A year after a Singaporean was overcharged, authorities finally crack down on errant driver, taxi operator.

The culture among Mumbai cabbies to gouge money out of tourists spurred a complaint from Singapore to the Prime Minister's Office, a frantic hunt for a cheating driver and suspension of his licence — a crackdown in which Mirror played a small but important role.

The action against overcharging comes nearly a year after Singaporean Raymond Yeo, 50, took up the issue with the PMO.

Raymond, who visits Mumbai for business and leisure, was charged Rs 500 for a 1-km trip from The Lalit hotel to T2 terminal on April 11, 2015. The driver initially quoted a fare of Rs 200, but demanded more when the trip ended saying Raymond's two suitcases were "excessive baggage".

Raymond paid Rs 500 and later sent a complaint to Prime Minister Narendra Modi's office, which has been trying hard to woo foreign tourists and investors.

The complaint reached the Maharashtra transport commissioner's Bandra office last Monday and the driver, Jamil Ahmad Khan from Marol, was tracked down four days later. He initially denied driving Raymond to the airport, but Mirror helped authorities expose his lie by forwarding his picture that the Singaporean had taken that day.

On Wednesday, Khan's licence was suspended and the tourist travel permit of the cab he drove was withdrawn for 30 days. The cab is owned by Thane's Mahek Tours and Travels, according to RTO officials.

Raymond said he was glad, and a little surprised, that action had been taken over an issue that enrages thousands of cab users in Mumbai day in, day out. "I searched online where I could register a complaint [with the PMO]. I mentioned the taxi's registration number in the complaint. I never expected that the Indian government would look into the issue and take action," he told Mirror from Singapore. "My only objective was to highlight the issue because I have heard from my Indian friends that this happens often and people don't report it."

Raymond works as a sales manager with an electronics firm in Singapore. He checked out of The Lalit on the morning of April 11, 2015, and ordered a ride to the airport around 10.30 am.

Driver refused metre fare

"I hired a private taxi from outside the hotel. I have been to Mumbai before and know that the hotel is barely a kilometre from the international airport. The driver refused to ply by the metre and told me the fare would be Rs 200. I knew I was being cheated, but I was in a hurry to reach the airport so I agreed," Raymond said.

"But when we reached the airport, the driver demanded Rs 500 saying I was carrying excessive luggage. I was shocked as I only had a handbag and two suitcases. I could not believe he was asking more money for the luggage than the journey fare."

Complaint's long journey

Raymond, who was getting late for his flight, argued with Khan briefly before paying him Rs 500. As he walked into the terminal, he decided to report the incident to the PMO.

His complaint described Khan's actions as "pure malpractice and corruption" and stressed on the fact that such incidents were ruining India's image. The complaint made its way to the transport ministry in Delhi on February 16 this year before finally landing in state transport commissioner Shyam Wardhane's office on March 28. It was forwarded to the Thane RTO, where the cab is registered, on March 31.

The inquiry into the complaint once again exposed serious lapses in the vehicle registration process: the Shahpur address listed against the taxi in RTO's files does not exist, officials found. The car's insurance records with the RTO helped them find the correct address. "But we could not find the vehicle owner or the driver at the location," an RTO officer said.

Social activist Binu Varghese came to the RTO's aid. He and a group of volunteers kept a watch near the international airport, from where Khan often picked up customers, for two days. "I shared the cab's licence plate number with the volunteers, one of whom spotted the car on April 2 and rang me up," he said.

RTO officers soon reached the spot and seized the cab. Khan told officials he didn't own the vehicle and he had started driving it only recently. Another driver with the cab firm may have overcharged Raymond.

On Wednesday, Raymond shared a picture of Khan he had clicked with Mirror. We forwarded it to Varghese, who confirmed with RTO officers that Khan was the same driver that overcharged Raymond.

"We have suspended the cab owner's permit for 30 days and are considering to cancel it permanently. We have asked Andheri RTO to suspend the driver's licence," said Thane deputy RTO Hemangini Patil.

Former Crime Branch officer Sachin Waze said NGO 'Support' had launched a drive to identify cars registered on fake addresses. "We have identified over 100 cars. We hope the campaign will help prevent incidents in which tourists are fleeced," he said.

The Indian American Muslim Council (IAMC – iamc.com), an advocacy group dedicated to safeguarding India’s pluralist and tolerant ethos has condemned the Saudi government’s decision to confer Indian Prime Minister Modi with the nation’s highest civilian award.

“It is expected that the Indian Prime Minister is accorded the respect befitting a head of state. However, conferring of the highest civilian award on Mr. Modi by those who claim to be the custodians of the two Holy Mosques is a slap in the face of survivors of the Gujarat pogroms of 2002. It is also a demonstration of indifference to the increased attacks and threats against the religious minorities and Dalits in India,” said Mr. Umar Malick, President of IAMC.

Mr. Modi and the Saudi monarchy have much in common. As Chief Minister of Gujarat, Mr. Modi presided over one of the worst episodes of sectarian violence in independent India, when over 2,000 people were massacred by mobs instigated by the Hindu-supremacist groups. The horrific killings were accompanied by rape and pillage, resulting in the displacement of over 150,000 Muslims from their homes, many of whom are still struggling to pick up the pieces of their lives. Mr. Modi continues to have a case pending against him in the Gujarat High Court and a tainted Special Investigation Team failed to initiate prosecution of Mr. Modi. The handful of convictions in the cases related to the pogroms in Gujarat have happened as a result of tireless and courageous work by activists and whistleblowers, whom the Modi government has harassed and intimidated.

Since coming to power, the Modi administration has worked steadily to erode religious freedom and India’s long-cherished traditions of tolerance among its diverse populace. Ranging from attacks on churches and mob violence against Muslims and Dalits, to felicitating the killer of Mahatma Gandhi, Mr. Modi’s administration and its supporters have relentlessly pursued a divisive agenda, that is antithetical to the country’s Constitution and its egalitarian ideals. The demonization of intellectuals, the vigilantism encouraged by the state, and the weakening of institutions are all indications of a besieged Indian democracy.

Saudi forces are conducting indiscriminate airstrikes in Yemen that are widely acknowledged to have caused huge loss of civilian lives, creating an ongoing humanitarian catastrophe. Incidentally, the monarchy had conferred the same award given to Mr. Modi, on Mr. Abdel Fattah Al-Sisi of Egypt.

“Coming from the Saudi monarchy, which is known for its repressive domestic policies and human rights violations, the award itself is of dubious value. It diminishes, rather than enhances the office of the Prime Minister of India,” added Mr. Malick.

All the statements were given in front of a magistrate and hence admissible as evidence to nail the alleged culprits that include a 'sadhvi' and a serving Indian Army officer.

In a major setback to the 2008 Malegaon blasts case, seven statements of witnesses - all recorded in the presence of a magistrate and admissible as evidence - have gone missing from the Special NIA Court.

Coming in the wake of Special Public Prosecutor Rohini Salian's statement in June last year that National Investigation Agency (NIA) officers were putting pressure on her to go soft in the case, the disappearance of the crucial court documents will again call into question the prosecution's intent and ability to take the case, in which members of an alleged Hindu radical group stand accused, to its logical conclusion.

The Maharashtra police's Anti Terrorist Squad, which investigated the case before it was handed over to NIA in 2011, arrested a dozen-odd accused, including self-styled Sadhvi Pragya Singh Thakur and serving Indian Army officer Lt Col Srikant Purohit. Both worked for Hindu radical group Abhinav Bharat.

Top NIA officials, including DIG Abhin Modak, all through Wednesday did not respond to calls and text messages and an agency spokesman said he had no comment to offer on the matter.

Among the witness statements gone missing is that of Dharmendra Bairagi, a close aid of Ramji Kalsangra, a key accused in the case who is absconding. Bairagi, in his statement recorded before a magistrate, had said that he was witness to a meeting between Kalsangra and Pragya Thakur in Ujjain just months before the 2008 blasts. He had also said he had heard the two discussing a plan to engineer blasts.

Another key statement that is missing is that of the founder of Abhinav Bharat Hemani Savarkar. Savarkar's statement details a meeting between Lt Col Purohit and Pragya Thakur in Nashik in 2007. It also accuses Lt Col Purohit of misusing Abhinav Bharat's name to raise funds.

Top criminal lawyer Majid Memon called the disappearance of the documents shocking. He added that this appears as a deliberate attempt at weakening the case and helping the accused. "On the face of it, this cannot be accidental or a case of omission."

Bharat Mata with Stars and Stripes

The Bharat Mata which is hailed by the Hindutva forces will soon have to hold the Stars and Stripes in one hand while the other holds the Bhagwa Jhanda. Absent will be the tricolour.

The Modi government is seriously considering signing the Logistics Support Agreement (LSA), which will convert India into a military ally of the United States on par with countries like Pakistan, Philippines and South Korea. The LSA, which is another name for the Acquisition and Cross-Servicing Agreements (ACSA), will provide for the respective militaries to use each other’s base facilities for logistic support such as refueling and berthing facilities and to borrow specified “non lethal” defence equipment for use elsewhere. This would facilitate the United States using India’s air force and naval facilities for military operations against third countries.

If this agreement on the LSA is arrived at and the signal for which will be clear during the visit of Ashton Carter, the US Secretary for Defence, to India on April 10, it will be the biggest sell out of India’s strategic interests to the United States by the Modi government – an anti-national act without parallel.

The other aspect in the defence sphere is the speed with which the Modi government is fulfilling the other agenda of the US administration. The signing of the Indo-US nuclear deal was made contingent on the United States becoming the largest and major supplier of arms and defence equipment to India.

It is not only in the defence and strategic areas that the Modi government is proceeding to compromise sovereignty and Indian interests. The sell-out in the economic and trade sectors is equally pronounced. At the WTO ministerial meeting in Nairobi, the Union Commerce Minister, Nirmala Sitaraman, surrendered without any resistance India’s vital interests in getting a permanent solution for the public stock holding programme. Neither did India stand firm on Special Safeguard Mechanism (SSM) for protection against sudden surge in imports. The Modi government, thus, compromised on the issue of food security and the interests of farmers.

That this is not an isolated incident becomes clear from the ongoing negotiations between India and the European Union for the Broadbased Trade and Investment Agreement (BTIA). Here too, there are two major issues concerning investment rights and reduction of tariffs on agricultural imports which can have serious repercussions for India. An investor-state dispute settlement agreement will lead to foreign firms taking the Indian government to an International Tribunal if their investments and profits are endanger by any policy measure. Similarly, the agenda on lowering of import tariffs for agricultural goods from Europe to India is something which can spell ruin for agriculture and the dairy industry. The Modi government has given up on all vital issues concerning government procurement, agricultural tariffs and intellectual property rights which are harmful for the people and national interests of India.

The Modi government has surrendered to US pressure on intellectual property rights in particular about patent rights for medicines. The Patent Law provides for compulsory licensing, a clause which allows Indian companies to break the monopoly of MNCs. It is now reported by the US-India Business Council that the Indian government has “privately assured” the US based drug MNCs that it would not use compulsory licenses for commercial purposes. Thus the only way to bring down the monopoly prices imposed by drug MNCs has been given up.

This is also mirrored in the offer to include education in the General Agreement on Trade and Services (GATS) and the recent decision to allow 100 per cent FDI in e-commerce retail which is a betrayal of the BJP’s own pledge not to allow FDI in retail trade.

The Modi government has taken another dangerous step in moving for an amendment to the Foreign Contribution Regulation Act. This amendment has been proposed in the Finance Bill whereby the definition of a foreign company is being revised. As per this amendment, any company which conforms to the foreign investment limit prescribed by the government will be treated as an Indian company. This amendment is being done to circumvent the verdict of the Delhi High Court which had found both the BJP and the Congress guilty of receiving foreign funds from a London-based multinational company, Vedanta.

If this amendment goes through in Parliament, then the BJP can happily receive crores of rupees from foreign companies operating in India. This will bring about a major transformation in the nature of political party funding with all its consequences for the democratic political system.

BJP Nadiad Councillor sentenced to life imprisonment along with 13 others

A local court on Monday, sentenced sitting BJP Councillor of the Nadiad Nagarpalika, Bhanu Bharwad to life imprisonment in a 2002 case of abduction and ransom. Bharwad was sentenced to life imprisonment along with 13 others and asked to pay a fine of Rs 1 lakh each. Four others in the case were sentenced to six months imprisonment.

The incident dates back to July 8, 2002, when Bharwad was booked in a case of abduction and extortion by the Nadiad city police, along with 13 others. At that time, he was not a councillor but has had two terms since.

The complainant, Usman Ghani Adam Vohra had a fall out with his business partner, Shahed Natubhai, allegedly over the accounts of the year 2001. After a civil suit resulted in an arbitration, the partners had agreed that Vohra would pay Rs 65 lakhs to Natubhai.

However, as he failed to pay the sum until 2002, four of Natubhai's employees, who had the power of attorney to administer his business, allegedly contracted Bharwad and 13 others to abduct and threaten Vohra to pay up the sum.

The 13 others convicted for life, include, Navdhan Bharwad, Bhanu Ufa, Mafat Bharwad, Mafat Bhura, Sajan Bharwad, Chandrakant Sharma, Ratna Bharwad, Hasu Bharwad, Manu Rabari, Kiritsinh Gohil, Anilkumar Darbar, Gaurangkumar Pandya and Pappu Premnath Sharma.

The accused were booked for kidnapping or abduction in order to murder, wrongful confinement, rioting armed with deadly weapon, criminal intimidation and criminal trespass under IPC sections 147, 148, 364 (A), 120 (B), 507 (2), 342 and 447. Bharwad was also booked under PASA in the same year.

According to Public Prosecutor Paresh Dhora, the four employees Dashrath Patel, Manu Patel, Ambalal Patel and Dilip Joshi alias Labhshankar had contacted Bharwad to threaten Vohra. Accordingly, Vohra was abducted in a sports vehicle (GJ 7 R 9639) on July 8 2002 an then exchanged with another set of accused. He was then taken in a tempo into the fields outside Nadiad, where he was assaulted and kept in confinement.

The convicts also made a ransom call to his family demanding Rs 65 lakhs. Dhora said, "The police investigation could not establish if Natubhai himself had a role in the entire conspiracy but his four employees were booked, tried and convicted by the court to six months imprisonment."

In its judgement on Monday, the third additional judge of Nadiad Sessions Court, HB Raval sentenced the 14 accused to life imprisonment and also slapped a fine of Rs 1 lakh each. In addition, the court also sentenced the accused to a concurrent rigorous imprisonment of two years and an additional fine of Rs 10,000.

A zero for Modi on diplomacy

Modi govt’s diplomatic energy has been expended on making forays into enhancing spirit of ties with US, Pakistan and China in personalised manner.

The past 10 days have cruelly exposed the foreign policy pretensions of the Modi government as deep embarrassment has simultaneously been caused to India from three crucial quarters: Pakistan and China in our immediate neighbourhood operating in tandem, and internationally the United States.

The direction in which Mr Modi wishes to travel to elevate India’s status in the world is thus clear. We must, of course, ask ourselves if the status of a “leading power”, let alone a “global power” or “great power” such as the US, China or the European Union, is achievable for a country mired in disquieting poverty for close to one half of its population, and burdened with a savings deficit to fuel the greatly enhanced investments required to maintain a place on the high growth path.

At the same time, India is having to endure on a sustained basis a worsening social climate on account of religious neo-imperialism being sought to be pushed by the Hindutva brigade indulged by the regime. Domestic peace and harmony, it can’t be emphasised enough, is as great a requirement for achieving prominence and weight in the international system as accretion to economic wealth and development of military might for purposes of power projection.

In any case, strategies being pursued by this government to raise India’s position in the world — by dovetailing our strategic and security preferences to the overarching US “vision”, especially for the Indo-Pacific region, — have not been brought to the forum of Parliament for discussion, although it is possible that they have been gone over in the counsels of the RSS and the Sangh Parivar, of which the ruling BJP is an element.

India has not before been known for a tail-between-the-legs attitude towards a great power.

After the triple rebuff of recent days, one truly wonders. The much maligned Dr Singh was at no stage in his 10 years in office humiliated by Washington, Islamabad and Beijing in quick order within a space of less than 10 days. Is it Mr Modi who is being strong-armed, or is it India?

MUMBAI: The CBI court dropped charges against senior Gujarat police officer Geeta Johri after it found that the CBI had not taken mandatory sanction from the state government before chargesheeting her in the fake encounter case.

The court discharged senior police officer in a case where she was allegedly manipulating investigation of three fake encounters in Gujarat. The court discharged Geeta Johri as the CBI had not taken mandatory sanction from state government before chargesheeting her. The CBI said that in serious cases sanctions are not required. Responding over the dropping of charges against Geeta Johri, the victims' family said that they were shocked with one after another discharges in the case.

Pandey is currently out on bail: Ishrat case accused takes over as Gujarat police chief

A day after P C Thakur was shifted to Delhi on the Central government’s orders, Director General of Police (DGP) Prithvi Pal Pandey took additional charge as the Gujarat Police chief in Gandhinagar on Saturday.

Pandey is the senior-most IPS officer of Gujarat cadre. Out on bail in the Ishrat Jahan encounter case, he was also the senior-most officer who was chargesheeted in the case.

The 1980 batch IPS, Pandey was arrested in July 2013 in the Ishrat encounter case. Pandey remained in jail for nearly 19 months till he was released in February, 2015. His passport is still in the custody of special CBI court which he has recently sought back, citing plans to travel abroad.

Pandey was reinstated after the bail in the Ishrat case and was promoted to the Director General of Police (DGP) last year. Currently, he is posted as Director, Anti-Corruption Bureau (ACB).

A close aide of Pandey said that “the charge of police chief has come as a surprise. We never thought he was in the race due to the Ishrat case. This is the best he could have got in view of the serious allegations in the case.”

Pandey, along with IPS officers G L Singhal, N K Amin, retired IPS D G Vanzara and three other policemen, was chargesheeted for conspiracy, murder and kidnapping of 19-year-old Mumbai girl Ishrat Jahan, her friend Javed Sheikh alias Pranesh Pillai and two alleged Pakistani nationals. The case is at present pending before a local court.

The Maharashtra police's Anti Terrorist Squad, which investigated the case before it was handed over to NIA in 2011, arrested a dozen-odd accused, including self-styled Sadhvi Pragya Singh Thakur and serving Indian Army officer Lt Col Srikant Purohit. Both worked for Hindu radical group Abhinav Bharat.

Top NIA officials, including DIG Abhin Modak, all through Wednesday did not respond to calls and text messages and an agency spokesman said he had no comment to offer on the matter.

Among the witness statements gone missing is that of Dharmendra Bairagi, a close aid of Ramji Kalsangra, a key accused in the case who is absconding. Bairagi, in his statement recorded before a magistrate, had said that he was witness to a meeting between Kalsangra and Pragya Thakur in Ujjain just months before the 2008 blasts. He had also said he had heard the two discussing a plan to engineer blasts.

Another key statement that is missing is that of the founder of Abhinav Bharat Hemani Savarkar. Savarkar's statement details a meeting between Lt Col Purohit and Pragya Thakur in Nashik in 2007. It also accuses Lt Col Purohit of misusing Abhinav Bharat's name to raise funds.

Top criminal lawyer Majid Memon called the disappearance of the documents shocking. He added that this appears as a deliberate attempt at weakening the case and helping the accused. "On the face of it, this cannot be accidental or a case of omission."

As NIA does a U-turn on Malegaon blast case, accused Muslim men plunge back into helplessness

The National Investigation Agency maintains that Hindu extremists were behind the blasts, but it has refused to withdraw cases against nine Muslim accused.

In 2014, the NIA had asserted in special court in Mumbai that there was no evidence linking the nine Muslim accused to the September 8, 2006 blasts that killed 37 people in Malegaon. Instead, the Agency had implicated members of the Hindutva extremist group Bajrang Dal in the case. In July 2015, Sharad Kumar, the director general of NIA, told the Economic Times that when the agency investigated the case, it found the Muslim accused were "innocent". This Tuesday, even while maintaining this stance about its own investigations, the NIA refused to discharge the terror charges against the nine Muslim men.

Of the nine men who were arrested in 2006 and released on bail in 2011, two have already died. The rest have been left feeling helpless and clueless about their fate, as the tag of “terror accused” continues to dangle over their heads. For now, they have their hopes pinned on the special court’s verdict scheduled for April 25.

‘We sensed something fishy’

Farogh Anwar Magdumi, an Unani doctor in Malegaon and one of the nine Muslim accused, says he sensed a danger to their fate soon after NIA prosecutor Rohini Salian claimed, in 2015, that she was under pressure to “go soft” on the Hindu accused in the Malegaon blasts case.

“I believe there is definite political interference in this case. Ever since Salian stopped representing us, the NIA has not taken a clear cut stand on whether the charges against us should be withdrawn,” said Magdumi, speaking to Scroll from Malegaon soon after Thursday evening prayers.

“The NIA is the only agency that has prosecution rights in this case. But we’ve seen that the prosecutor representing the Maharashtra ATS is always present in the court even now, when he has no legal right to interfere,” he said. “We just sensed that there is something fishy going on.”

Magdumi, the son of a retired school principal and father of two, was arrested after the blasts on charges of being a member of the banned Students Islamic Movement of India. He describes the past 10 years of his life as painful and full of sorrow. “When I was in jail, my family had to survive on my father’s meagre pension,” he said.

Although Magdumi was able to renew his private clinic practice as a Unani doctor after getting out on bail, work has not been the same. “I have to leave work and lose income every time I have to visit Mumbai and attend court hearings. I am used to such pain and hardship because of my jail experience, but now that the state of Maharashtra is clearly against us, I feel rather helpless.”

‘We are innocent, should not have suffered’

Noorul Huda Shamsuddoha comes from a different socio-economic background from Magdumi, but his ordeal has been similar. Accused of planting one of the bombs and allegedly belonging to SIMI, Shamsuddoha says he faced third degree torture for 48 days at a stretch when he was arrested in 2006. He works as a labourer folding clothes at a powerloom factory, but often feels weak even for such work.

“Five years in prison have taken their toll on my body, and I often have to miss work because of court hearings,” said Shamsuddoha, who makes between Rs 1,200 and 1,500 a week to support his wife and two babies. “I spent my jail time fruitfully, completing my BA degree and teaching Urdu to other inmates. But all nine of us are completely innocent and should not have had to suffer so much.”

Shamsuddoha claims he began to lose faith in the NIA when he saw the Agency’s prosecutors mingling with counsels of the ATS and defence lawyers of the Hindu accused in court. “How can both groups be considered accused at the same time? Something definitely felt wrong,” he said.

As they wait for the decisive April 25 hearing, Magdumi, Shamsuddoha and the five other accused draw strength from the fact that at least in Malegaon, they have public support. “All of Malegaon believes in us and supports us,” said Shamsuddoha. “Now all we can do is pray to Allah to take this case off our backs.”

For decades now, the Sangh driven BJP has blatantly challenged the Rule of Law with Election Campaign(s) that are Polarising and Divisive, especially in Uttar Pradesh (UP)

Over the past few days, in 2016, Uttar Pradesh, the state that signals the political fortunes for the country, was agog with yet another potentially divisive controversy stoked by the Sangh-inspired Bharatiya Janata Party (BJP).

A Poster of UP BJP Chief, Keshav Maurya as Lord Krishna was spotted in many parts of UP; it uses, yet again, religious symbols as a start up to its campaign ten months before the state elections due anytime before February 2017, signalling the beginning of a campaign that will bank on polarising the voter on religious lines.

This poster, that was spotted in Varanasi, prime minister Modi’s constituency, depicts UP BJP president Keshav Prasad Maurya –a man with reportedly several criminal cases pending against him -- as ‘Lord Krishna’ and other politicians including Chief Minister Akhilesh Yadav as ‘Kauravas’. Such imagery blatantly violates the law on mis-using religion for political gain. The election law, Section 123a of the Representation of People’s Act becomes effective once an election is announced; so chances are that we shall see more of the same provocative electioneering as dates for the crucial state elections draw near.

This peculiar brand of politics and campaigning has been, for several decades now, BJP and the Sangh’s USP (unique selling point). Gujarat or Delhi, Maharashtra, Assam or Kerala, its singular success has been the defiance of Indian law to galvanise votes on religious lines.

Ten years ago, in the run up to the UP elections of 2007, the party had been severely reprimanded by the Election Commission of India (ECI) that had even directed that an FIR be filed against senior BJP leaders, for a CD containing targeted hate mongering released by the BJP's state unit at the instance of the central leadership. The Election Commission at the time had directed the filing of an FIR against senior Bharatiya Janata Party leaders -- Lalji Tandon and others -- involved in the production of the controversial party election CD allegedly making a reference to Babri and Godhra train arson of 2002. The CD had been officially released and widely circulated.

The contents of the CD brazenly released by the BJP's state unit -- that claimed it had got the clearance of the central leadership -- were found to be so offensive that independent citizens groups as well as political parties had appealed to the EC to de-recognise the BJP. The Commission had issued a show-cause notice to the BJP on the matter.

The controversial CD was first released at the party's national council session in December 2006

The fact is that this "official CD" was also found to be offensive and anyone seeing it — as this reporter (The Hindu, Neena Vyas) has — would note that it is calculated to create hatred as it shows Muslims slaughtering a cow in a gruesome and primitive manner. This "official" CD also has footage on Hindu girls eloping or being abducted by Muslim youth with a voiceover saying that Muslim clerics encouraged this.

The Hindu had, on April 7, 2007 passed strong editorial comments on the comments of the CD, under the heading, " Playing foul" The editorial had read:

“That a mainstream party, the BJP, revels in Muslim-bashing is not the best-kept of India's political secrets. The campaign of vitriol gets particularly nasty at election time — for obvious reasons. Since the party's raison d'etre as well as life force is communalism as a political mobilisation plank, its electoral strategy can only be pitting India's overwhelming Hindu majority against its 150 million Muslim minority...
"… the BJP has got away, time and again, with inciting communal passions. A dispassionate analysis reveals that the major milestones on its post-1984 road to power have been communal campaigns revolving round the project of demolishing the Babri Masjid and building a Ram temple on its grave, and exploiting anti-Muslim pogroms, most notoriously in Gujarat… This time with evidence in hand, the Election Commission has shown commendable seriousness in moving against the offenders… A lot rides on how the ECI handles this case and how the BJP responds to the challenge.

So here is my experience working with PM Modi.

As i am working with one of the ministries, I prefer to be anonymous otherwise may be i can lose my job. As working in coal ministry for more than 15 year, this is the difference i feel very dramatically.

Time schedule: we have thumb impression machine that note down in time and out time during the day.
No more late meetings: To my utter surprise, when our ministry had first meeting with Mr. Modi, he on time for meeting. Even our minister and some officers were not present in meeting on that time, as they are used to come late for meetings. He actually started meeting and conclude on time frame giving initially. He was well informed about our department than our own minister.
No nonsense: In all meeting i observed him taking notes, and than in next meeting he ask for progress about work discussed in last meeting
Work culture change: As we used to work in govt job mode, we have to change it. It’s not about how hard you work, it’s about how smartly you work.
Personal notes to employee: I had my son birthday few days back. I stuck with some urgent work in office and i fell very frustrated about it and shout to my juniors during the meeting with PM. Next day to my total surprise my son received a greeting card hand written by PM himself, to say birthday wishes and sorry about my engagement on work on his special day. And yes i got one day off to make it for my son.
work load: We have alot of work load now as present govt is more result oriented. Sometime it’s difficult to even get week end off, which i will really want to change.

Ishrat Jahan fake encounter accused: Where are they now?

Days before the Gujarat government prematurely moved out its police chief DGP PC Thakur, Prithvi Pal Pandey, the senior most DGP after him who replace him as the in-charge DGP, was at the Gandhinagar town hall among those rolling out the red carpet for DG Vanzara, the retired IPS officer, accused in the fake encounter cases. They were celebrating his return from Mumbai, after his bail conditions were relaxed.

This was on April 8. DGP Pandey, Vanzara's co-accused in the Ishrat Jahan fake encounter case described him as a “Rajashri” (king turned sage) and spoke for 20-minutes in his praise to a crowd mostly from the Vanzara community, and retired or in-service policemen. He described the day as “Vijay Dashmi” and said, “The time to win over all demonic forces which tried to trouble Gujarat, has already begun a long time ago but today is the day when it will actually start.”

Seven days later, Pandey was appointed the in-charge DGP replacing Thakur, contrary to the strong buzz that the government was keen to appoint Gujarat's first woman IPS officer Geetha Johri as the full-time police chief. She was promoted to DGP after being discharged in the Sohrabuddin Sheikh fake encounter case. This is probably a first in Gujarat when a top police officer facing a murder charge and out on bail, is also the part-time police chief.

Pandey is not the only accused in the 2004, Ishrat Jahan fake encounter case to be rehabilitated. Over the past two years, since the investigation hit a dead end, all the accused in the case are out on bail.

Before Pandey the state government had promoted IPS officer G L Singhal to Deputy Inspector General of Police and posted him as Commandant at Police Training Academy, Karai in Gandhinagar. His junior IPS officer N K Amin was recently transferred to Mahisagar district a Superintendent of Police.

Earlier this year the special CBI court allowed Amin to renew his passport as well while Pandey and Singhal have requested the court to return their passports so that they may travel abroad. They had to deposit their passports as a condition for their bail.

On the other hand, Satish Verma, the IPS officer who helped crack the Ishrat Jahan encounter case has been denied promotion and is currently on deputation to Shillong in the North-Eastern Electric Power Corporation.

He is also facing a probe in an encounter case of 1997, reopened on directions of the Gujarat High Court following a petition filed in 2013.

Two of the accused in the Ishrat case, Tarun Barot and J G Parmar have retired as Deputy Superintendent of Police while Anaju Chaudhary is serving as a head constable in State Reserve Police (SRP).

Apart from the Gujarat policemen, the CBI has also chargesheeted four officials of Intelligence Bureau in 2014. The senior most accused IPS Rajinder Kumar has retired as special director while three others T Mittal, Rajiv Wankhede and MK Sinha continue to work as intelligence officers with Subsidiary Intelligence Bureau (SIB), Ahmedabad.

Even after completion of investigation by CBI in February 2014 when it filed the second chargesheet against IB officials, the trial has yet to start. The reason is largely attributed to CBI's failure to receive the Home Ministry’s sanction to prosecute the officers. The accused officers, while seeking relief from the case, have cited how “the second chargesheet remains only a document with no legal value.”

Farogh Anwar Magdumi, an Unani doctor in Malegaon and one of the nine Muslim accused, says he sensed a danger to their fate soon after NIA prosecutor Rohini Salian claimed, in 2015, that she was under pressure to “go soft” on the Hindu accused in the Malegaon blasts case.

“I believe there is definite political interference in this case. Ever since Salian stopped representing us, the NIA has not taken a clear cut stand on whether the charges against us should be withdrawn,” said Magdumi, speaking to Scroll from Malegaon soon after Thursday evening prayers.

“The NIA is the only agency that has prosecution rights in this case. But we’ve seen that the prosecutor representing the Maharashtra ATS is always present in the court even now, when he has no legal right to interfere,” he said. “We just sensed that there is something fishy going on.”

Magdumi, the son of a retired school principal and father of two, was arrested after the blasts on charges of being a member of the banned Students Islamic Movement of India. He describes the past 10 years of his life as painful and full of sorrow. “When I was in jail, my family had to survive on my father’s meagre pension,” he said.

Although Magdumi was able to renew his private clinic practice as a Unani doctor after getting out on bail, work has not been the same. “I have to leave work and lose income every time I have to visit Mumbai and attend court hearings. I am used to such pain and hardship because of my jail experience, but now that the state of Maharashtra is clearly against us, I feel rather helpless.”

‘We are innocent, should not have suffered’

Noorul Huda Shamsuddoha comes from a different socio-economic background from Magdumi, but his ordeal has been similar. Accused of planting one of the bombs and allegedly belonging to SIMI, Shamsuddoha says he faced third degree torture for 48 days at a stretch when he was arrested in 2006. He works as a labourer folding clothes at a powerloom factory, but often feels weak even for such work.

“Five years in prison have taken their toll on my body, and I often have to miss work because of court hearings,” said Shamsuddoha, who makes between Rs 1,200 and 1,500 a week to support his wife and two babies. “I spent my jail time fruitfully, completing my BA degree and teaching Urdu to other inmates. But all nine of us are completely innocent and should not have had to suffer so much.”

Shamsuddoha claims he began to lose faith in the NIA when he saw the Agency’s prosecutors mingling with counsels of the ATS and defence lawyers of the Hindu accused in court. “How can both groups be considered accused at the same time? Something definitely felt wrong,” he said.

As they wait for the decisive April 25 hearing, Magdumi, Shamsuddoha and the five other accused draw strength from the fact that at least in Malegaon, they have public support. “All of Malegaon believes in us and supports us,” said Shamsuddoha. “Now all we can do is pray to Allah to take this case off our backs.”

Here is the evidence against Purohit in Samjhauta blasts

Even at a time when the strong evidence exists and the custodial interrogation of Col. Shrikant Purohit is pending, National Investigation Agency (NIA) has declared he is not involved in Samjhauta blast case.

“There is no proof against him in Samjhauta blast case. He was never an accused. I wonder why his name is being linked to Samjhauta blast case,” NIA Director General Sharad Kumar said on Tuesday.

When this news was taken over by all media, the central government was quick to shrug its shoulder and said it is not pressurizing NIA.

However, one would wonder why NIA is in a hurry to absolve Purohit from Samjhauta case although NIA has not conducted Purohit’s custodial interrogation and that there are strong evidences against him implicating in Malegaon, Ajmer and Samjhauta blasts cases.

If we scrutinize the charge sheet submitted by Maharashtra ATS in Malegaon 2008 blasts case, we find statements of many witnesses establishing guilt of Purohit and others that they were conspiring to explode bombs at many places in India and were hell bent to pursue agenda of creation of Hindu Rashtra. The names of witnesses are withheld as per sections of MCOC Act.

In the charge sheet, Witness no. 55 (Vol. III-A, Page 281 to 286, Compilation Page No. 183 to 188) a friend of Purohit stated – In the year 2007 he had visited the house of Purohit at Nasik, and Purohit had shown him a green colour sack (bag) containing RDX kept in his wooden cupboard. And at that time Purohit had told him that some part of the RDX was given to Bhagwan to cause a blast in Samjhauta Express. And that the said Bhagwan, presently has become a Sadhu by renouncing the world (referring to the blast which had occurred in Samjhauta Express train running from Delhi to Wagha border at LOC).

This statement of witness clearly implicates Purohit in Samjhauta Express blast occurred on February 18, 2007 killing 68 people and causing injuries to 12 train passengers including women and children travelling in the train.

This was not a simple statement but it was recorded by ATS under section 164 of Criminal Code before Metropolitan Magistrate. The statement of a witness u/s 164 is considered as a strong piece of evidence and the witness cannot change this statement even during trial. There are many Supreme Court judgments where the culprits are sentenced only on the basis of such 164 statement of a witness.

In addition to this another witness number 51 (Vol. III-A, Page 251 to 258, Compilation Page No. 125 to 132), a member of Abhinav Bharat organization stated – In one of the meeting held in Faridabad Purohit was talking on phone with somebody and thereafter he told another accused Sudhakar Dhar Dwivedi @ Swami Dayanand Pandey that their men were successful in accomplishing the mission at Ajmer (referring to the Ajmer blast).

This statement of witness links Purohit to Ajmer Dargah blasts that had taken place on October 11, 2007 leaving 3 dead and many injured.

Moreover, NIA’s plea for custody of the three main accused in the Malegaon blasts viz. Lt Col Shrikant Prasad Purohit, Sudhakar Udaybhan Dwivedi alias Dayanand Pandey and Major (retd) Ramesh Upadhyaya is pending before Supreme Court since November 2011.

Therefore, in the presence of such a strong statement of witness and pending custodial interrogation of Purohit, NIA’s clean chit to Purohit in Samjhauta blast case is highly deplorable.

Religious tolerance in India deteriorated in 2015: USCIRF report

Washington, May 3(ANI): The United States Commission on International Religious Freedom (USCIRF) in its latest report has said that religious tolerance in India deteriorated in 2015, and that the religious freedom of minorities was violated by Hindu nationalist groups, ' tacitly supported' by members of ruling Bharatiya Janata Party.

" In 2015, religious tolerance deteriorated and religious freedom violations increased in India. Minority communities, especially Christians, Muslims, and Sikhs, experienced numerous incidents of intimidation, harassment, and violence, largely at the hands of Hindu nationalist groups," the report said.

" Members of the ruling Bharatiya Janata Party (BJP) tacitly supported these groups and used religiously-divisive language to further inflame tensions. These issues, combined with longstanding problems of police bias and judicial inadequacies, have created a pervasive climate of impunity, where religious minority communities feel increasingly insecure, with no recourse when religiously-motivated crimes occur," the report said.

USCIRF, a bipartisan US federal government commission that makes policy recommendation to the US President, the Secretary of State, and the Congress also mentioned top BJP faces including party president Amit Shah and Yogi Adityanath and Sakshi Maharaj in its report.

The report comes down heavily on the current dispensation and its Sangh allies for 'numerous incidents of intimidation, harassment and violence' experienced by Minority communities, especially Christians, Muslims, and Sikhs.

According to reports, the USCIRF was behind the U.S. government's decision to revoke Narendra Modi's tourist visa in 2005, then Chief Minister of Gujarat, three years after religious violence consumed the state.

The watchdog body since 2012, has placed India amongst Tier 2 countries.

The report added that India is on a negative trajectory in terms of religious freedom.

The USCIRF has recommended that US should integrate concern for religious freedom into bilateral contacts with India.

It has also urged Modi-led government to publicly rebuke government officials and religious leaders that make derogatory statements about religious communities. (ANI)

Gujarat Model: Land Grab in the Name of Land Acquisition

Farmers, homeowners, landed, landless, urban, rural, large sections of Gujarat’s urban and rural marginalised populations are likely to be victims of land grab if Presidential assent is given to the Bill


What the Modi government failed to do in early 2015, bring in a fresh law that in the name of making ‘land acquisition’ easier actually snatched away the original owner –be it the peasant, small farmer or tenants –right to have a say in whether or not the land should be acquired—the Gujarat Government, known for its infamous ‘Gujarat Model’ under Narendra Modi is attempting to do through the “Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Gujarat Amendment) Bill, 2016” (RFCTLARR, 2016), just recently passed, in the Assembly.

On April 1, 2016, deliberately on a day when the Opposition had been suspended from the House, the Government of Gujarat (GOG), passed the “Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Gujarat Amendment) Bill, 2016”. The amendments were cleverly introduced in the Assembly on a day when the opposition had been suspended from the House. There was therefore practically no discussion or debate on the proposed amendments in the Assembly. It is a mockery of democracy that such a crucial Bill is introduced on a day that the opposition is absent in the House, and the legislation passed without debate.

This Bill, if it gets the required assent, snatches away the right of the cultivator to have his or her say on whether or not their land can be acquired. This Bill also snatches away the social audit process and consent clauses painstakingly put in by the UPA Government’s Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (LARR 2013).

The Modi government, flush with a sweeping electoral victory in May 2014 had, in what was seen to be the direct influence of crony capitalists, sought to overturn the 2013 law. The amendments in the Bill are a clear statement of the intentions of the government about its priorities and its leanings, if any are required. After 2013, certain industrialists and a particular corporate lobby seen to be close to the Modi government had made it clear that it was ‘impatient and dissatisfied’ with the LARR 2013 and that it needed action, and fast.

Farmers and others dependent on land, who were the drivers of the changed law of 2013 (under UPA II at the Centre), do not even find a mention in the ‘Statement of Objects and Reasons’ (of the Gujarat 2016 Bill).

Clearly, the moves of the Modi government to ignore India’s peasantry and decaying agrarian sector and push, an unhealthy culture of land grab that can benefit the rich few have simply changed track, not been abandoned. This poses a fresh and new challenge to the political opposition and people’s movements all over the country.

Corporate houses owe Rs 5 lakh crore to banks, claims JD(U) member

Corporate houses owe about Rs 5 lakh crore to PSU banks, a JD(U) member said in Rajya Sabha on Thursday and particularly referred to the Adani Group, alleging that the company got “unimaginable” favours and its debt stands at Rs 72,000 crore.

Raising the issue during Zero Hour, Pawan Verma contended that PSU banks are influenced to give loan to the people who are not able to repay them.

“PSU banks are owed about Rs 5 lakh crore by corporate houses and of this roughly Rs 1.4 lakh crore are owed by just five companies, which include Lanco, GVK, Suzlon Energy, Hindustan Construction Company and a certain company called the Adani Group and Adani Power,” he said.

The amount owed by this group “called the Adani Group” both in terms of its long term and short term debt on Thursday is around Rs 72,000 crore, he added quoting reports.

“Yesterday it was mentioned that the entire amount that the farmers need to pay as crop loans is Rs 72,000 crore. The Adani Group itself owes to the banks Rs 72,000 crore,” he said.

“I don’t know what the relationship is of this government with this business house. I don’t even know if they know them, but the owner of this group (Gautam) Adani is seen everywhere the Prime Minister has gone, every country China, the UK, the US, Europe, Japan,” the JD(U) member said.


“This company has been given favours which are unimaginable. In Gujarat, their SEZ was approved inspite of the High Court strictures,” Mr. Verma member said.

Deputy Chairman P J Kurien warned Verma against making allegations.

To this, Verma said: “I am giving you factual account. It is a High Court judgement. It was left to state government.

The UPA government had not approved it and when this government came to power it was approved.”

The JD(U) member said it does not matter if Adani Group has the ability to pay this amount, but in the last 2—3 years, the company’s net worth has gone up by 85 per cent.

“But, economic analysts say that the ability of the company to keep paying the interest on its debt has come down dramatically during the course of the financial year and budget credit/brokerage credit ... ranks Adani Group as the fourth most burdened house of India in business,” he added.

Inspite of this and knowing the crisis of Vijay Mallya, a loan of USD 1 billion was given by the State Bank of India to this very group after this government came to power, Mr. Verma claimed.

“I want a reply from the government are they aware of this or are they not. And if they are ware what are they doing in this matter. One company owes as much as all the farmers of India.

Target Hindu leaders seen to have had a role in the Gujarat 2002 riots and those perceived as "anti-Muslim" and get good money and jobs in South Africa: this was a line Dawood Ibrahim's D-Company used to lure recruits to execute its plan to create communal tension in India. TOI had reported on May 6 that Dawood plotted social unrest to upset the Modi government
The National Investigation Agency chargesheet in an Ahmedabad court against 10 D-Company men accuses them of being part of a "larger conspiracy" to attack Hindu leaders that led to the gunning down of former BJP chief of Bharuch Shirish Bangali and BJP youth wing leader Pragnesh Mistry last year.
The D-Company bosses, NIA says, also asked its recruits in India to throw petrol bombs made in empty liquor bottles and indulge in arson in churches. The motive, NIA sources say, was to create communal tension.
In its chargesheet, details of which were exclusively accessed by TOI, NIA has stated, "D-Company, through Javed Chikna planned to target BJP, RSS, VHP and Bajrang Dal leaders..."
For carrying out the attacks, Rs 50 lakh was sent to Gujarat from Dubai through hawala channels by Javed Chikna while guns were also arranged by him in Mumbai and Surat through his contacts in India. For the first killings - of Mistry and Bangali - accused were paid Rs 5 lakh out of this money.
The accused are: Abid Patel (brother of Dawood's close aide Javed Patel alias Chikna who is based in Pakistan), Saiyed Imran, Zuheb Ansari, Inayat Patel, Mohmad Yunus, Haider Ali, Nissarbhai Sheikh, Mohsin Khan Pathan, Mohmed Altaf Shaikh and Abdul Salim Ghanchi.
"As part of the plan, Javed Chikna (based in Pakistan) and another senior member of D-Company (based in South Africa) Zahid Miyan alias Jao contacted several of their men, including Chikna's brother Abid Patel and Yunus (also called Manjrao), and asked them to prepare a list of such leaders," NIA says. A list of 15 such leaders, mostly local, had already been prepared.
NIA says that the accused persons who had hatred against such Hindu leaders had been identified on the basis of their religion and "they were offered handsome money and jobs in South Africa".
When Abid realised that he is likely to be arrested soon, he tried to flee to England but he couldn't do so. "He, then, fled to Nepal along with his close friend Salim Ghanchi by road," said an NIA officer
Abid, while in Nepal, contacted his brother Chikna in Pakistan who tried to get him out of Nepal but they didn't succeed. Abid and Ghanchi were later arrested on the Indo-Nepal border. NIA has already issued red corner notices against Chikna and Jao.

PM Modi lied to people about his BA degree, alleges Arvind Kejriwal

Chief Minister Arvind Kejriwal Friday claimed the Delhi University’s (DU’s) records showed that Prime Minister Narendra Modi had never enrolled in the university, contradicting the PM’s claim that he obtained his Bachelor of Arts (BA) degree from DU.

Accusing the Congress and the BJP of being part of a mutually beneficial “pact”, Kejriwal said, “... BJP is cursing Soniaji (Gandhi) but not arresting her. Congress is not questioning the PM’s degree. BJP and Congress are holding dharnas against each other. Is this country foolish? Dono mein badi achchi setting hai (They have a very good pact).”

“It emerges that he has done neither a BA nor an MA. Both degrees are fake. Firstly, he lied to the entire country, secondly, he lied in an affidavit and thirdly, the degrees are forged. This is a case of cheating. If the PM is accused of cheating under (IPC section) 420, this is a serious matter,” he added.

In his affidavit for the 2014 Lok Sabha elections, Modi had stated that he received a BA degree from DU in 1978 and a MA degree from Gujarat University.

Meanwhile, Kejriwal Friday claimed that a different person, also named Narendra Modi, had been a student of DU in 1975.

“With great responsibility, I started talking about this day before yesterday. In DU, there is neither an enrollment form nor is his (Modi’s) name in the register. He has not obtained a degree. His name is not even in the school of open learning. His name is nowhere. After all the probing, we found one Narendra Modi who had taken admission in 1975. He was from Alwar. His date of birth is 1958 while the Prime Minister’s date of birth is 1950. He is a completely different Narendra Modi,” said the chief minister.

“The issue is not about how educated he is. Even if he was Class X or Class XII pass, we would have accepted it... people gave him a lot of votes, they reposed their faith in him. We respect that faith and that mandate. But there are things that point towards cheating,” he added.

On how AAP managed to access DU’s records, Kejriwal claimed the party had volunteers in various DU departments who had carried out an “investigation” into the matter and procured copies of various documents.

The inability of a poor farmer to repay a loan installment of few thousand, often ends in suicide , particularly in Marathawada, the heart of RSS rule. But a major Corporate cannot pay a debt of 72000 crores, and yet he flies everywhere with the Prime Minister of India.

The KG (aseous) balloon: The end of the Modi dream?

Power corrupts, and absolute power corrupts absolutely. This is precisely what has happened to Prime Minister Narendra Modi. In his quest for absolute power, he has systematically laid the foundations of an authoritarian state by undermining every single leader within the BJP, and by ruthlessly crushing any dissent. That is why India has been witness to the dastardly “suppression by stealth” of the media, civil society, academics, students, and obviously the political opposition. Concurrently, he has undertaken a Gobblesian propaganda campaign to obfuscate/embellish his past and present, presumably to establish himself as the greatest saint politician India has ever seen (purer than even Mahatma Gandhi).

One such sordid tale that this Gobblesian campaign seeks to suppress is the Krishna Godavari-Basin (KG-Basin) scam. In 2005, then CM Modi abruptly announced that the Gujarat State Petroleum Corporation (GSPC) had discovered 20 trillion cubic feet of gas in KG basin (that the BJP promptly renamed the Deendayal West area block), which would generate revenue worth Rs. 2.2 lakh crore for India! Everyone (including the state and central administrations as well as subject experts) was astonished at this fantastic claim. If true, such a find would have made India energy self-sufficient, a must for any country aspiring for super power status. Modi’s announcement therefore generated euphoric excitement and even shifted the narrative from him being the alleged mastermind of the 2002 riots to a potential Prime Ministerial candidate. In fact, given how events unfolded, it is abundantly clear that the announcement (like everything else PM Modi does) was just another exaggerated publicity stunt.

Four years after CM Modi made the announcement, GSPC’s “Field Development report” pointed out that less than 10 per cent of what was claimed was actually available and that it would be commercially unviable to drill for so little gas, or sell it at the prevailing market rate. Unfortunately for GSPC, they didn’t know (as India is painfully realising now) that Modiji pays heed exclusively to his own mann ki baat! He thus ignored the field report, and forced GSPC to go ahead with the project. Because of this, GSPC borrowed nearly Rs. 20,000 crores from 15 different public and private sector banks. And what does India have in return? Nothing! As of May 2016, GSPC’s KG Basin block has not even started commercial production. In fact, as per GSPC’s own annual reports, after 2005 its gas reserves have consistently declined.

But the issue is not just about Modiji’s gaseous exaggerations. It is also about diversion of public funds and corruption. After coercing GSPC to go ahead with drilling in KG basin, CM Modi forced it to partner with a company named Geo Global. Now here’s the interesting bit.

Geo Global was reportedly incorporated just six days before the agreement with GSPC! At the time of entering into the agreement with GSPC, Geo Global’s capital was reportedly a measly Rs. 3,200. A week after the agreement, its capital magically mushroomed to Rs. 10,000 crores!

Similarly, GSPC was reportedly forced to dole out contracts for complex extraction rigs and platforms to Tuff Drilling. Shockingly, Tuff Drilling’s promoter was primarily in the apparel business before landing GSPC’s contract and had no prior experience in gas extraction! Since then, CM Modi forced GSPC to disburse over Rs. 5000 crores to similar dubious companies!

Given that GSPC has not produced any gas from the KG-basin, where did the Rs. 20,000 crores vanish? Assuming Rs. 5,000 crores were spent on purchasing and setting up equipment (even if this went to dubious companies), that still leaves Rs. 15,000 crores! Was this public money diverted to fund Modi ji’s extravagant 2014 election campaign? Does this not merit an independent high level judicial probe? And even more interestingly, when the screws were tightened on Vijay Mallya for defaulting on Rs. 9000 crores, why is GSPC not being subject to similar treatment? Why is it that instead, its Managing Director was rewarded with an appointment as the Director of the National Informatics Centre?

However desperately the BJP may sycophantically defend PM Modi, the bitter reality is that under him, corruption was rampant in Gujarat. Consider how he gave 250 acres of land (in a restricted wildlife zone) to cronies of the current CM of Gujarat for less than Rs. 1.5 crores!

Similarly, as pratham sevak for his corporate friends, CM Modi gave public land for the Mundra SEZ, which was worth Rs. 1500 per square metre for a pittance (anything between Rs. 01 & Rs. 32)! That is why for years, the CAG was deliberately denied access to numerous files in Gujarat! And that is also why under Modi ji, a Lokayukta was not appointed for 10 years!


In his avatar as Prime Ministerial candidate, Modi ji had famously argued “main na khata hoon, na khaane deta hoon”. It seems the truth is that “wo khilate toh hain hi, shayad khate bhi hain"!

PM Modi lied to people about his BA degree, alleges Arvind Kejriwal

Chief Minister Arvind Kejriwal Friday claimed the Delhi University’s (DU’s) records showed that Prime Minister Narendra Modi had never enrolled in the university, contradicting the PM’s claim that he obtained his Bachelor of Arts (BA) degree from DU.

Accusing the Congress and the BJP of being part of a mutually beneficial “pact”, Kejriwal said, “... BJP is cursing Soniaji (Gandhi) but not arresting her. Congress is not questioning the PM’s degree. BJP and Congress are holding dharnas against each other. Is this country foolish? Dono mein badi achchi setting hai (They have a very good pact).”

“It emerges that he has done neither a BA nor an MA. Both degrees are fake. Firstly, he lied to the entire country, secondly, he lied in an affidavit and thirdly, the degrees are forged. This is a case of cheating. If the PM is accused of cheating under (IPC section) 420, this is a serious matter,” he added.

In his affidavit for the 2014 Lok Sabha elections, Modi had stated that he received a BA degree from DU in 1978 and a MA degree from Gujarat University.

Meanwhile, Kejriwal Friday claimed that a different person, also named Narendra Modi, had been a student of DU in 1975.

“With great responsibility, I started talking about this day before yesterday. In DU, there is neither an enrollment form nor is his (Modi’s) name in the register. He has not obtained a degree. His name is not even in the school of open learning. His name is nowhere. After all the probing, we found one Narendra Modi who had taken admission in 1975. He was from Alwar. His date of birth is 1958 while the Prime Minister’s date of birth is 1950. He is a completely different Narendra Modi,” said the chief minister.

“The issue is not about how educated he is. Even if he was Class X or Class XII pass, we would have accepted it... people gave him a lot of votes, they reposed their faith in him. We respect that faith and that mandate. But there are things that point towards cheating,” he added.

On how AAP managed to access DU’s records, Kejriwal claimed the party had volunteers in various DU departments who had carried out an “investigation” into the matter and procured copies of various documents.

How did Modi get ‘computer typed mark sheet’ in 1978: AAP

A day after the Delhi University Registrar confirmed that PM Narendra Modi's degree was "authentic", the Aam Admi Party on Wednesday alleged that the DU officials had been "under pressure" from the BJP.

"It's not the Registrar's fault. He has to keep his job. Its not possible for him to stand against the Prime Minister and Finance Minister and Amit Shah," said AAP leader Sanjay Singh at a press conference.

Party leader Ashutosh also mentioned the "long list" of officials in Gujarat who had been "transferred and suspended and jailed and harassed" for "speaking against Modi when he was CM".

"The DU authorities should take care that they don't suffer like Vanzara, who had to stay in jail for eight years for doing what Modi told him to", said Ashutosh.

The AAP raised eight questions about the validity of the marksheets released by BJP leader Amit Shah and Finance Minister Arun Jaitley, including the issue that it was a "computer typed mark sheet" even though there were no computers in India in 1978.

"Bill Gates must have had computer at the time knowing that Modiji will become PM in 2014 so his degree needs to be printed now," said Ashutosh. The AAP has also pointed out that the marks in the mark sheets of other persons who graduated in 1978 were handwritten, while the mark sheets for Narendra Damodardas Modi were "printed."

Modi came to power with a bang. Riding on the support of the Corporate World, the RSS combine, the media blitz and the promises of sky; he managed to get 31% of votes and 262 seats in the Lok Sabha. This is the first time BJP managed a simple majority in lower house of Parliament. This also became an occasion for Modi-BJP- RSS to unfold their agenda in full. While economic promises have floundered, the protective policies for the average downtrodden have been partly retracted along with the claims of great economic achievement by RSS combine and its supporters. The reality of economic situation has forced the substantial section of media to take cognizance of the plight of the people and criticize the failure of the Government on economic and many other fronts.

The social scenario has been dismal, the growing intolerance, the attack on autonomy of universities, the treatment of dalits, as reflected in the death of Rohith Vemula, the intimidation of religious minorities through issues like beef, Bharat Mata ki jai, and nationalism have dominated the scene. By now most of the people are clear that RSS is in the driving seat supervising the total unfoldment of its agenda of Hindu nationalism.

This e-book is a compilation of my articles written on the theme during last two years. The idea was to take a stock of the direction of the present regime and its attack on democratic, plural ethos of the country. I hope this will help readers to comprehensively assess this regime, its promises and reality and its deeper agenda of Hindu nationalism.

Gujarat has over a third of India's Muslim detainees

Gujarat accounts for over a third of the total Muslim detainees in the country, Union home ministry figures show.

Of the country's 658 Muslim detainees, 240 are in PM Narendra Modi's home state.

The state has 58.6 lakh Muslims who account for 9.7% of 6 crore Gujaratis. The number of Muslim detainees is disproportionate to the state's share in the country's Muslim population. Gujarat is home to 3.4% of India's 17.2-crore Muslim population. Yet the state accounts for 36.5% of total Muslims detainees.

Activists allege that laws like Prevention of Anti-Social Activities Act 1985 (Pasa) and the now-repealed Prevention of Terrorism Activities Act (Pota) is used mostly against minorities.

Shamshad Pathan, a city-based civil rights activist and lawyer, alleges that the main reason for detaining Muslims is to instil fear in the minority community. "After 2000, there was a trend to detain Muslims for interrogation and that, too, on suspicion of terrorism. Police would force these detainees to become informers and threaten them that they would otherwise be framed in cases of terrorism," Pathan alleged.

Gujarat is a communal state. The hatred against Muslims runs deep within the upper caste Gujarati Hindus. In particular the poison is frightening within the Gujarati Jain and Patidar ( Patel ) communities. In the last hundred years Gujarat has produced many national level leaders. With the exception of Mahatma Gandhi, almost all others, had a mild to strong bias against Muslims. One of them, K.M.Munshi was appointed as the in-charge of Hyderabad state, after the " Police Action " in 1948 . Literally thousands died in that " Police Action ".

It is no wonder that the RSS / BJP developed deep roots in Gujarat. Ahmedabad became the saffron political capital, much before the rise of Modi. Every top saffron leader ultimately entered Parliament through Gujarat.

Hence it is not surprising that detention laws have been widely misused in Gujarat. Of the total held in detention without trial in the country, 36 % are in Gujarat. Incidentally the Gujarat Muslim population is just 3.5 % of the national Muslim population. These figures speak of the frightening communal hatred within the political leadership, the bureaucracy and even in the judiciary.

Modi's emergence as a virulent saffron mascot in 2002, was most natural in Gujarat.

I wonder how Gandhi was born a Gujarati ?

Skeletons in the closet: India bad loans getting messier

India's bad-loans problem looks much worse than lenders have been willing to acknowledge, heaping pressure on banks' profits and further tightening the screws on distressed debt that could be bigger than New Zealand's $170 billion economy.

The magnitude of the debt-mess was laid bare late last month when two of India's largest private sector lenders provided unprecedented guidance on non-performing loans, underscoring repeated warnings by Reserve Bank of India's governor Raghuram Rajan on the need to clean up banks' balance sheets.

The dangers are clear cut. Increasing provisions to cover rising bad loans are likely to hurt banks' profits and curb credit growth, stoking a vicious circle of lower economic growth triggering more defaults and choking off business investment and production.

Bhattacharya estimates about 13 trillion rupees ($195 billion), or a fifth, of bank loans are already stressed - bigger than the size of New Zealand's economy.

That compares with 8.06 trillion rupees of distressed loans reported as of December or 11.5 percent of India's entire bank debt, meaning more pressure on profits.

Investors and analysts have long suspected that Indian lenders, especially the dominant state-run banks, are not disclosing the true extent of their troubled loans to avoid having to raise provisions.

"It could get worse before it gets better is the sense we have," India Ratings' Bhattacharya said.

Clean chit to Sadhvi, MCOCA dropped, Karkare probe was fudged: NIA’s new Malegaon script

Three others to be let off too, all accused to be tried under unlawful activities Act

Significantly watering down the 2008 Malegaon blasts case, the National Investigation Agency (NIA) has decided not to name Sadhvi Pragya Singh Thakur as an accused in its chargesheet to be filed in a Mumbai court Friday. This sets the stage for her early release from jail.

The chargesheet is likely to mention that the investigation conducted by former Maharashtra ATS chief Hemant Karkare, later killed in the 26/11 terror attack, was flawed, that the evidence produced against Colonel Prasad Purohit, another key accused, had been fabricated, and statements of witnesses were taken under duress.

In all likelihood, the chargesheet will state that the ATS planted explosives in Purohit’s living quarters at the Deolali Army camp at the time of his arrest in 2008. “We have evidence to show that the RDX was planted by ATS,” an NIA officer said.

It is learnt that the NIA has also given a clean chit to at least three other accused who, the agency claims, had a peripheral role and were not aware of the conspiracy behind the Malegaon blasts on September 29, 2008 that killed four people and injured 79 others.

In an interview to The Indian Express on June 24, 2015, Rohini Salian, who was the special public prosecutor in the case, said she had been under pressure from the NIA to go “soft” on the accused ever since “the new government came to power” at the Centre. In October, after she was removed as the case prosecutor, she named the NIA officer who had contacted her.

The Maharashtra ATS, which had earlier filed a chargesheet in the case, named 14 people as accused including Thakur and Purohit.

Sources said the decision not to charge Thakur, a former office-bearer of the ABVP, was taken because of the “weak evidence” against her and the fact that MCOCA charges had been dropped against the accused.

“The only material evidence against her was the motorcycle on which the bomb was kept. This motorcycle was in her name but was being used by Ramchandra Kalsangra. Investigations have proved it was with him for two years prior to the blast. He was the one who would get it repaired and pay for its maintenance. Witness statements proved it,” an officer claimed.

Sources claimed the evidence against Thakur on her participation in the conspiracy was “thin”.

The NIA, which took over the case almost three years after the Maharashtra ATS filed a chargesheet in the case, re-examined all the accused, witnesses and evidence presented in the ATS chargesheet. It also recorded fresh statements, many of which exonerated the accused.

* Sadhvi said she would arrange men for the blasts in Malegaon.
* Sadhvi knew Sunil Joshi, Ramchandra Kalsangra. Her motorcycle was with Kalsangra.
* ATS said Purohit floated Abhinav Bharat in 2007 for a Hindu Rashtra.
* Purohit brought RDX from Kashmir where he was posted earlier.
* Purohit assembled bombs in Pune with Sudhakar Chaturvedi, Kalsangra.
