Nice to hear aliakbar we also stay in this building and I know Murtuza Bhai very well. We should now come in open without hiding and help the struggle against SBUT. The SBUT has already shown its colors if they redevelop the area they will end up owning the entire area like what Israel has done in Palestine. Even Israel occupied the land by purchasing land, this is what SBUT IS doing. Those that left their land \ homes for the project did so without any documents or agreements and would most likely be never able to come back . infact the area is planned to be developed to such an extent that it would become very expensive for the majority middle\upper middle class people bohras. This is similar to what happened with saifee hospital wherein only the super rich are preferred. Already the bookings for flats have started and most of the bookings are from NRIs. I even heard major gulf consulates would also come up here.This would pave the way for a complete cultural and demographic apartheid favoring the super rich and the clergy.

No construction or demolition work is going on, everything is at a standstill, the reason given is that it is because of monsoons although there are many other factors too.wise_guy wrote:What is the current status of this project ?

Bhendi Bazaar Trust seeks change in Development Control Regulations’s cluster clause

MUMBAI: The much-awaited redevelopment of Bhendi Bazaar will take a while longer. Holding back the Rs 1,500-crore project is mandatory ownership of all properties marked for cluster redevelopment. The trust that has taken up the project on a no-profit, no-loss basis has asked the government to modify one of the cluster clauses of the Development Control Regulations (DCR) so that it can start work.
"There are 280 buildings spread over 16.5 acres, including religious structures. In all, we need to buy 249 buildings, but have purchased 212 so far, which is 85% of the requirement," said Abdeali Bhanpurawala, secretary, Saifee Burhani Upliftment Trust (SBUT). "Acquiring the remaining is proving to be a hurdle. Landlords are demanding a price far in excess of the market rate, which is an unreasonable demand."
The trust has asked the government to allow it to redevelop clusters where they have 100% ownership or reduce the ownership clause to 80% for the entire area. It has asked the government to amend DCR's clause 33(9), give powers to the Maharashtra Housing Area Development Authority (Mhada) to buy out the remaining landlords by giving them 50-100% more than the ready reckoner rates for their properties.
Urban development department officials said "The scheme under the present policy has failed to take off. We have received very few proposals for cluster redevelopment and many are still on the drawing board," a senior official said.
Any forcible acquisition would invite legal challenge, said Janhit Manch secretary Utsal Karani. "Cluster redevelopment should be in the interest of the city and there must be an amicable solution. It would be best if redevelopment is allowed in phases where consent and ownership is 100%. This will blunt the opposition."
There are 3,200 residential tenements and 1,200 shops in the area. The trust, along with Mhada, has certified tenants of 175 buildings. "We have shifted 1,074 families to Anjirwadi and Gorabhdev in Mazgaon and 20% have moved out on rent in the vicinity. About 500 tenements will be shifted in the next two or three months," said Murtuza Ali, who is in charge of obtaining consent from tenants.
Bhanpurawala said that while a few landlords are refusing to budge, those who have shifted are becoming impatient. "We are being constantly asked by these families when they will be able to return."
Shifting of tenants is also an issue as there are not enough transit tenements. The trust has asked for an FSI of four so that it can accommodate all residential tenements. As for commercial transit, the BMC granted permission last week for constructions on the trust's land in Dongri.
At present, the SBUT has begun the demolition of empty, old and dilapidated buildings in clusters one and three. "If granted permission, we can immediately start construction in clusters one, two, three and six," Bhanpurawala said. s

It is reported that an F.I.R. No.227 of 2013 has been filed with the N.M.Joshi Marg Police Station against Murtuza Ali Rajkotwala and Hozefa Chechatwala of M/s.Alamdar Infrastructure Pvt Ltd for Forgery, Cheating and other offences in the SBUT Project. M/s.Alamdar Infrastructure P.Ltd. have been given full powers by Qaid Johar to negotiate and enter into agreements with tenants of Bhendi Bazaar. They are instrumental in getting consent letters of over 3200 families whose fate now remains hanging. The credentials of these 2 men who head the company are highly questionable and some members who have relatives in Bhendi Bazaar area can probably provide more info with regard to their past activities.

MUMBAI: The state government has found a way around to enable the 16.5-acre Bhendi Bazar cluster redevelopment project to move ahead.
It has zeroed in on a clause in the cluster redevelopment policy that mandates a minimum of one acre for a cluster redevelopment project.
The Saifee Burhani Upliftment Trust (SBUT), which has undertaken the project, has already divided it into nine sub-clusters to phase out reconstruction. Each sub-cluster is of more than one acre, said SBUT secretary Sheikh Abdeali Bhanpurawala.
"The government told us that so long as the sub-cluster is at least of one acre and we own 100% property, we can carry out redevelopment,'' said Bhanpurawala, adding that they can immediately start redevelopment in clusters one, two, three and six.
The most ambitious cluster redevelopment project in the city is unable to take off as it is mandatory for the developer to own all properties in the cluster.
The trust, which has so far purchased 85% of the properties, is unable to get the remainder due to "unreasonable'' demands of those land-owners.
"As the entire 16.5 acres cannot be taken up for redevelopment at the same time, I have requested the government to allow redevelopment in pockets,'' said Amin Patel, the local Congress legislator. A meeting was held with Sachin Ahir, minister of state for housing, a fortnight ago, where an in-principle approval was apparently granted for the sub-cluster redevelopment.
The policy, which was framed in 2009, has not taken off. The state government wants to make the cluster redevelopment policy its flagship programme for urban renewal of the city. Civic officials said, "The redevelopment of single, old and dilapidated buildings under 33(7)
will result in pencil-thin buildings and the city will not gain in terms of wide roads, better drains, parking facilities, schools, libraries and other public amenities. Instead such redevelopment will be a burden on infrastructure.''
Bhanpurawala said once the trust obtained written approvals from the government, it would submit building plans to the Brihanmumbai Municipal Corporation (BMC) for clearance.
The trust has also sought a floor space index of four for transit camps so that it can accommodate more residents. It also has to swap 4,500 sq metres of land with the BMC.
"We want to take over the BMC land in the cluster and will give it other land in the cluster's vicinity,'' said Bhanpurawala.
