In 1951, however, the leader of the Dawoodi Bohras, Syedna Taher Saifuddin, challenged the Prevention of Excommunication Act in the Bombay High Court. The Syedna’s contention was that the Act infringed upon his constitutional freedom of religion by curtailing his right, as the religious head, to discipline the community by casting out “errant” members.
When the High Court upheld the Act, the Syedna appealed in the Supreme Court and in 1962, a five-judge bench finally gave a divided verdict. A minority among the judges wanted the Act to be upheld, but the majority judgement regarded excommunication as a legitimate practice of a community that had to be protected under Article 26 of the Constitution, which grants individuals the freedom to manage religious affairs. The apex court concluded that the Prevention of Excommunication Act was unconstitutional.

And in my mind there is no doubt that STS loved SKQ – that is why SKQ, of all his children, was made the mazoom. And SKQ’s love for STS is also evidently clear. [In spite of the claims of SMS that SKQ did adawat of STS.]
The fact that SMS makes statement that SKQ did adawat of STS tells me that a lot of the other claims of SMS should also be discounted.

Desi people will spend lakhs and crores in making opulent homes/waajebaat (applicable to bohras) etc but will not spend a few bucks for short circuit or fire avoidance equipment/system. With flammable stock such as paint, thinner, this disaster was waiting to happen someday!

In the annals of Kothar history, prime real estates, revenue producing properties, musafirkhanas, sports clubs, etc. have all been 'pachaved' by it. Perhaps the four have selective amnesia. No school for 10 days; Muharram prayers are a must, says Syedna
Syedna Mufaddal Saifuddin, the spiritual leader of the Dawoodi Bohra community, has made the 10-day mourning period for Muharram starting October 14 compulsory for followers. A notice issued by the Syedna Trust last week states that children would have to stay at home for prayers and has advised parents to apply for leave, both at schools and their offices. The notice states that those not following the diktat could face consequences.
There are approximately 2.5 lakh Dawoodi Bohras in Mumbai and the notice is being mailed in batches to their homes. The process started last week.
Although Qureshi Raghib, the Dawoodi Bohra community spokesperson, refused to comment on the issue, a member from Andheri confirmed the same to Mumbai Mirror. "Muharram is a very important time for any Shia not only in Mumbai but across the world.
Our Syedna has always asked us to attend the 10 day long prayers but this year he has made it compulsory. Everyone has to attend for all 10 days without fail," he said.
Some members of the community voiced their dissent over making the period of mourning compulsory. They said there are rumours that members who don't attend the prayer on all days could face cancellation of their e-Jamaat cards. The blocking of the card means that the person cannot enter any mosque or religious gathering where access is controlled through the card.
A member from Mazagaon told Mumbai Mirror: "Prayers during Muharram have always been optional and I see no reason to make it compulsory now. My husband works in a private firm and it is very difficult for him to ask for leave for ten days. Even schools are reluctant towards granting leave for such a long period of time since the students miss classes and find it difficult to catch up."
Shortly after receiving the notice, parents have started applying for leave to avoid objection from the school authorities later. "We don't want a repeat of what happened during Laylat al-Qadr where the principal had punished students who missed school on July 9. Parents are thus applying for leave from this month itself," said a parent whose daughter studies at St. Agnes School in Byculla.
Laylat al-Qadr, or the 'Night of Power', is a very significant event for Muslims and is considered the most auspicious period to pray for forgiveness.
Another parent whose daughters study in St Mary's school in Mazgaon confirmed the receipt of the notice which came on Thursday. "Muharram is an important event in our community where we pray and mourn from morning till evening. It is difficult for the children to attend classes in school during this period. The state government grants leave to schools for festival like Ganesh Chaturthi and Christmas.
Why should we not get holidays for an event as important as Muharram," she asked.
Messages about the notice have been circulating on social media. One such message states that in case parents face difficulties in getting leave sanctioned, they can use the Jamaat letterhead from the community's education officer and submit the application to the principal.

એટલું જ નહીં એવું કરવામાં નહીં આવે તો તેમણે પરીણામો ભોગવવા પડશે તેવી ચેતવણી પણ અપાઈ છે. બીજી બાજુ વ્હોરા સમાજના સભ્યોએ આ આદેશ અંગે અસંતોષ વ્યક્ત કર્યો છે. લોકોનું કહેવું છે કે ખાનગી નોકરીઓમાં કામ કરતા લોકો માટે દસ દિવસની રજા લેવી ખૂબ જ મુશ્કેલ છે.
ઉપરાંત બાળકોને પણ પ્રાર્થનામાં હાજર રહેવા માટે સ્કૂલોમાંથી રજા નહીં મળે. તેનાથી બાળકો સ્કૂલમાં પાછળ રહી જશે તેવો ભય પણ માતા-પિતાએ વ્યક્ત કર્યો છે. તેમનું કહેવું છે કે અગાઉ ક્યારેય પ્રાર્થનામાં હાજર રહેવાનું ફરજિયાત બનાવાયું નથી અને તે પણ ખાસ કરીને બાળકો માટે તો નહીં જ. ઉલ્લેખનીય છે કે મુંબઈમાં જ દાઉદી વ્હોરા સમાજના અંદાજે અઢી લાખ સભ્યો છે.
ઈ-કાર્ડ્સ રદ થઈ શકે
નોટિસમાં કહેવાયું છે કે પ્રાર્થનામાં ગેરહાજર રહેનારા લોકોને ઈ-જમાત કાર્ડ્સ રદ થઈ શકે છે. આ કાર્ડ્સ રદ થવાનો અર્થ છે કે આ સભ્યો સમાજની મસ્જિદો, ધાર્મિક સ્થળો અને સભાઓમાં ભાગ નહીં લઈ શકે.

if abdes and liberal Bohras succumb to the threats and comply , SMS Will get the confidence to oppress further.
at times I feel time has come to draw the fight ...not attend risk barat , or see if this threat is a bluff
people need the courage to stare the threat eye to eye ...let the showdown begin .
the least I can promise is both will have pain, not go down alone .

idea is to eliminate all poor middle class working families from community and just keep big fat a** rich guys in community so they can enjoy the property of dawoodi bohras worldwide. and also to terminate all rebels and truth speaking people and only chancha and blind slaves are allowed to stay in community but this wont happen...

The problem is that bohras are ultimately big cowards. They are strong only to do maatam, which is actually beating themselves. They will never stand up to injustice like their idols have done. So, they will suffer this ignominy in life and even in death if they continue to bow down to this Dai.

This is exactly the problem with Bohris. They are spineless, groveling, ignorant idiots. They will talk big on "revolution", "changes" this and that, but when the mullah looks at them they will fall on their faces and grovel in front of him, begging him forgiveness. Hence, there is no chance of change, no chance that things will be different. All Bohra men are just hijjras. Actually, I should not say that. Hijjras are very bold and brave, but these spineless cretins are neither bold nor brave. Such fear and such cowardice is unprecedented in history. In open letter, the journalist says middle-class Bohras will be hit hard if they are not allowed to attend work and school for 10 days.
A reformist from the Dawoodi Bohra community has come out in the open challenging Syedna Mufaddal Saifuddin's order for followers to stay at home during the 10-day mourning period for Muharram starting October 14.
Saifuddin Insaf, general secretary of the Central Board of Dawoodi Bohra Community, has written an open letter, suggesting use of technology and other means to help members join the prayers on mourning days without compromising their daily routine.
In his letter of August 15, Insaf has criticised the move to keep members from offices/businesses and children from schools for a long period. Earlier, the diktat sent by the Syedna Trust to every Bohra household had warned that those not following the order could face consequences.
"Janab, do you know what the majority of ordinary Bohra families will undergo when their breadwinner loses 10 days of earning to submit to your above diktat? No, because you have enormous wealth, sufficient for your ten generations to live in luxury. You don't have to earn for your daily needs, medical treatment, school or college fees, functions, marriage, burial, etc," reads the communication from Insaf, who is also the editor of Bohra Chronicle.
Insaf has urged the spiritual leader to make use of IT such as YouTube, prerecorded compact discs (CDs) to deliver sermons to the members of the community. On the one hand, the reformist's letter goes on to say, community leaders have embraced modern inventions to reach out to the members, but on the other, diktats like this are being issued to make them retrogressive. There are nearly 2.5 lakh Dawoodi Bohras in the city.
"You are taking full advantage of computers, Internet, WhatsApp, DVDs, YouTube and other devices of communication, but you are making every effort to keep the community members backward by indulging them in community kitchens and tiffin deliveries"
Insaf's open letter says that sermons can be given in a manner similar to the ones followed by other Shia Muslims (with flexible timings), and pre-recorded CDs be passed on to the members so that they can listen to them whenever possible.
"I request you to revoke your order and instead of asking mumineens to shut shop, skip offices and children to skip school, you change the timing of your sermons from 6 pm to 9 pm."

A reformist from the Dawoodi Bohra community has come out in the open challenging Syedna Mufaddal Saifuddin's order for followers to stay at home during the 10-day mourning period for Muharram starting October 14.
Saifuddin Insaf, general secretary of the Central Board of Dawoodi Bohra Community, has written an open letter, suggesting use of technology and other means to help members join the prayers on mourning days without compromising their daily routine.
In his letter of August 15, Insaf has criticised the move to keep members from offices/businesses and children from schools for a long period. Earlier, the diktat sent by the Syedna Trust to every Bohra household had warned that those not following the order could face consequences.
"Janab, do you know what the majority of ordinary Bohra families will undergo when their breadwinner loses 10 days of earning to submit to your above diktat? No, because you have enormous wealth, sufficient for your ten generations to live in luxury. You don't have to earn for your daily needs, medical treatment, school or college fees, functions, marriage, burial, etc," reads the communication from Insaf, who is also the editor of Bohra Chronicle.
Insaf has urged the spiritual leader to make use of IT such as YouTube, prerecorded compact discs (CDs) to deliver sermons to the members of the community. On the one hand, the reformist's letter goes on to say, community leaders have embraced modern inventions to reach out to the members, but on the other, diktats like this are being issued to make them retrogressive. There are nearly 2.5 lakh Dawoodi Bohras in the city.
"You are taking full advantage of computers, Internet, WhatsApp, DVDs, YouTube and other devices of communication, but you are making every effort to keep the community members backward by indulging them in community kitchens and tiffin deliveries"
Insaf's open letter says that sermons can be given in a manner similar to the ones followed by other Shia Muslims (with flexible timings), and pre-recorded CDs be passed on to the members so that they can listen to them whenever possible.
"I request you to revoke your order and instead of asking mumineens to shut shop, skip offices and children to skip school, you change the timing of your sermons from 6 pm to 9 pm."
Despite many calls and messages, Raghib Qureshi, spokesperson of the community, chose not to respond.

MUMBAI:The fight between an uncle and his nephew for the chair of Syedna, the supreme spiritual leader of the Dawoodi Bohra community, has taken an interesting turn after the first bout in the Bombay High Court is over. The second round will begin on August 24.
Khuzaima Qutbuddin, 74, has challenged the appointment of his nephew Mufaddal Saifuddin, 70, as the 53rd Syedna. He claims that the 52nd Syedna—his elder brother, the late Muhammad Burhanuddin—had appointed him as his successor in 1965, almost 49 years before his death on January 17, 2014. Saifuddin, the second son of Burhanuddin, also claims that he is the natural heir to the chair.
In Bombay High Court’s room number 46, people listened curiously when Qutbuddin told the court that he was wearing a ring that originally belonged to the 51st Syedna Taher Saifuddin, his father. He claimed that late Syedna Burhanuddin had given him the ring after he pronounced nass (official anointment) on him. “The Syedna appointed me as Mazoon (second in hierarchy). He also pronounced nass on me. He gave me this ring, which I wear to this day,” Qutbuddin told the court when the current Syedna Saifuddin’s lawyer Iqbal Chhagla cross-examined him.
Qutbuddin pointed out that Burhanuddin was a Mazoon before his predecessor made him a Syedna. He, however, maintained that the nass was not made public because Burhanuddin feared there could be violent reactions to it. None of his other 11 brothers and eight sisters were aware of it either.
According to Qutbuddin, his half-brother Najmuddin, who was 20 years older to him, influenced Burhanuddin’s family to declare Saifuddin as the Syedna. Interestingly, Saifuddin is Najmuddin’s son-in-law. Qutbuddin also said that two attempts were made to kill him; first in Indore during Muharram and the second in Yemen. The car in which he was supposed to be travelling in was shot at.
Qutbuddin’s lawyer Ravi Kadam will cross-examine Saifuddin from Monday in the same courtroom where Muhammad Ali Jinnah had unsuccessfully argued against the six-year jail term to Lokmanya Bal Gangadhar Tilak in 1914. In a rare scenario, the entire proceeding is being videotaped.
The Syedna and Mazoon’s absolute authority over the rich Dawoodi Bohra community has brought the family to the court. The Dai (Syedna) and Mazoon together guide the community and have control over its mosques, trusts, hospitals and educational institutes. The trust runs a super speciality hospital in Mumbai and also oversees a redevelopment plan of Bhendi Bazaar, one of Mumbai’s most crowded areas. The project cost runs into crores of rupees.
In his 700-page suit, Qutbuddin has given details on why he is the right claimant to the chair. In contrast, Saifuddin has filed a 494-page affidavit elaborating on how he is the obvious choice for the position.
Qutbuddin’s supporters have launched a Facebook page to underpin his claim. They say that Saifuddin is a regressive person and does not like women stepping out of their homes. Saifuddin has ordered the community members to remain indoors for 10 days during Muharram, as it is a period of mourning. The order has not gone well in the community, known for its liberal views.
Saifuddin’s cross-examination from Monday will also give answers whether he is regressive.

Akhlaaq of DB are deteriorating day by day, sense of love and care and appreciation for each other is vanishing in community. DB are forgetting ways of ahlul bayt which is really bad for coming generations.
