Former Gujarat Judge Says He Quit Over Government’s Anti-Muslim Bias

Activist Teesta Setalvad may have had a bumpy ride from the start in her attempts to fight for justice for the victims of the 2002 Gujarat riots but recent cases foisted on her by the Gujarat police and Central Bureau of Investigation are being widely seen as a last ditch attempt by the state to stop her in her tracks.

Teesta’s defenders say accusations of embezzlement and embellished accounts of what the CBI found when it raided her home are aimed at diluting the potency of the Zakia Jafri petition her organisation is now taking to the Gujarat High Court in its attempt to indict Narendra Modi for complicity in the 2002 violence.

In the wake of claims made by Bharatiya Janata Party leaders about Teesta being “anti-national”, a former judge of the Gujarat City Civil and Sessions Court has reached out to Setalvad with a letter of support and also disclosed how the allegedly anti-Muslim bias of the state government during the Modi years prompted him to quit his job.

In a Facebook post, Himanshu Trivedi, who was a judge in the City Civil and Sessions Court from October 2002 to May 2003 has explained the nature of events that enveloped the judiciary in 2002 and after. His post highlights the structural coercion that has been the reason why scores of victims have still not had the chance to get justice.

Trivedi was a former colleague of Jyotsna Yagnik, the judge responsible for convicting Maya Kodnani and Babu Bajrangi for the Naroda Patiya massacre, before he resigned on moral and ethical grounds and emigrated to New Zealand. His post reads as follows:


“Teesta Setalvad. Hats off. I have always admired you and your courage and outspokenness on these issues. I also take this opportunity to state that I am indeed pained (and I am the one who had QUIT Gujarat’s Judiciary. I was a district cadre judge in Ahmedabad City Civil and Sessions Court – once a colleague of the bravest judge Ms Jyotsna Yagnik who handed out the judgments to Babu Bajrangi and Kodnani and now lives in fear of her life) … because they (the State of Gujarat) wanted us (the judges and the judiciary) of Gujarat to be acting against the minority community (albeit with no written orders but DEFINITELY communicated in loud and clear messages to us). I could not be part of it as I was sworn to the Constitution of India …”

In a subsequent email to Teesta, Trivedi revealed that there were many individuals who had communicated directly with members of the judiciary telling them to rule in a manner that would teach “these people” a lesson – a reference to the Muslim minority.

While Setalvad and Jafri intend to highlight before the High Court crucial information that they say the Special Investigation Team had ignored in giving Modi a clean chit for his role during the riots, Trivedi’s statements suggest the Gujarat state machinery was deployed to protect many of the perpetrators of the 2002 riots long after the violence had ended.

Bajrangi is one of the 31 convicts of Naroda Patiya case which relates to massacre of 97 Muslims in Naroda Patiya area here during the post-Godhra riots in 2002.

The trial court sentenced him to “imprisonment till death” in August 2012.

Bajrangi was granted bail by the Gujarat High Court on April 23 for three months for the treatment of vision loss. It was then extended for another ten days.

“My father today returned to the jail, but he is blind now even after the treatment in Chennai,” said his son Anil Patel.

“There is no improvement in his vision. He cannot see anything,”
Anil told PTI.

The Indian muslims are paying in blood and have paid over the years for what their fellow muslims or so called mulims do in other countries/places. Incidents such as the removal of Kashmiri Hindu Pandits by the Kashmiri mulsim militants (allegedly supported by Pakistan's ISI as means of waging proxy war against India). Exploitation of minority Hindu and Christian communities in Pakistan and Bangladesh is well known. The so called Hindu right wing who are anti muslim to their core and their supporters are always frustrated at this and always protest and malign the muslims whenever they can(Similar to how Muslims worldwide are frustrated and oppose Israel). If you look at history, Hindus have always been moderate and it were the Muslim invaders and then Christian missionaries who invaded India and are documented to have destroyed Hindu temples and other things and converted Hindus into their respective faith in huge numbers sometimes forcefully.. Gujarat, Babri masjid etc was all politics for BJP to come into limelight and power, first on basis of Ayodhya issue (Nationwide) and then in Gujarat on Godhra basis. Same has been done by Congress whenever it was suitable for them. Prime example was support of Jarnail Singh Bhindrawale by Indira Gandhi which proved fatal for her and thousands of people including Sikhs and Hindus in the end ->

It's time for muslims to stop playing victim always and bask in the shadows of self pity. It's time for muslims to start looking at the bigger picture, to become part of the mainstream and progress together. The muslims never protest the uniform civil laws when they migrate to foreign countries and happily abide by the laws of the land because it suits their purpose of migration. Right now, majority of muslims who are backward and under the influence of the regressive, fundamentalist and radical Ulemas and Maulvis are reproducing exponentially. The result is more children per poverty ridden family who don't get proper upbringing and education and who are then brainwashed by vested interests and go the anti social way. The political parties like Samajwadi party, congress and other Vote bank parties take advantage of this for their political interests. This has become a vicious circle that has kept majoirty of muslims backward and regressive.

On the other hand, the bohras, Ismailis, and other similar minority muslim communities under the guidance of their Dai and respective leaders have at least pursued proper civil life and have progressed considerably.

My point of view might have faults but this is exactly what is happening and keeping the muslims backwards.

The wind is fast changing in Gujarat after the infamous 2002 Gujarat riots. Muslims had focused heavily on the ignored sphere of education before the genocide of Muslims broke on them in that fateful year.But after the riots, realising that they had no government support, the Muslims geared themselves up to face challenges boldly by improving their educational standing.

.“Muslim boys and girls diversifying into other educational fields is a good sign,” added J S Bandukwala, a retired Physics professor from M S University who runs Zidni Ilma Trust, which promotes professional and technical education among poor Muslim students.Ultimately the best we can do is to go for quality education, business, a more scientific approach and a serious attempt to make secularism operate in the country. Baroda based Activist, educationist and well known Businessman Zuber Gopalani recently in a function which was held in Ahmedabad cleary exhorted Muslims to send their siblings in English medium schools. He adviced gathering to invest in education for their children even in financial constraints.

Even some ulema are talking about the need for girls’ education, not only for its own sake but also to empower the community as a whole. “There is definitely a rising trend of Muslim students, both boys and girls, getting admitted to medical institutes in the last couple of years”, points out Dr Jayshree Mehta, dean of the SBKS Medical Institute and Research Centre at Waghodia in Vadodara district.

For instance, some people associated with the Tabligh Jamaat are now setting up Muslim schools in different parts of Gujarat.

According to Rajkot based Faruk Abdul Ghaffar Bawani who works for medical students says that there are 1350 Muslim students who have got admission in various courses of medicine .He collects funds from wealthy Muslims and distributes them among poor and needy Muslim medical students.

Godhra Riots: Gujarat govt gets HC nod to launch probe against former DGP Sreekumar

Sreekumar had several run-ins with the Gujarat government which started following his depositions before the Nanavati Commission probing 2002 post-Godhra riots.

In a setback to former Director General of Police (DGP) R B Sreekumar, the Gujarat High Court on Friday allowed the state government to initiate a departmental inquiry pending since 2005. The former IPS officer had taken on the previous Gujarat government led by the then Chief Minister Narendra Modi, now the Prime Minister, for 2002 post-Godhra riots.

The chargesheet was issued against the former top cop in September 2005 on nine alleged charges including maintaining a private diary and making it official, taping conversation of a meeting with government official and “leaking intelligence reports” to the media among others. Sreekumar had submitted the diary, tape recordings and intelligence reports before the Nanavati Commission probing the 2002 riots. Sreekumar moved before the CAT in 2007 which quashed the chargesheet. Subsequently, the state appealed against the CAT order in the high court in 2008.

Sreekumar, who retired in 2007, was among the first serving IPS officers who had openly criticized the then Gujarat government for the riots and had deposed before the Commission. He had several run-ins with the state government which started following his depositions in the Commission. While deposing before the Commission, Sreekumar had submitted the controversial diary, containing oral instructions of his superiors and an audio recordings with several state government officials asking him not to give any information to the Commission that may embarrass the government.

Following the request by Sreekumar’s lawyer I H Syed, the bench ordered that the former cop shall file his reply to the state government by October 28 and directed the state government not to take any action against the retired officer. When contacted, Sreekumar said that “state government is systematically working to finish all the whistle blowers and I am the first whistle blower. I am planning to move Supreme Court.”

The High Price of Conscience

As much at ease reciting from the scriptures of the world’s major religions as quoting chapter and verse from the Indian Constitution, Indian Penal Code and the Code of Criminal Procedure, RB Sreekumar a 1971 batch IPS officer remains one of the key whistleblowers blowing the lid of high level state complicity behind the Gujarat carnage of 2002. At the receiving end of state-driven vendetta that threatens his post retirement benefits, Sreekumar, in an exclusive interview to Communalism Combat-Newsclick and Hillele.org speaks of the significance of his bearing witness to the pogrom of 2002.

Sreekumar was ADGP State Intelligence Bureau Gujarat between April and September 2002, a critical period during which he was witness to deliberate inaction in the high echelons of power and subversion of the criminal justice system at the highest level. His actions during the communal carnage of 2002 were driven by conscience and a deep commitment to the rule of law, making him, as some others not just a thorn in the leash for the Modi regime but it’s bête noir. He speaks to Newsclick-Communalism Combat about the cost of telling the truth in the public domain under the current Regime.

Seven days after he took over as ADGP, Intelligence, Sreekumar recommended stringent action against a slew of virulent pamphlets circulated in their thousands by the Vishwa Hindu Parishad (VHP). His view, as that of other senior policemen in Gujarat was blithely ignored by the home department headed by the then chief minister Modi. Thereafter, on four occasions, i.e. on 24.4.2002, 15.6.2002, 20.8.2002 and 28.8.2002 he sent four Confidential reports to the state government recommending stringent measures to restore public confidence in the law and order machinery. These too were ignored. His independent report to chief election commissioner, James Lyndoh in August 2002 poked holes in the myth of ‘normalcy’ being propagated by the regime. His final act of exactitude that earned him his transfer was responding to the request of the National Minorities Commission (NCM) and sending a transcript of Modi’s speech at Becharaji, Mehsana on 9.9.2002. His aide memoir, a confidential register maintained between April and September 2002, is a record of the illegal instructions issued by his superiors. The Raghavan-dominated SIT failed to independently investigate the evidence that this officer provided with any probity.

Along with other officers like Rahul Sharma (now a lawyer having sought voluntary retirement) and Sanjiv Bhatt (Recently sacked from service), he has paid the price for standing by his conscience. Other officers who protected lives and properties have been similarly sidelined even as the collaborators in the services (IAS and IPS) hold high positions today.

RB Sreekumar also holds a Masters Degree in History. After he was appointed to the Gujarar cadre in 1971, he was at various times, Assistant Superintendent of Police, Deputy Inspector General, Deputy Director General DIG (Central Investigation Bureau), Joint Director (IG), and Additional Director General of Police. In 1999, under NDA I, he was even awarded the President’s medal for meritorious service. Today he is in the news once more as he prepares to move the Supreme Court of India after the Gujarat High Court (on September 4. 2015) has dealt him, and free Constitutional speech, a body blow.

Gujarat riots case: Sanjiv Bhatt moves SC, seeks to make Amit Shah a party to his petition

Dismissed IPS officer Sanjiv Bhatt moved Supreme Court seeking to make BJP president Amit Shah a party in his pending petition alleging PM Narendra Modi's role in Gujarat riots as well as foisting false cases against him.

In his petition, Bhatt also sought to make Gurumurthy Swaminathan a party in his petition which was filed in 2011 alleging that he was present in a meeting called by the then CM Narendra Modi that decided to allow Hindu mob to go on rampage after 2002 Godhra incident.

Bhatt's new application seeking to make Amit Shah and Gurumurthy party in his petition was mentioned by senior advocates Kapil Sibal and Indira Jaising before a bench headed by CJI HL Dattu.

Indian widow fights Modi in 'final' court battle over deadly riots

AHMEDABAD, India (Reuters) - Zakia Jafri, a frail 76-year-old, has begun what may be the last legal battle to pin blame on Indian Prime Minister Narendra Modi for deadly riots that shook the state of Gujarat when he was chief minister, and claimed her husband's life.

"My case is not just against the foot soldiers," said Jafri, "It is against those who allowed the foot soldiers to operate," "It is against those who created the situation for the foot soldiers to get provoked and enabled them to operate. It is against Modi."

"We are trying to establish a chain of command responsibility. Our task is to show that an individual in the position of power could be administratively or criminally culpable,"

Setalvad said she pored over testimonies of victims, policemen, bureaucrats, politicians and members of hardline Hindu organisations to piece together Modi's role in the riots.

She examined Modi's phone records and police intelligence reports as well as evidence from policeman Sanjiv Bhatt.

The Gujarat High Court began hearing Jafri's petition, which names Modi as the prime accused, this month. She is seeking a criminal trial against him and 58 others for the month-long bloodshed.

Lawyers involved in Jafri's case said it would take months for the proceedings to conclude, and that it could eventually reach the Supreme Court.

Modi may not be losing sleep yet, although he did inquire who would be presiding over the case, one official in his office said, speaking on condition of anonymity.

For Jafri, what could be her last battle against Modi will bring back painful memories.

She saw her husband, Ehsaan, making desperate calls to the police before being dragged out of his ancestral home by sword-wielding men. Within minutes he was stripped and killed.

"This case is not just about my husband, it is the final attempt to seek justice for thousands of Muslims who expected Modi to save them."

Muslim IAS and IPS officers provided a freehand to saffron rioters during Gujarat riots : R B Sreekumar

Gujarat post Godhra riots once surfaced as Former chief of Gujarat Intelligence Bureau R B Sreekumar made shocking revelations through his book Gujarat: Behind the Curtain, about the functioning of the state police department in the aftermath of Godhra train carnage. The ex-bureaucrat has disclosed shocking facts which not only brings the role of the then legislative government under scanner but also throws light on the actions of Muslim IPS officers who also chose to provide a freehand to saffron rioters, particularly in Naroda Patiya.

At least six IAS and seven IPS Muslim officers at the time were working in close coordination with the government and chose to turn a blind-eye towards the rioters linked to saffron bodies.

“At least two Muslim officers, including a commandant, even defied my “written orders” to give shelter to 500 Muslims from Naroda Patiya on the state reserve police (SRP) premises. Consequently, they had become victims of riots… Most of the 96 people killed in the evening in Naroda Patiya were reportedly from this group of Muslims… No action was initiated for defying written order of ADGP (AU) and no report was made,” Sreekumar wrote in his book.Sreekumar also mentions about the strive he made towards exposing those within the establishment responsible for orchestrating the entire pogrom. During his five-month stint as Intelligence chief beginning immediately after the trains were burned in Godhra, Sreekumar was given “illegal” orders from higher authorities, and not allowed to take action against those who were bent on sparking communal tensions on a large-scale.

Gujarat, Behind the Curtain,’ a book on Gujarat riots by R B Sreekumar, former DGP, Gujarat, was published the other day in New Delhi, according to a release issued here by Sreekumar. The former IPS officer, a native of Neyyattinkara in Thiruvananthapuram, had been in the news for his relentless fight against the then Gujarat Chief Minister Narendra Modi, alleging that Modi had given a free hand to the rioters for two days following the killing of 59 Hindu pilgrims at the Godhra railway station in 2002.

Sreekumar had been alleging that subversion of criminal justice system was followed in Gujarat after the Godhra incident with the tacit understanding of the government. Sreekumar had thrown light on the role of intelligence agencies after the Godhra incident and how policemen and bureaucrats responded during the riots. It is worth noting that this is the first time that SIT has recorded the statements of Sreekumar which will prove to be of pivotal importance for the investigation agency. A reliable source said, “The statements were recorded not in connection with a particular case but in connection with the act of commission and omission during the riots by a few people. The statements were recorded in connection with the conspiracy of the riots.”

Jafri’s wife had filed an application in the apex court challenging the decision of the Gujarat high court to dismiss the plea which sought registration of a complaint against Modi and others for their alleged role in the Gulbarg Society riots of 2002.

Sreekumar said that he was subsequently superseded by three of his juniors. However, he was promoted after he filed a petition before a tribunal but by then he had already retired.

According to SIT sources, senior IPS officer and IG SRP (Rajkot) Rahul Sharma was also quizzed in this connection. Sharma has been named as a witness in Zakia’s complaint on account of his submitting a CD containing call details of some ruling party politicians, VHP activists and police officers during the riots. It was on the basis of his CD that former minister Maya Kodnani and former VHP leader Jaideep Patel were arrested.

The Gujarat Government’s Attempt to Target a Police Officer Has Backfired, Badly

In exonerating Rahul Sharma and criticising the government for wrongfully targeting the former police officer, the CAT has shone a spotlight on the state’s lack of interest in punishing the perpetrators of the 2002 riots.

“And now to add insult to injury, a charge sheet is issued to an officer who had apparently aided the cause of truth. Have not the words ‘Satyameva Jayate’ no meaning?

This is the conclusion reached by the Central Administrative Tribunal (Ahmedabad Bench) in its judgment quashing the departmental charge sheet against the retired Indian Police Service officer Rahul Sharma. The charges stemmed from the Gujarat government’s attempt to take action against him for having submitted incriminating call data records from Ahmedabad during the period of the 2002 riots before the Nanavati Commission of Inquiry.

The trumped up charge against Sharma fell somewhere between destruction of evidence and its fabrication but lacked any substance and failed to withstand proper scrutiny. But though the Gujarat government failed to make out a case against the police officer, its ham-handed efforts at persecuting him for actually trying to serve the cause of justice will only strengthen the suspicion that it has something to hide.

It was a matter of record that the police had sought the records of all calls made from Ahmedabad by certain individuals during the relevant period. However, this information was subsequently ‘misplaced’. Much to the consternation of the Gujarat government – which was headed by Narendra Modi as chief minister at the time – it turned out that Rahul Sharma, who had received a set of the CDRs, kept a copy, analysed them and produced this data before the Nanavati Commission.

Targeted for telling the truth

The Gujarat government sought to attack the unexpected emergence of this evidence in two ways. First, it alleged that Rahul Sharma had fabricated the call data records – an allegation which could not pass muster as there was no indication of fabrication and the government, in fact, did not ever dare to prosecute him for fabricating evidence as that would have led to even greater focus on the call records. This was the reason for the second line of attack – that the originals had been ‘misplaced’ or ‘lost’ and because Rahul Sharma had obtained a copy of the same he should be held responsible for the loss of the original.

This was the specious reasoning on which the departmental chargesheet was based. To simplify the Gujarat government’s case, they admitted losing the crucial evidence and then sought to blame the police officer who was actually able to produce a copy of the same. The importance of the CDRs was realised by the Nanavati Commission in its report and is also a crucial piece of evidence in ongoing trials relating to the riots.

The CAT, in its judgment, has come down harshly on the Gujarat government and has held not only that its actions against Sharma were motivated by “malice in law”, but that the state government has, in attacking the sanctity of the evidence produced by Sharma, done a great disservice to the cause of justice and public good. It has noted that if Rahul Sharma were to be blamed for the loss of the original CDs, then other officers who dealt with the original information received should also have been questioned and prosecuted. Needless to say, not one question was raised against any other officer.

The judgment of the tribunal makes for interesting read as the bench tries to make sense of the government’s case against Sharma.

‘Malice and illegality’

This is not only an indictment of the Gujarat government’s handling of Rahul Sharma but of that government’s utter failure in implementing the rule of law. The judgment concludes that the government’s action “is tainted by mischief, mala fides and malice and coloured by arbitrariness, illegality and designed to defeat proximate and pertinent matters blessed by constitutional compulsion and designed as an engine of oppression.” These are unusually strong words which cannot, and should not, be ignored.

Rahul Sharma, who took voluntary retirement from the IPS in 2015 after constant harassment by the state government, is one of the many upstanding officers targeted by the Gujarat government. A similar chargesheet against Kuldip Sharma was quashed in 2011. The CAT and other courts are hearing many other cases in which the Gujarat government’s actions against its own police officers have been questioned. That all these police officers have taken actions that are considered inimical to the interests of BJP and Gujarat government leaders cannot be considered a mere coincidence.

Angry Patels Spill the Beans; Say Godhra Train Blaze Was BJP’s Pre-planned Political Stunt

AHMEDABAD – The ongoing Patidar agitation in Gujarat has taken unexpected turns with Patidar Samiti leaders Rahul Desai and Lalbhai Patel lashing out against the governing BJP for its communal politics. “The BJP is fundamentally a communal party that has been planting its ideology of Muslim hatred for years now,” said Desai. “I can tell you with certainty that Modi would never have been re-elected as the chief minister in 2002 if it had not been for the Godhra train burning.”

In February 2002, a fire in the Sabarmati Express killed 59 commuters, many of them Hindutva karsevaks. Thirty one Muslims were later convicted of their alleged involvement in the fire. The Godhra blaze was followed by anti-Muslim pogrom across Gujarat in which more than 2,000 people died. Desai, who was in school at the time, remembers being shown videos of the Godhra train burning in class.

“They were doing it to propagate the idea that all Hindus need to come together or else the Muslims would kill us,” said Desai. “I don’t know if the men who burnt the train were Muslims or not, but I know that the Godhra train burning was a pre-planned political stunt by the BJP to win the state election later that year.”

When communal thinking takes root, says Desai, it is very difficult to get rid of. “Because of the BJP’s propaganda, all of us began to think communally, and I feel kind of cheated now,” he said. “Even today, people are afraid that Muslims will riot against them, but honestly, even if they don’t, the BJP will get it done.”

Desai acknowledges that he may not be speaking for all Patidars in Gujarat, but he is certain that all other members of the Patidar Andolan Samiti share his views.

In Mehsana, Laljibhai Patel could not agree more. “Of course, Godhra and the 2002 riots were orchestrated by the BJP. It is obvious to us now, but back then it wasn’t,” said Lalbhai Patel. “Last time they targeted Muslims. Now they are allowing the Patels to be persecuted. This is exactly the kind of politics that leads to the creation of Naxals.”

Kanhaiya Kumar is right. 1984 & 2002 riots are different

Jawaharlal Nehru University Students Union President Kanhaiya Kumar has apparently said the 2002 Gujarat riots and the 1984 riots in Delhi were different.

He has been quoted as saying that the the massacre of Muslims in Gujarat was carried out with the active collusion of the state machinery while the killing of Sikhs in Delhi was the result of mob frenzy.

From insensitivity to Congress appeasement, Kanhaiya is being accused of a variety of vices.

Let's get a few things straight.

First, 1984 was a pogrom against Delhi's Sikh minority, 2002 was a pogrom against Gujarat's Muslims. There is absolutely no difference in the suffering of the victims and their families. From people being burnt alive to women being raped, there was no difference in the brutality either.

Second, Kanhaiya is right that the Gujarat riots were state sponsored. But in1984, the administration didn't come forward to save the hapless Sikhs. Perhaps the state complicity in Gujarat was higher, but at the most, it is just a difference in degrees.

Third, In terms of providing justice to victims, perhaps the case of Gujarat is marginally better with at least Mayaben Kodnani and Babu Bajrangi being convicted. No leader from the Congress was ever convicted for the '84 riots.

Yet 2002 and 1984 are different. The difference doesn't lie in what happened during the riots but what happened after them.

Modi became PM. Sajjan and Tytler were sidelined

The Gujarat riots made Narendra Modi a hero for BJP's core constituency, who saw him as someone who "taught Muslims a lesson".

Modi revelled in that image for many years. In the 2002 Assembly elections, he actively made dog-whistle communal remarks like "hum paanch hamaray pachees" (we five, our 25) and called relief camps for the riot affected as "baby producing centres".

Let us face it, Modi would have been just one among many BJP leaders had it not been for the 2002 riots. In fact, had the riots not taken place, he would probably have lost the 2002 Assembly elections in Gujarat, given the way his party was trounced in the Panchayat polls the previous year.

Had 2002 riots not happened, Narendra Modi would never have become PM

The riots made Modi a national figure and this eventually paved the way to his ascent as prime minister. For many, Modi is an icon because of the riots not despite them.

Tytler and Sajjan Kumar were never hailed as Hindu Hriday Samrat. They remained sidelined within the Congress for much of their careers.

In comparison, whom did the Congress make PM when it came to power in 2004? Not Tytler, not Sajjan Kumar, but Manmohan Singh, a Sikh.

Will BJP ever project a Muslim as PM?


Rajiv Gandhi versus Modi

Yes, Rajiv Gandhi won the elections that followed soon after the assassination of Indira Gandhi, just as Modi won in 2002. But it was a sympathy wave not an anti-Sikh wave.

And his remarks "when a big tree falls, the earth shakes" are often compared to Modi's comment that "every action has a reaction".

But that wasn't the only statement Rajiv Gandhi made. Here's what he told the people of India in his address on 31 October,1984, the day Indira Gandhi was assassinated

"This is a moment of profound grief. The foremost need now is to maintain our balance. We can and must face this tragic ordeal with fortitude, courage and wisdom. We should remain calm and exercise the maximum restraint. We should not let our emotions get the better of us, because passion would cloud judgment. Nothing would hurt the soul of our beloved Indira Gandhi more than the occurrence of violence in any part of the country."

Did Modi say anything like that?

Similarly, both Sonia Gandhi and Manmohan Singh apologised on a number occasions for what happened in 1984. There was no such apology from the BJP for 2002. On the contrary, the Hindutva brigade often showcases the Gujarat riots as a lesson to minorities on what can happen if they don't 'behave'.

Ideology matters

True, words don't matter as far as the victims' grief is concerned. But they are important as they reflect the intent of the political parties concerned.

The reason that the BJP never apologised for the 2002 riots is that antipathy towards Muslims is integral to the Sangh Parivar. VD Savarkar, for instance, didn't regard Muslims as Indians in the first place. Even now BJP leaders like Yogi Adityanath openly preach hatred against Muslims.

On the other hand, there is nothing ideologically anti-Sikh about the Congress and the party did not run a campaign against Sikhs.

Had Congress been inherently anti-Sikh, would Sikh majority Punjab have elected Congress to power twice - in 1992 and in 2002?

Congress isn't inherently anti-Sikh but antipathy towards Muslim is part of BJP's ideology

In contrast, Muslims in Gujarat and rest of the country still continue distrust the BJP and very few of them vote for the party.

The 1984 and 2002 riots are no different in terms of people's suffering or even, as Kanhaiya claims, in terms of state support. It basically boils down to a difference between the Congress and the BJP, which is the larger point Kanhaiya seems to be trying to make.

Postscript: There is one commonality between the two riots that most people seem to have missed. BJP and RSS cadres were reportedly involved in both of them.

‘Yesterday Somehow I was Saved, But It Does Not Look Likely Today’: Gujarat Files

For her book, Gujarat Files: Anatomy of a Cover-Up, a memoir of reporting undercover on Modi’s Gujarat, journalist Rana Ayyub posed as ‘Maithili Tyagi’, an earnest American-born filmmaker in order to interview (and surreptitiously record) key figures in the state, including Maya Kodnani, G.L. Singhal and, in this excerpt, Ashok Narayan, the state home secretary during the 2002 pogroms.

It was on that day that I began talking to him about his most crucial responsibility, that of being the Home Secretary of Gujarat. The ambience was just perfect, I had initiated the topic in a manner that looked like just another light conversation over food. Narayan spoke uninhibitedly.

By the time we sat down for post-lunch tea, he had started getting into the details of how Narendra Modi had handled the riots.

Even for a layperson the conversation would reveal the level of complicity of the state administration during the Gujarat riots. What Ashok Narayan was telling me was something most of us knew but it had never been said by an official figure, the man on whom most eyes were fixed during the Gujarat riots. What is more revealing is the sociological and political context the ex-Home Secretary talked of when he spoke about the Gujarat riots and what it meant for Narendra Modi. That he is objective can be ascertained from the fact that at no point does he try to mix facts with fiction. He even expresses his apprehensions about the manner in which Sreekumar leaked his affidavits to the media. He further talks of a meeting which took place in Gandhinagar during the Gujarat riots but at no point suggests that the CM gave marching orders against Muslims. Rather he makes a more nuanced argument about how these orders were given personally to officers who found favour with the dispensation.

I sat there listening to this gentle, unassuming man as he said things to me that he had not even stated during his cross-examination by the Nanavati Commission.

In 2010, the journalist Rana Ayyub spent eight months undercover in Gujarat. Ayyub, who was then working for Tehelka magazine, posed as a filmmaker. She met bureaucrats and senior police officials in Gujarat who held pivotal positions in the state between 2001 and 2010. The transcripts of the sting operation, unpublished so far, form the core of her book Gujarat Files: Anatomy of a Cover Up. How Police Officers Defied the Orders of Their Superiors to Protect Muslims in Naroda Patiya

RB Sreekumar was the additional director general of the Gujarat police in the intelligence department, a post he took over soon after the Godhra riots in 2002.

In August 2004, Sreekumar deposed against the state government and filed nine affidavits in front of the Nanavati-Mehta commission, which was investigating the carnage. In 2005, he was denied a promotion on the grounds that that a case from 1987—a period during which he was the superintendent of police in Kutch—was pending in court. He subsequently took the case to the Central Administrative Tribunal, which ruled in his favour in September 2006. The Gujarat government had also initiated a probe against Sreekumar for maintaining a “secret official diary” and for giving out “classified information” to the panel. He got a stay on this investigation from the Supreme Court in October 2015.

Sreekumar’s book Gujarat: Behind the Curtain, which was released in December last year, criticises the Bharatiya Janata Party and the Sangh Parivar for its role in the violence. Sreekumar also condemns the United Progress Alliance government for its failure in the delivery of justice to the victims of the riot.


In the following excerpt, Sreekumar describes how his explicit orders to protect the Muslims in Naroda Patiya were defied on 28 February 2002, leading to the death of 96 people.

Riot victims often expressed their concern, disillusionment and apprehension about the condemnable state of justice delivery to them by Gujarat Police and SIT investigating 9 major carnage cases through Gujarat Police officers.

While Gujarat Police tried to save practically all accused in anti-minority cases from clutches of law–only 30-35 cases, out of 2,000 odd riot cases, reinvestigated by Gujarat Police on the Supreme Court orders had reached the stage of prosecution and in the remaining cases, witnesses including riot victim survivors did not corroborate their own statements to police during the trial before the court.

Except two police Inspectors, no higher officer was found to be even remotely responsible for any criminal negligence of duties, facilitating attacks by Hindu mobs.

After a lot of hue and cry made by activists and riot victims only, DySP Noel Parmar, the Investigating Officer of Godhra train fire case, who was continuing months after his retirement, was relieved of his responsibility in this case. Two main witnesses of this case, in an extra-judicial admission, revealed that they were bribed by Noel Parmar for supporting police theory on genesis of train fire.

The non-enforcement of curfew imposed in the area by Commissioner of Police (Ahmedabad city), led to armed men freely attacking minority habitats and killing 96 persons. The local police did not arrest anybody for curfew violation and prosecuted them under Section 188 IPC. Was it not blatant connivance to the commission of crimes?

The major characteristic of Sandesh, in the period under review, has been to feed on the prevalent anti-Muslim prejudices of its Hindu readership and provoke it further by sensationalising, twisting, mangling and distorting news or what passes for it. The average Hindu reader in Baroda feels that he is getting value for money and ‘real’ reportage.

Sandesh has consciously sought to project a communalised version of events and inflicted serious and long-term damage to a society already fragmented along communal lines. Gujarat 2006 is deadlier than 2002. Because Hindutva has manufactured a new DNA beyond the Indian Constitution

Short, stocky, and balding, Babubhai Rajabhai Patel can pass off as a normal, middle-class trader. Only, he isn't one. Babu Bajrangi, as Patel likes to be called, says he runs an NGO, Navchetan Sangathan. Sitting in his 'office' in Ajanta Ellora Complex in Naroda in Ahemdabad, Bajrangi is surrounded by images of RSS ideologues KS Hedgewar and Guru Golwalkar, a map of Akhand Bharat, and his own photographs, with politicians or in public meetings.

Bajrangi claims to be a social worker. "I rescue Hindu women who are lured by Muslims. I hate such marriages." As soon as Bajrangi gets to know of any such union, he kidnaps and sends the girl back home; and beats up the Muslim boy. "It's fun. Only last week, we made one such man eat his own shit thrice," he says. Bajrangi's operation is ruthless and effective. He claims to have 'saved' 725 Hindu women this way. And what about the law? "What I do is illegal, but it is moral. And anyway, the government is ours."

Perhaps that is the reason that Bajrangi, chief accused in the Naroda Patiya murder case (during the Gujarat carnage), is out on the streets and not behind bars. "People say I killed 123 people," says Bajrangi with a grin. Did you? "How does it matter? They were Muslims – bloody Pakistanis. They had to die. They are dead."

“The government is ours.” Few will doubt Bajrangi's claim. Not Muslims for sure, for they know Bajrangi might be more extremist than most, but he represents a mindset that is widespread: the mindset of the Gandhinagar government’s ministers. The mindset of several Hindus, from the waiter to the auto-driver and the middle-class, across Gujarat.

The discourse among Muslims has a striking unity. There is no one who speaks for us. This is not our government. This is their rule — Hindu rule. What do we do? As an elder in Shah Alam, a Muslim area in Ahmedabad, puts it, "Our crime is we pray to Allah."

The emotions of Muslims across Gujarat revolves around alienation, helplessness, and anger. Understandably so, large sections of the Hindu society, led on by the BJP government, ensure that Muslims remain second-class citizens.

And that is the story of Gujarat 2006. A tale of a society that is sharply polarised and prejudices about the 'other' deeply entrenched, and a state that happily engineers everyday hatred. In its wake, lies a community that lives in fear. The Gujarat of today is in some senses more dangerous than the Gujarat of 2002. For here, the violence is invisible. It operates systematically, as well as subtly, at the establishment and social level.

The truth is, the Gujarat government has seceded from the Indian Constitution. It did so in 2002, when the state sponsored mass violence against Muslims. And contrary to what many think, it has consistently done so and flaunted it since then. It has tried to completely subvert the process of justice for 2002 victims, from distorting FIRs and ensuring faulty investigation, to letting the accused get away free. With office-bearers of the Sangh Parivar affiliates doubling up as public prosecutors, it is little surprise that only 13 out of the 345 cases decided so far have resulted in convictions.

Even as it fulfils its promise that no harm should come the way of rioters, the government continues its campaign to harass innocent Muslims. The fact that the UPA government in Delhi did not ban the draconian legislation, Prevention of Terrorism Act (POTA), retrospectively has meant that those charged under that law in Gujarat before 2004 remain in jail. This effectively means that the secular UPA government, backed by the Left, is playing Narendra Modi’s game.

Maulana Omarji's house is, ironically, on the Station Road in Godhra. But he doesn't live there. Along with others accused of hatching the conspiracy and burning the train compartment at the Godhra railway station on February 27, 2002, he stays some distance away – in Sabarmati Jail in Ahmedabad. Omarji was arrested one year after the incident took place – a period in which he was active in organising relief camps for Muslims, and petitioning national leaders who came visiting about the injustice meted out to minorities in the state. Clearly, someone powerful did not like that. A well-respected man and community leader against whom there is no evidence, Maulana Omarji is charged with POTA.

His young and articulate son, Saeed, is quite frustrated. "What is the fault of Muslims in India? I am so angry with the system here, including the judiciary." Everything is stacked up against Muslims in India, feels Saeed. "I am an Indian and will never be disloyal to my country. But I feel our parents and grandparents made a mistake by staying on here. We should have gone to Pakistan." It is a striking comment, revealing the manner in which a fascist state is pushing people into a corner.

Half-an-hour from Godhra lies Kalol -- a site of major violence in 2002. This reporter met Mukhtar Mohammad at the Kalol police station. Active in organising relief camps, Mukhtar has been working to get justice for the victims. Something that did not go down too well with the state authorities. Framed under, what by all accounts, is a false ‘rape case’, he is stuck making rounds of police stations and magistrates and has to spend occasional nights, and at times, extended periods in jail. He says, "They want to break any kind of leadership that emerges among the Muslims, especially those who are moderate, and want to fight politically, constitutionally and legally."

Indeed, there is a pattern in which the Gujarat government is acting against Muslims. The Hindutva forces have no problems if the influence of the Muslim conservative religious organisations increases because it helps strengthen their stereotypes about Muslims. What they do not want is an articulate, liberal voice among Muslims that speaks the language of democratic rights and claims equal citizenship.

The regime targets innocent Muslims not just by framing false cases. Discrimination is spread across all realms. Juhapura is the largest Muslim ghetto in Ahmedabad with more than 300,000 people. Yet, it has no bank, state transport buses take a detour to avoid crossing through it, and there are no public parks or libraries. OBC communities among the Muslims in Gujarat find it difficult to get certain certificates. The saffronisation of the bureaucracy and local power structures, points out scholar Achyut Yagnik, has meant that panchayats, co-operatives, agrarian produce markets and government schemes have become sites for discrimination against Muslims.

What is more alarming is the fact that this discrimination has larger social sanction. There is pride about the 2002 toofan among many Hindus – we taught them a lesson, crushed; the world should learn how to deal with miyas from us, are oft-heard remarks. And the increasing distance between the two communities, both in the minds and physically, has not helped matters.

Most cities and towns in Gujarat are completely divided into Hindu and Muslim areas; a street corner, a divider in the middle of the road, a wall, or just a turn acting as borders. If it was difficult for a Muslim to find a house in Hindu areas before the killings, it is impossible now.

Sophia Khan is a well-known woman activist in Ahmedabad. Her office was in Narayanpura, an upmarket Hindu area. A month ago, when neighbours in her office complex got to know of her faith, they asked her to vacate immediately. Putting up a fight was no use in the face of constant harassment. She has now shifted to Juhapura. "My house is in a Muslim area. My office is now in a Muslim area. My Hindu employee is being pressurised by her family to resign, because they don't like her coming to a Muslim area. And my work revolves around Muslim women. This is how they want to push an entire community into a corner," says Khan.

The segregation has spread to other realms as well, leading to absence of contact and interaction between the two communities and breeding stereotypes and intolerance. The most visible realm is the fewer number of mixed schools in Ahmedabad which have a fair number of Hindus and Muslims. Discrimination on religious lines, coupled with the desire of parents to send children to schools where there are 'more of our people' has further boosted this trend. Pankaj Chandra, professor at Indian Institute of Management, is worried. Brought up in the composite Ganga-Jamuni culture of Allahabad in Uttar Pradesh, he says, "My children may graduate from school without knowing a single Muslim. Imagine how easy it will be to build stereotypes then."

When this reporter, with his long, unkempt beard, walked into an elite government colony in Ahmedabad to meet a senior official, three kids parked their bicycles right in front. One screamed aloud, “Terrorist.” Why? “Because you are a Musalman,” he responded. So? “All Muslims are terrorists. My father is a judge. He will call you terrorist in court.” Really? “Yes. And get out of here. This is a Hindu area.” Sauyajya is 12-year-old and has not met a single Muslim in his life. No one knows how many Sauyajyas are in the making in Gujarat.

2002 Gujarat riots accused Samir Patel who burnt Muslims alive nabbed in London

An accused in a case related to 2002 post-Godhra riot at Ode village in Anand district, who had escaped to UK by jumping his bail, has been detained by London police and will be brought back by the Special Investigation Team (SIT) soon. “Samir Patel, an accused in Ode riot case, who absconded while on bail, has been detained by the London police,” Gandhinagar Local Crime Branch’s inspector and SIT member A K Parmar said.

Two other accused in the case, Natu Patel and Rakesh Patel, are still at large. According to SIT officials, these two accused had left India on fake passports and are still untraceable. In the past, four other accused were deported from Austria, Singapore and other nations with the help of Interpol. 23 people – nine women, as many children and 5 men — of the Muslim community were burnt alive in a house in Pirwali Bhagol area of Ode village by a mob of over 1,500 people on March 1, 2002. The next day, four more persons were killed in another locality of the village.

On April 9, 2012, a special court convicted 23 persons. However, Samir Patel’s trial was not complete as he had gone absconding before that. This was one of the nine riots cases which were investigated by the Supreme Court-appointed SIT.
