The page, set up by Delhi-based publisher Masooma Ranalvi, has gotten significant traction and boasts a 2,000 member community.
On Tuesday a person with the account name Moiz Noori started putting up pornography on the page, and another person, Shabbir Mohsin Thanawala began to flood the page with irrelevant content. Angry members had the page administrators delete the post ­ while stating that they welcomed diverse opinions. Page admin Ranalvi told Mirror. “We are looking forward to debates that are respectable and not outright derogatory.“

The Bohras, a sub-sect of Shia Islam, are the only community in India that practice FGM, in which the hood of the clitoris is cut at the age of six, causing young girls lifelong psychological and physical trauma.

Bohra Jamaats in London, Australia and US have already issued letters banning FGM. The global movement was significantly strengthened by a recent landmark verdict in Australia, which convicted three people for practicing FGM. The court relied on the testimonies of two young girls who narrated their ordeal, and convicted a 72-year-old former midwife, the mother of the two girls, and senior community leader Shabbir Mohammedbhai Vaziri. The development comes at a time when many women from the 1.5 million strong Bohra community in India, raised their voice against the ritual, saying it amounts to child abuse. An online petition under the name 'Speak Out On FGM' has garnered more than 50,000 endorsements so far, by people within and outside the community.

Despite repeated attempts, Mirror was unable to contact the two accounts that had initiated the trolling.

The decades-long argument over excommunicationMaharashtra recently passed what has been called the country’s first law against social boycott, a punishment that is often used by Jaat Panchayats, or caste associations, and members of clergy to rein in individuals and families who dare to question their authority. The Maharashtra Prohibition of People from Social Boycott (Prevention, Prohibition and Redressal) Bill, 2016 makes social boycott, or excommunication, a crime and makes the practice punishable with a jail sentence and a fine.

The Bombay province, which gave way to Maharashtra and Gujarat, had a similar law. In November 1949 the province’s legislature passed the Bombay Prevention of Excommunication Act. The only group that challenged the law was the Dawoodi Bohras. The community’s then spiritual head, the 51st Syedna, filed a petition against the law, saying that it violated his fundamental rights under the Constitution. He said that the power of excommunication was one of the tools with which he managed the affairs of his sect. The judges, though not unanimously, agreed that powers of excommunication was vested in him to keep the denomination together, and allowed the petition.


The Dawoodi Bohras have a long history of legal fights over the issue of excommunication. In 1977, a commission headed by justice Narendra Nathwani was set up to find out whether allegations of social boycott by some families were true. The commission, which submitted its report after two years, said that the complaints were not unfounded. The commission’s findings were ignored by successive governments, but a group of reformists, led by the late Islamic scholar and Bohra reformist Asghar Ali Engineer, went to court with the judge’s findings.

The case has still not been disposed of and the three-decade-old petition came up for hearing in January. Though Engineer has passed away, the Central Board of Dawoodi Bohra Community (CBDBC), a group formed by families who declared themselves independent of the clergy, have said that they will continue to fight the case as families continue to complain of excommunication.

In Mumbai, the last case of social boycott, reported in newspapers, was in 2008, when a Dawoodi Bohra family complained that they were excommunicated for daring to file a complaint against a mosque trust which owned the premises from where they ran a shop. The four brothers and their families, which stayed together, said that the trustees of the property, who were also the local religious leaders, asked other Dawoodi Bohras in the area to boycott them. The family said they had stopped getting invitations to weddings and other functions in the community. The children were debarred from the religious school run by the trust and the elders were stopped from entering the local mosque.


To end the torment, the family was asked to withdraw the property case. The social boycott ended but the family is now facing litigation from the trust. “We withdrew the case thinking that the boycott would end, but we are now struggling to fight the case,” said one of the brothers.

The CBDBC continues to receive complaints about social boycott from other towns. In January, when news went around that the excommunication case was going to be heard by the Supreme Court, a Gujarat resident wrote to the trust that, after he refused to pay illegal religious taxes to the local clergy, he was told that dead bodies of his relatives will not be allowed to be buried in the community graveyard. They were stopped from entering the mosque and using the communal guest houses.

Saifuddin Insaf, member of the CBDBC, said that when his mother died, he had to fight members of the clergy who refused – because he had joined the reform movement - to allow her body to be buried in the community graveyard. “Asghar Ali (Engineer) also had to fight to get his mother’s body buried in a Dawoodi Bohra burial ground. We could fight, but others do not have this option,” said Insaf.

Eyebrows raised after Syedna refers to female circumcision
MUMBAI: Efforts may be on to end the practice of female genital mutilation that young girls in the Dawoodi Bohra community are made to undergo in India but their spiritual leader may not be convinced yet as he went on to publicly encourage the act of khatna (female circumcision) albeit indirectly, in his recent sermon at the Saifee Mosque in Bhendi Bazaar.
A four-minute audio clip from Syedna Muffadal Saifuddin's bayaan (speech) on the occasion of the 51st Syedna Taher Saifuddin's death anniversary, has gone viral over a mobile messaging app and generated conversations within the community on how the Syedna's endorsement may urge close followers of the spiritual head to continue with the painful practice.
The clip begins with a plea from the Syedna speaking in a mix of Gujarati and Urdu. "We should keep our things strong, stay firm. Even the big sovereign states, whatever it is they say, if it makes any difference to our things, then we are not prepared to understand!" he says and then adds. "The act has to happen! If it is a man, then it is right, it can be openly done, but if it is a woman then it must be done discreetly, but then the act has to be done. Please understand what I am trying to talk about..."
A Mumbai resident present at the Hussaini Mosque where the sermon was being beamed live on a giant screen confirmed that the clip was what he had heard being broadcast. "The Syedna was reading from a script which is usually the routine on such an occasion but all of a sudden he went off and started talking in a cryptic fashion. It was confusing at first. Then we gradually realized that he was talking about female circumcision when he used words like amal (act), mamlakat (states) and that the act must be carried out discreetly for women and openly for men. It was very disturbing for me and my wife," he told TOI. A close friend of the Syedna family dismissed such an interpretation of the Syedna's speech when TOI called him. "It was a general comment. Nothing specific. People are interpreting it differently," he said alleging that, "Those close to the new claimant to the Syedna title are trying to target our revered Syedna (Muffadal Saifuddin)."
A 36-year-old Bohra woman who has lived through the horrors of khatna and currently settled in the US expressed her anguish having heard the clip. "Just a month ago many of us in the US received a letter from the jamaat (local community unit) that works under the Syedna's guidelines. It said that we must follow the law of the land and not practice khatna. I was thrilled, at peace with my faith. What I just heard reflects hypocrisy. I'm disillusioned and worried

Everyone knows muffu is arrogant. He will say dawat na dushman wanted him to fight back on 'FGM' by provoking over exposure on trivial matter. Lot of noise on the matter.Since he dont care what they say, he just ignore them and hypocritically park the topic by making different story. He will never submit to fight put by dawat na dushman...his henchmen are told to ignore the topic hence we find weird response on mediaperson asking his henchmen to confirm what he said..

A month after the Lok Sabha hurriedly passed the Aadhaar Bill, the debate over privacy and surveillance related to the gathering of biometric data by the Unique Identification Authority continues. The Bill, notified as a law on March 28, allows the government to collect and centralise biometric data of its citizens, and assign each individual with a unique 12-digit identification number.

Though Aadhar numbers are ostensibly to be used to transfer government subsidies and benefits to those eligible for a variety of welfare schemes, the law also gives the Unique Identification Authority the discretion to let any “requesting entity”, including private businesses, access the Aadhaar database. Even before the Aadhaar bill was notified, some private companies began to advertise apps and services that would use Aadhaar numbers to perform background checks on potential employees. This is worrying in a country without a privacy law in place.

For now, citizens can only imagine the extent to which their biometric data could be misused. But why just imagine? To get a clearer picture of what unwanted mass surveillance could look like, we need to look only as far as the small Dawoodi Bohra sect of Shia Islam, and the electronic identity cards it has made mandatory for its followers.

From E-jamaat to ITS

Dawoodi Bohras, who predominantly hail from Gujarat, are estimated to number 1.5 million worldwide. Around half of them live in India. A close-knit business community, the Bohras are known to be wealthy, well-educated and also tightly-controlled by the dawat – the religious and administrative headquarters of the sect. The head of the dawat is the community’s leader, known as the Syedna.

A decade ago, the leadership issued mandatory E-jamaat cards for all Bohras. These were identity cards linked to an electronic database that contains personal and professional details of individual community members. The plastic E-jamaat card was meant to serve as a Bohra’s passport to the community – to be scanned while entering mosques or pilgrimage spots.

Around three years ago, all Bohras were asked to upgrade their E-jamaat cards to new smart cards called ITS cards (short for Idaratut Ta’reef al Shakhsi). These are radio frequency-enabled, bar-coded identity cards that connect to an international database managed by the Bohra dawat.

To upgrade to the ITS card, Bohras were expected to report at their local mosque and get photographed with very precise specifications, much like a passport photo. While their biometric data, such as fingerprints or iris scans, were not taken, the ITS registration form asked for personal and professional details of an individual’s entire family, which some Bohras found intrusive. “I remember asking them how secure they would keep such sensitive information,” said Fatema (identity concealed on request), a Bohra from the UK. “But of course I got no answer.”

Big Brother watching?

Like the E-jamaat card, Bohras are told to scan their ITS cards every time they enter a mosque, community hall or musafir khana (pilgrim guest house) anywhere in the world. Access to the dawat’s main website is also restricted to those who have an ITS number. Thus, only card-holders can access online application forms to go for pilgrimages or attend major religious events.

For many pious Bohras, this is a welcome convenience. But for many others, it is a form of policing. “The card records everything,” said Jameela (identity concealed on request), a Mumbai resident. “[From] the number of times you go to the masjid, how often you attend Moharram sermons, what time you enter the mosque for sermons and more.”

Faiyaz (identity concealed), a Bohra businessman from Pune, said he resented the fact that the ITS card was considered mandatory for anyone who wished to remain within the community fold. “Our privacy is completely lost,” said Faiyaz. “Last Moharram, I actually got a call from my local mosque asking me why I had not been attending sermons, because they saw that my card had not been swiped. I know people who send their cards with their wives to be swiped by proxy at the mosque.”

Even donations are not anonymous anymore, said Faiyaz, because religious authorities insist on recording the donated amount on the ITS database.

Community members are afraid to openly criticise the Syedna or the dawat because it could entail getting excommunicated. But the resentment against the surveillance enabled by the smart card is evident on online forums. One thread on Dawoodi-Bohras.com is called “Shredded my E-jamaat card”.

“The card is really creepy because the moment you scan it, they can see your entire history of records instantly,” said Fatema. “They say it is for organisational purposes, but it’s really like Big Brother is watching you.”

ITS and Aadhaar

This sentiment is familiar to activists protesting the use of the Aadhaar card. An electronic database of citizens’ demographic and biometric information could easily be used for similar surveillance of anyone the state may deem suspicious. Handing over such data to private, commercial parties poses even greater threats to privacy.

While the government has claimed that the biometric information will not be handed out to any “requesting entity”, the Aadhaar Act allows for this data to be disclosed to any government joint secretary “in the interest of national security” – a phrase that remains undefined.

“Aadhaar is a platform that will be used to converge all existing databases, and it is already happening,” said Gopal Krishna, a member of the Citizens Forum for Civil Liberties. “The fear is that it could be used to classify and profile all kinds of citizens.”

Krishna said the Bohra ITS card can easily be compared to the Aadhaar. “The community’s members need to realise that electronic databases are never really secure, and may not remain in control of the community authorities,” he said. “Bohras are endangering themselves because their information can be used not only for surveillance by their own clergy but also can be used by any hostile body to get personal information about them.”

Allah isnt enough to watch it?

it is clearly meant for worldly gains and nothing to do with religion. I urge bohras to deny this E Jamaat card system at earliest, deny to show your card and deny to carry it in masjid.

tell them Allah is enough to watch my entry and exit in masjid.


my card dont work any more since I haven not used it from long time now, but even if it was working I would never use to enter masjid. my entry and exit in masjid is between me and my Allah.


if they dont let you enter masjid dont fight, just go to police station and report it and also report it to local muslim authority, its time to flood mufaddali dawat with FIR and cases.
